What is Bail Enforcement?
When one is arrested and/or jailed for one's suspected exercise of criminal intent,
they (under most circumstances) are given the opportunity to "make bail". Since
one is a SUSPECT in commiting a crime until they are actually convicted, bail
can be made to allow one to pursue his/her life until their trial. When one posts
bail, one does so with a bail bondsman. This becomes a contractural agreement
between the bailee and the bondsman. The bondsman has an agreement with the court,
which is that he/she is responsible for the suspect (bailee) to appear at his/her
trial. If the suspect fails to appear, the court holds the bondsman liable for
the amount of the bond prescribed by the court. That means the bondsman's gotta
pay the court the full amount of the bond. This is not the bondsman's preferred arrangement.
Due to the particular contractural agreement with the bondsman, the court has upheld
(the Supreme Court, I might add) that the bondsman, or his agent, may pursue
and bring the suspect back to jail to await his/her new situation. As the bondsman
many times has other interests which are not congruant to his/her personal pursuit
and apprehension of the suspect, he is willing to pay a percentage of the bail
to have the suspect brought back to task for his/her original charge which is now
accompanied with a failure to appear. And, this person which so accomodatingly
pursues and apprehends the fugitive is, the bail enforcement agent. Of course,
there are several other "handles" given to this person. The most common of which
is, Bounty Hunter.
