HENRY EDWARD DIBDIN Dated 6 Sep 1866 Presented at Edinburgh Sheriff Court 11 Sep 1866 Scottish Documents: Will Ref. SC70/4/105; Inventory Ref. SC70/1/131 I Henry Edward Dibdin, Professor of Music, at present residing at Flodden Lodge, Morningside near Edinburgh, Considering it to be my duty to settle my affairs during my lifetime in such a way as to avoid all disputes regarding them after my death and having full and entire confidence in the integrity & ability of the persons after named for executing the trust hereby reposed in them have therefore assigned & Disponed as I do hereby Give Grant Assign and Dispone from me my heirs and successors to & in favour of Mrs. Isabella Perkins Palmer or Dibdin my wife Huntly Lawton of the Inland Revenue Excise Department residing in Edinburgh, and John Thomson Mowbray Writer to the Signet and to such other person or persons as shall be assumed in virtue of the powers after written to act in the trust hereby created & to the acceptors and acceptor and survivors and last survivor of the persons hereby named or to the named or assumed as aforesaid as Trustees for executing the trust hereby created, the majority of the said Trustees whilst more than two accepting are alive and acting as trustees being always a quorum whom all failing then to the nearest heir male of the last accepting and surviving trustee who shall be major sui juris & resident in Scotland at the time (the said Trustees named and to the named & assumed and their aforesaid being throughout these presents denominated “my Trustees”) and the Assignees of my Trustees heritably and irredeemably All and Sundry lands houses and real or heritable property and estate of every description wherever situated which shall belong to me at the time of my death Also my whole moveable or personal property means and estate of whatever kind or denomination & wherever situated, heirship moveables included which shall belong to me at the time of my death together with the whole titles writs and evidents vouchers & instructions of and concerning the said whole property means and estate heritable & moveable real and personal hereby generally conveyed: And I Bind & Oblige myself my heirs and successors to grant all necessary deeds and writings in favor of my Trustees for implementing and fulfilling the preceding general Disposition & Conveyance of my whole heritable and moveable real and personal property means and estate: And I Nominate & Appoint my trustees to be my sole Executors Declaring always that these presents are granted by me in trust only for the uses and purposes after mentioned: Viz First That my Trustees shall from the produce of my property means and estate pay all my just and lawful Debts deathbed & funeral charges and the expense of executing the Trust. Second That my Trustees shall pay and deliver all such legacies gifts or provisions and implement all such instructions as shall be contained in my Codicil or any Memorandum or writing by me clearly expressive of my Will though not formally executed, declaring that the same whether formal or informal shall be held & taken to be part and parcel of these present: Third That my trustees shall hold the residue of my whole real or heritable property and estate or prices or proceeds thereof after payment or deduction of any debts affecting the same for behoof of the said Wo. Isabella Perkins Palmer or Dibdin if she shall survive me in liferent for her liferent use allenarly and for behoof of all my children born or to be born who shall survive me or their lawful issue as after-mentioned in fee, & shall pay over the free annual interest or income thereof to the said Isabella Perkins Palmer or Dibdin during all the days of her life after my death: declaring that she shall be bound out of the said annual interest or income so paid to her and the share of my personal or moveable property means and estate hereinafter appointed to be paid to her (but that only in so far as may be necessary after applying the free annual income or produce of the share of my personal or moveable property means and estate hereinafter provided to them) to maintain and educate in a proper and suitable manner all my children born or to be born who shall survive me unless they then are or until they shall be respectively be established in life, when the said obligation on her to maintain & educate them shall cease Fourth That my Trustees shall divide the free residue of my personal or moveable property means and estate into three equal parts or shares and shall pay or make over two of such parts or shares but under deduction always of any legacies or bequests which I may leave or appoint to be made or delivered under or in terms of the second purpose of these presents to my said wife if she shall survive me as her own absolute property: and Fifth That my Trustees shall hold the remaining share of my said personal or moveable property means and estate as