(hereafter referred to as "THE PAINTER")



 

ARTICLE 1

This CONTRACT is about organizing exhibition of PAINTER'S works of art (the paintings) by GALLERY, and accomplishing duties of compensation for organizing and holding exhibition by Sasa Kolic PAINTER from Nis, as the performer .

 

ARTICLE 2


THE PAINTER is obliged to perform his CONTRACTUAL DUTIES, which are: to leave or to deliver to THE GALLERY number of ordered paintings after exhibitions, as a fee for organizing and holding exhibition, defined in his order stated in ANNEX 1, (ORDERING STATEMENT). Order is to be made following one of the suggested points:

POINT 1) one painting of following dimensions 100x75 or 100x70 or 100x60 or 90x80 or 90x70 or 90x60 or 80x80 or 80x70, technique oil on canvas, latest three months after the exhibition ends;
OR
POINT 2) two paintings of following dimensions 70x70 or 70x60 or 70x50 or 80x60 or 80x50 or 90x50, technique oil on canvas, first latest in three months, the other latest in six months after the exhibition ends;
OR
POINT 3) three paintings of following dimensions 70x40 or 60x50 or 60x40 or 50x50, technique oil on canvas, according the scheme: first painting in three months, second in six months, third in nine months after the exhibition ends;
OR
POINT 4) four paintings of following dimensions 50x40 or 50x30 or 40x40 or 40x35 or 40x30 or 30x30 or 30x35, technique oil on canvas, according the scheme: first painting in three months, second in six months, third in nine months, fourth in twelve months after the exhibition ends;
OR
POINT 5) six paintings dimensions 35x50, technique oil pastel / mixed technique on cardboard, according the scheme: first painting latest in two months, second in four months, third in six months, fourth in eight months, fifth in ten months and sixth in twelve months after the exhibition ends. Note: all dimensions are in centimeters.
Note: all dimensions are in centimetres.



ARTICLE 3

THE PAINTER is not obliged to frame paintings for exhibition.

 

ARTICLE 4

THE PAINTER is obliged to provide to THE GALLERY every necessary information about himself and artworks which will be exhibited (dimension, techniques, year, prices).

ARTICLE 5

THE PAINTER will determine and financially cover the conditions of paintings delivery for exhibition at list 15 days before exhibition will be open. THE PAINTER will pack the paintings in order to avoid damaging. THE RISK of the transport from THE PAINTER to THE GALLERY is on THE PAINTER.

ARTICLE 6

The obligation of THE GALLERY is to organize exhibition (that will last minimum 15 days) which will be arranged by CONTRACTING PARTIES and to inform THE PAINTER at least month before the Opening nigh. Framing the paintings and providing properly catalogue for exhibition is the responsibility of THE GALLERY.

 

ARTICLE 7

The GALLERY have to choose the paintings for compensation before the exhibition opening.

 

ARTICLE 8

THE GALLERY will determine and financially cover the conditions of paintings return to THE PAINTER after the exhibition is over or canceled. THE GALLERY will send back the paintings in the same condition as they received. THE RISK of the transport in this case is on THE GALLERY.

ARTICLE 9

THE GALLERY is obliged to reimburse any eventual damage of the paintings, made during the period while THE PAINTINGS are in THE GALLERY'S responsibility or while transporting them, regardless to the cause of the damage (fire, robbery, flood or any cause that can not be foreseen).

 

ARTICLE 10

THE GALLERY have right on provision which will be built over the PAINTER'S price of painting sold during the Exhibition period (from the date of received the paintings to the date of return paintings back to THE PAINTER).

 

ARTICLE 11

Competent JURISTICTION AUTORITIES will handle any problematic issue, in the country of DEFENDANT.

 

ARTICLE 12

THE GALLERY can break THE CONTRACT in case that THE PAINTER does not fulfil his obligations in agreed time. THE PAINTER can break THE CONTRACT in case that THE GALLERY does not organize exhibition in agreed time. In that case THE GALLERY is obliged to return the paintings undamaged and properly packed, latest in two weeks after THE CONTRACT breaking. In that case obligations stated in ARTICLE 6 should be followed.

 

ARTICLE 13

THE ORDERING STATEMENT is constituent part of this CONTRACT and will be attached to THE CONTRACT as ANNEX 1.

 

ARTICLE 14

This CONTRACT is made into FOUR identical copies, two for each contracting party.
