SENATE BILL NO. 226

An act to ament Section 601 of the Welfare and Institutions Code, relating to minors.

ABSTRACT

SB 226 amends existing law to eliminate the incarceration and imprisonment of minors as adults

The people of the State of California do enact as follows

1 SECTION 1. Section 602 of the Welfare and Institutions Code is amended to read:

2 602. (a) Except as provided in subsdivision (b), any person who is under the age of 18 years

3 when he or she violates any law of this state or of the United States or any ordinance of any city or

4 county of this state defining crime other than an ordinance establishing a curfew based solely on

5 age, is withing the jurisdiction of the juvenile court, which may adjudge such person to be a ward of

6 the court. 7 (b) Any person who is alleged, when he or she was 14 years of age or older, to have committed one

8 of the following offenses shall be prosecuted under the general law in a court of criminal

9 other designated entity shall designate the classes of emplyees required

10 to take custody of these children.

11 SEC. 2. Section 1255.7 is added to the Health and Safety Code, to

12 read:

13 1255.7. (a) The following designations are secure abandonment

14 facilities: Emergency rooms, public prenatal clinics, fire stations, and

15 police stations.
