Inalienable Rights?

One of the most unfortunate things about today's society is that through "dumbing down" our schools, the power seekers (looters) in our government have managed to make the Constitution moot in the eyes of many people by first, not teaching them what it's all about, and second, lying to the students in what they do tell them.

The biggest lie may be that "The Constitution is a 'fluid document,' subject to change without the interference of Congress of the people because it is 'outdated,' having been written more than 200 years ago by men who did not know what the future would bring." It is not. The method for changing the Constitution is spelled out in a detailed manner within the document. And any change or "redefinition" of anything therein is illegal, and even though it may be enforced by "force of arms" by the criminals in our government, it does not exist in law.

This is what the Supreme Court says about it: "In its first truly significant case, the Supreme Court asserted its power to overturn laws of Congress with the ruling written by our great Chief Justice John Marshall, which said simply: 'All laws repugnant to the Constitution are null and void.' " (Marbury v Madison, 5 US 137 (l803)

Natural (Inalienable) Rights

One of the most insidious ways they change the Constitution is by "redefining" the very words used. One of the words they wish to redefine is "inalienable." They want us to think that "inalienable" is not "permanent." They want to redefine the word so they can prostitute its meaning.

This is what Ayn Rand said about "inalienable rights":

"When we say that we hold individual rights to be inalienable, we mean just that: inalienable means that which we may never take away, suspend, infringe, restrict or violate -- not ever, not at any time, not for any purpose whatsoever. "You cannot say that 'man has inalienable rights except in cold weather and on every second Tuesday,' just as you cannot say that 'man has inalienable rights except in an emergency,' or 'man's rights cannot be violated except for a good purpose.'

"Either man's rights are inalienable or they are not. You cannot say a thing such as 'semi-inalienable' and consider yourself either honest or sane. When you begin making conditions, reservations or exceptions, you admit that there is something or someone above man's rights, who may violate them at his discretion. Who? Why, society -- that is, the Collective. For what reason? For the good of the Collective. Who decides when rights should be violated? The Collective. If this is what you believe, move over to the side where you belong and admit that you are a Collectivist." (Source: "The Ayn Rand Lexicon," page 211)

If each person were alone on a desert island there would not be a need for the term "inalienable rights," for each person, alone, may do anything he/she wishes, at any time. But when others arrive and begin living close to this man who was alone, these "natural" and "inalienable" rights need to be recognized by all those present, or a group of those newcomers must limit the natural rights of the original resident by force. These people can make all the laws they wish, but those laws are as if they did not exist because natural rights supercede those "given" or "taken" by law. The only way to "enforce" these laws is by illegal force if those who make them are of superior numbers and strength.

Rights Not "Granted" by the Constitution

They teach today the concept that the Constitution granted rights. It does not. It merely recognizes that those inalienable (natural) rights exist and pledges not to abridge or violate them. They teach that if it isn't mentioned in the Constitution, the government has the power to ignore such rights. It does not. Rights do not belong to the government to be dispensed or dispensed with at their whim. They belong to each individual. To the people, who created the government in the first place. That means that unless they give up a right, it will always belong to them the people, who are supreme under our kind of government, whatever the power seekers may maintain.

Constitution "Limits Government," Not Citizens

I refer to the "power seekers" so those not familiar with Objectivism will understand what I mean. And I coined the term "forced altruism" to describe what they practice upon us when they "force us" to be altruistic by taking our money and property and giving it to those who do not earn their own. It is the power seekers who wish to do away with, or make moot, the Constitution of the United states so they may more easily subjugate us to their will. But if we remember this one thing, we can avoid accepting their "edicts."

The Constitution was not meant to "give rights" to citizens or show the limits of the rights to which we are entitled. It is to simply recognize that we have rights that are ours by birth and which no one can properly or morally take from us. To limit the powers of government, not those of the citizen.

RICO Laws: Egregious Violation of "inalienable rights."

They use the scam that the laws under which they "confiscate" our belongings without the necessity of proving us guilty of anything (The RICO Laws) are civil, rather than criminal actions. Thus, they are not required to observe the constitutional protections of "innocent until proven guilty" in dealing with us and they rape and pillage us on a regular basis by claiming any money or property they want to steal is "probable drug money or bought with drug money."

They are now able to stop you on the street, in your car on the highway, or anywhere else at will, with the thinnest "probable cause" there is, search you, take any cash you may have, and send you on your way without having to arrest you or having to prove any law violation. All that is required is that someone "define" your money as "probable drug money." They stop people in airports and other transportation terminals on a regular basis to do this. They have even gimmicked up the new dollars with a "readable strip" so they can "read" the contents of your pockets from a distance to know in advance if what you're carrying is worth their time to steal.

And if they want your land, they just do a "Gestapo-style" raid, based on some snitch's unsupported word that you might be doing drug business there (and they have snitches standing by willing to say anything they want them to say and mostly they don't even have to identify him/her). They throw you out of your own property without necessarily arresting you for anything, claiming the property is "drug money purchased." And if you get in their way or try to defend your property, they just kill you.

Once this is done and they have stripped you of your money and property, if you want to get it back, you have to sue. But before you can sue you have to post a bond (after they've made you broke) guaranteeing that you will pay their legal costs, win, lose, or draw. Sometimes they even offer to give you back some of it if you will agree not to sue to get it all back.

Theft, Extortion, and Blackmail

If anyone but the "authorities" tried this scam they'd soon be in prison convicted of theft, extortion, and blackmail. But when thieves with badges do it, it's "the law of the land." Ayn Rand described some interesting looter laws made to make it easier for the looters to steal what wasn't theirs, but even she didn't visualize such a brazen rape of the populace as the RICO Laws.

The very purpose of the RICO laws was (and is) unconstitutional. They said the purpose was to "stop rich drug dealers from using their millions to hire good lawyers, and to make them easier to convict." Under the Constitution everybody, even people the government thinks is in the drug business, is entitled to the best legal representation they can afford. And if they can't afford it, the government has to provide it for them (at least in theory). By making and enforcing these laws, our government has become a "criminal enterprise" and ought to be subject to these same laws. But don't hold your breath. The criminals are in charge.
