Dear Dr Zuma

MEDICINES CONTROL COUNCIL TYRANNY & COMPLEMENTARY MEDICINES COMMITTEE CREDIBILITY CRISIS

This is not an appeal for assistance in my personal conflict with the MCC, but rather a selfless plea that you take urgent cognisance of an ever-increasing trend of pharmaceutical driven MCC tyranny against natural health products, without a rational basis and contrary to original legislative intent and constitutional principles.

I fear that without your near immediate personal intervention, this escalation of abuse by the MCC is destined to result in an unnecessarily ugly conflict situation wherein the MCC will force natural health products interests to resort to legal action (currently in preparation), not against the MCC, its secretariate and inspectorate, but because of Section 25 indemnity and no other option, regretably against yourself and the Dept. Of Health, in order to protect the existence of said products in what is purported to be an open and democratic society.

In November I met with Prof. Rachel Gumbi in an attempt to deflect a lawsuit in excess of 20-million rand against the Ministry and Department, arising out of gross MCC abuse of a fellow competitor and comrade in arms. Rachel liased with Dr. Olive Shisana (Director General : Dep. of Health) who in turn liased with me, undertook to investigate and subsequently established that the secretariate deliberately concealed costly and unnecessary court rulings against the MCC from the D.G. and the Department's legal department.

Unfortunately, little relief has been forthcoming from these quarters and the clock is ticking on million rand scandal, which will be further aggravated by pending and fast developing the Department's opportunity to act constructively and avoid a high-profile multi-interdict and Constitutional Court challenges, should you not within the next fortnight manage to diffuse the fast deteriorating crisis. I have little influence over developments beyond this stage and hence my plea that we take hands rather than fists into the future.

My sole interest in these matters is to avoid allowing the MCC to strengthen their hand by driving a wedge between the Dept./Ministry and natural health products interests by forcing action against yourselves as the only option should the gravity of our plight not receive immediate cognisance and constructive steps be instituted to investigate and restrain the MCC, its secretariate and inspectorate's culture of tyranny developed under the former regime and now being used by powerful philosophical and commercial forces to control the means to health.

I offer the following documents as an introduction to the most recent developments and also my services in any possible manner likely to defuse the current situation and contribute to an equitable system of control in line with the Government's health plan. I personally believe that some kind of fusion between the US and UK regulatory systems would be most appropriate and possibly this concept could be a starting point, since the FDA model is what we are stuck with and the UK model encapsulates the Western liberal tradition.