well as the fee of my said real or heritable property and estate or prices or proceeds thereof (subject always such real or heritable property and estate or the prices or proceeds thereof to the liferent right of my said wife as aforesaid) for behoof of all my children born or to be born, who shall survive me and the lawful issue of any who may predecease me or die before receiving their shares (such issues being entitled to the shares that would have fallen to their parents respectively had he or she or they survived) equally among them if more than one share and share alike in manner following: That is to say to pay or convey the shares of my said personal or moveable property means and estate and also provided my said wife shall be then dead but not otherwise, the shares of my said real or heritable property falling to Sons on their respectively attaining majority and the shares falling to Daughters on their respectively attaining majority or their being married whichever of these events shall first occur and my trustees shall pay and apply the whole or such part as they shall think necessary of the shares of the annual interest or income of my said personal or moveable and also when the right thereto shall open, of my said real or heritable property means and estate falling to such of my children or other descendants as if sons shall be minors or if daughters shall be minors and unmarried for their maintenance and education, declaring that my trustees shall be the sole and exclusive judges of the mode and extent of such application and that any part of the annual interest or income which may not be so paid and applied and accumulations thereof shall be retained by my trustees for behoof of the Child or Children or other descendants to whom the same respective belong, and shall be paid over to them along with their respective shares of the Capital or fee of my said property means and estate: Declaring further that if any of my children shall predecease me or die before receiving their shares of my property means and estate, leaving lawful issue, such issue shall be entitled to the share or shares which would have fallen to their parents respectively had he or she or they survived: Declaring that the provisions herein contained in favour of my said wife and children are in full satisfaction to my said wife and all terce or dower half or third of moveables and all she could ask or claim jus relictae or otherwise through my death and to my children & each of them of all bairn’s pairt of gear, legitum, executry & every other claim or provision whatever which they could by law ask or demand by & through my decease or the decease of their mother : And I hereby Give full power to my trustees to make up & complete in their persons as Trustees foresaid all proper titles to the property means and estate hereby generally conveyed or to which my trustees may at any time have right as falling under the trust hereby created: With full power to my Trustees to grant leases of all or any part of the lands or heritages hereby conveyed upon such terms and conditions & for payment of such rents and for such endurance not exceeding nineteen years as my trustees shall think proper: And also to appoint either one of their own number or any other person with or without caution to be their factor or agent or cashier for the purpose of uplifting discharging or conveying the trust funds and the securities held by them for the same, and for applying to the same for the purposes of the Trust, And to give a reasonable allowance to such factor agent or Cashier for his trouble: And I also give my trustees full power to borrow money for the purposes of the trust on the security of the property estate and effects hereby conveyed or any part or portion thereof and also full powers of sale by public coup or private bargain, but declaring that so far as regards any real or heritable property & estate the same shall not be exercised without the consent of my said wife during her survivance and also power of compromise or submission and in general power to do or cause to be done everything necessary for the execution of the said trust and for these purposes to grant subscribe and deliver all writs and deeds requisite & necessary: And I hereby declare that my Trustees shall in nowise be liable for any omissions in management nor for the omissions or neglects of their factors, agents & cashiers nor for the responsibility of them or their Cautioners, if caution shall be required, nor for the responsibility of the debtors, purchasers, and others with whom any trustees may transact, nor for the insufficiency or depreciation of any securities or stocks in which they may invest the trust funds which they are hereby empowered to do in such government securities or mortgages or real or heritable property and first class debentures as they shall think fit: but declaring that my trustees shall otherwise invest