HOME AGAIN RESCUE ADOPTION CONTRACT

This contract is made between _______________________________________ (Adopter) and Home Again Dalmatian Rescue. (HADR).

HOME AGAIN RESCUE AGREES TO DO THE FOLLOWING:

1. Give the Adopter title to, possession and control of the dog as described:

for so long as the ADOPTER complies with the terms of this contract. All liability due to property damage or personal injury will be transferred to the new owner upon adoption.

2. Provide ADOPTER with any and all veterinary records available for dog along with current medications.

3. ADOPTER acknowledges receipt from HADR of a fee as noted below to aid with reimbursement of expenses incurred to consider dog for adoption.

IN RETURN, THE ADOPTER AGREES TO THE FOLLOWING:

1. Keep the dog as a pet and companion and not to abandon, trade, give away, or sell it, nor is the dog to be used or sold for commercial use or research purposes. If the ADOPTER no longer desires or is unable to keep the dog within the terms of this contract the dog must be returned to HADR unless HADR approves another owner and all information of new owner is given to HADR. It is NEVER to be turned over to an animal shelter or euthanized. If a certified vet feels the dog needs to be euthanized for any reason HADR has to be notified first.

2. Provide adequate, high-quality food (ie; Science Diet, Purina, Pedigree or Iams) fresh water, shelter, daily exercise, and medical care at all times and care for the dog in a devoted and humane manner for the remainder of its natural life.

3. Have the dog examined, vaccinated and spayed/neutered if not already done so by a licensed veterinarian within one month of adoption ( (or when dog is age appropriate) and at least once a year thereafter, maintain appropriate vaccinations and other preventive health and dental care, including but not limited to year-round heartworm and flea prevention, and gives HADR permission to contact ADOPTERS vet if needed to verify care.

4. Have the dog spayed/neutered and vaccinated as early as ADOPTERS Vet will allow but no later than 6 months of age if it was a puppy less than 5 months of age upon adoption.

5. To send proof of spay/neuter to Home Again Dalmatian Rescue at PO BOX 33 Belk AL 35545 no later than 2 weeks after stated date below, if no proof is received within that time period HADR has the right to reclaim the adopted dog

6. The dog shall reside within the ADOPTER’S home or secure fenced yard, not be crated for more than 8 consecutive hours and not be left in a fenced yard while ADOPTER is not home more than 8 consecutive hours without being checked on, and dog should be provided shelter. The dog shall NOT ride in the back of a truck without a safety tie or harness, the safety tie or harness should prevent the dog access to the sides of the truck, and dog should not be left in a car unattended for more than 15 minutes in extreme weather.

7. Keep the dog under the ADOPTER’S control at all times and not let the dog roam freely outside of the home or fenced yard. Keeping the dog on a chain, rope or tie out is not permitted; a dog RUN is okay as long as the dog cannot get tangled and is not on it for longer than 2 hours, but this method of restraint is not preferred.

8. Provide a humane collar or harness for the dog to wear at all times and to keep on this collar, at minimum, the rabies tag.

9. ADOPTER must notify HADR within ten days if dog becomes lost or dies as well as any change in address, phone number or dogs’ veterinarian. Written proof by a veterinarian of the dog’s death if the dog should pass should be mailed to HADR. If the dog dies due to accident and not in the presence of a vet, a written explanation should be mailed to HADR for their records.

10. During the dog’s lifetime HADR may visit the premises where the dog is kept and reclaim the dog if, in the judgment of HADR, the dog is not being adequately cared for or ADOPTER has not complied with any provision of this contract.

11. ADOPTER agrees to pay all costs necessary to enforce this agreement including reasonable attorneys’ fees, costs of litigation, dog recovery fees, and all medical bills to restore the dog’s health back to adoptable status. Jurisdiction for any disputes shall be in the county and state where the dog resides.

12. The ADOPTER authorizes any animal care or control agency to release the dog to an HADR representative, hereby designated as Agent for the ADOPTER, if the dog is found running at large or is brought into a sheltering facility for any reason.

13. ADOPTER acknowledges that the dog is adopted “as is” and that no implied or expressed warranties have been made by HADR in reference to the health, training and/or temperament of the dog. HADR will disclose all information to the best of their knowledge known about the dog, and only knows as much as they are told and has seen in the time the dog has been in Rescue. HADR shall not be held responsible for any veterinary expenses including spay/neuter after adoption, if applicable, of the dog or held liable for any misrepresentations unknown to HADR.

14. ADOPTER understands that should the dog cause personal injury or property damage after adoption, HADR shall in no way be liable in whole or part for that damage and hereby assumes and agrees to hold HADR harmless from any and all liability for the dog, or any injury or damage that may be caused by it. ADOPTER hereby waives all claims, losses, or damages which may arise after the adoption of this dog, caused by any act or omission by HADR which results in personal injury or property damage to any person by this dog, and the ADOPTER agrees not to bring any legal action seeking any remedy against HADR in connection with this agreement or in connection with personal injuries or property damage claimed to result from any act or omission by HADR whether by ADOPTER or any third party.

Adoption Fee: _________which helps reimburse some of the cost of neuter, microchip, shots, worming, vet visit, rescue, and care while at the rescue. ADOPTER understands that the adoption fee is a tax deductible donation to HADR and therefore is not refundable, and that the ADOPTER is not paying for the dog, they are reimbursing some of the expenses incurred by getting the said dog adoptable and spayed neutered if applies.
