Recent Press Reports Concern On-going Legal Proceedings
A recent report in the Washington Post suggested that Congressman Bob Barr just recently instituted legal proceedings concerning attempts by James Carville, Larry Flynt, Bill Clinton and the Clinton administration to interfere with his duties & responsibilities during the House impeachment proceedings are not complete. In fact the origin of this legal case began in 1999, shortly after then-President Bill Clinton was impeached. The initial action concerned Privacy Act and other related claims against the Clinton Justice Department and the Federal Bureau of Investigation for allegedly using government acquired information to wage a media campaign interfering with the duties and responsibilities of Congressman Barr. Based on information acquired in this initial law suit, as well as other information, Congressman Barr sought to amend the complaint at a later date to include Carville, Flynt and Clinton. When the court declined, on procedural grounds, to grant leave for the amendment, Congressman Barr filed a related complaint against the defendants on January 11, 2002. It is this related case which is the subject of recent press reports.
Accordingly, those in the media who would characterize this as a recent case are incorrect.
Chronology of Litigation on Behalf of Congressman Bob Barr
June 25, 1999 – Initial Complaint filed against the Executive Office of the President ("EOP") and the Department of Justice ("DOJ"). The Complaint contained two Counts alleging a violtion of the Privacy Act by both EOP and DOJ.
January 11, 2002 – Amended Complaint filed. Defendants: DOJ, Bill Clinton, James Carville, Larry Flynt, L.F.P., Inc. The Amended Complaint contained three Counts: (1) against DOJ alleging a violation of the Privacy Act, (2) against Clinton, Carville, Flynt, and L.F.P. alleging a violation of 42 U.S.C.§ 1985 (1), and (3) against Clinton alleging a violation of 42 U.S.C. §1986.
March 6, 2002 – Motion for Leave to File Amended Complaint denied by Judge Thomas F. Hogan on procedural grounds.
March 7, 2002 – Second related Complaint filed against Clinton, Carville, Flynt and L.F.P., Inc. This related Complaint contained two counts: (1) against Clinton, Carville, Flynt, and L.F.P., alleging a violation of 42 U.S.C. §1985(1), and (2) against Clinton alleging a violation of 42 U.S.C. §1986. Second Complaint Assigned as a related case to Judge Hogan.