any part of the trust funds in Bank shares or the shares of railway or other joint stock companies or on personal security: And declaring farther that any Trustees shall be only bound to act honorably and shall nowise be liable singuli in solidum or for one another but each for himself only and for his own personal intromissions or wilful default and no farther or otherwise; And my Trustees are hereby empowered from time to time to Nominate & Appoint any person or persons to be a Trustee or Trustees along with and after them or in place of any trustee or trustees who shall die or desire to resign and be discharged which they shall have full power to do, or who shall refuse, decline, or become incapable to act in the Trust, which trustee or trustees to be so assumed shall have the full power and privileges of my trustees before named: And I Nominate and Appoint the said Mrs Isabella Perkins Palmer or Dibdin, Huntly Lawton & John Thomson Mowbray & such other person or persons as shall be named or assumed as trustees as aforesaid and the survivors or survivor of them who shall accept to be tutors and curators to such of my Children born or to be born, as shall be pupils or minors at the time of my death during their respective pupillarities or minorities: Declaring that a majority of the said tutors and curators accepting and surviving shall at all times form a quorum: and I Give and Grant to my Trustees and tutors and curators foresaid all the powers competent to Tutors and Curators by the Law of Scotland for managing the estate and effects of minors hereby declaring that the said tutors and curators shall not be liable for omissions of any kind or for not doing diligence or for one another but each for his own actual intromission only: And I reserve full powers to revoke these presents in whole or in part: And I dispense with the delivery thereof: And I reserve my own liferent right: And I revoke all former Settlements made by me: And I Consent to the Registration hereof for preservation: In Witness whereof I have subscribed these presents consisting of this and the two preceding pages with one marginal addition on page first and two marginal additions on page second all written by James Matthew Clerk to the said John Thomson Mowbray, At Edinburgh the sixth day of September Eighteen hundred and sixty four before these witnesses the said James Matthew and H.E. Dibdin; Stamp £15; 11th Sept. 1866 At Edinburgh the eleventh day of September in the Year Eighteen hundred & sixty six the following Inventory of the personal Estate of the deceased Henry Edward Dibdin & Deed relative to the disposal thereof were presented by John T. Mowbray W.I.
At Edinburgh the eleventh day of September Eighteen hundred and sixty six in the presence of Thomas Inglis Depute Commissary clerk of Edinburgh Appeared John Thomson Mowbray Writer to the Signet One of the Executors of the deceased Henry Edward Dibdin Professor of Music who resided at Flodden Lodge Morningside near Edinburgh who being solemnly Sworn & Examined Depones that the said Henry Edward Dibdin died at Flodden Lodge aforesaid upon the sixth day of May One Thousand Eight hundred and sixty six and that the deponent and Mrs Isabella Perkins Palmer or Dibdin formerly Wife and now Widow of the said Henry Edward Dibdin, and Huntly Lawton of the Inland Revenue Excise Department residing formerly in Edinburgh & at present at Murrayfield near Edinburgh, are about to enter upon the possession & management of the deceased’s Estate as Executors nominated by him in a Trust Disposition & Settlement Executed by him on sixth September One Thousand Eight hundred and sixty four which is now Exhibited and signed by the Deponent and the said Thomas Inglis of this date as relative hereto. That the deponent does not know of any Testamentary Settlement writing relative to the disposal of the deceased’s personal Estate & Effects or any past thereof other than the said Trust Disposition & Settlement that the foregoing Inventory which is signed by the deponent and the said Thomas Inglis as relative hereto is a full and complete Inventory of the personal Estate and Effects of the said deceased Henry Edward Dibdin wheresoever situated & belonging or due to him beneficially at the time of his death in so far as the same has come to the deponents knowledge. That the deponent does not know of any money or property belonging to the deceased liable to the duty imposed by the Acts Twenty three Victoria Chapter fifteen & Twenty three & Twenty four Victoria Chapter Eighty That the value at this date of the said Personal Estate and Effects situated in the United Kingdom including the Proceeds accrued thereon down to this date is Six hundred pounds & under Eight hundred Pounds Sterling That confirmation is required in favor of the deponent and the said Mrs Isabella Perkins Palmer or Dibdin and Huntly Lawton. All which is truth as the deponent shall answer to God
