4. The evidence is;

1. EXHIBIT TWO; unfiled, CASE MANAGEMENT CONFERENCE MEMO TO BE FILED NOT LATER THAN 7 DAYS PRIOR TO CMC received by plaintiff in the mail on or about January 5, 1999 from attorneys for defendant in case 226736.

2. EXHIBIT THREE; A copy of the cover of the UNIFIED RULES and SCHEDULE OF TRAIL COURT SERVICES, FILING FEES AND SERVICE CHARGES, Effective July 1, 1998.

3. EXHIBIT FOUR. A copy of page TC-i, TABLE OF CONTENTS, RULE 100 to RULE 402.

MEMORANDUM OF POINTS AND AUTHORITIES

5. The misinformation or distraction to plaintiff detracting from his efforts of legal recourse has caused plaintiff acting in pro per emotional and mental distress.

3. The additional evidence produced by appellant is conclusive to defendants use of control of legal rules to publish misinformation or distraction, with the intent to harm plaintiffs legal ability, and for purposes of review it should be taken into the record.

6. The Appellate court in Bassett v Johnson C.A. 2d 807; P.2d 939 discovered a letter in the record a letter that had never been introduced in evidence or mentioned at the trial. The appellate court appointed the trial judge as referee for the taking of additional evidence, adopted the referees findings and made additional findings favorable to the plaintiff.

7. Appellant has not had the opportunity, beyond his initial defective complaint, to introduce the evidence because the granting of the demurrer without leave to amend precluded and dismissed the action before trial.
