QUESTIONS

Q.  IS ACCEPTING INDIVIDUALS THAT ARE NOTICEABLY COMPETENT A BUDGETARY ISSUE?

Q.  AREN'T YOU AND YOUR STAFF BOUND BY STATE/FEDERAL LAWS AND ETHICS TO
PROPERLY DIAGNOSE SOMEONE ADMITTED TO YOUR HOSPITAL BEFORE TRYING TO TREAT THEM?

Q.  WHEN A PERSON TELLS YOU OR YOUR STAFF THAT HE/SHE IS NOT INCOMPETENT, WHY IS THERE NOT AN EVALUATION OR INQUIRY MADE?--Few, if any inmates coming from the county jail would claim competency due to the fact that being incompetent keeps them from going back to the jail and standing trial.  When one makes this claim, why does no one listen?

Q.  ARE YOU ACCEPTING DALLAS COUNTY DETAINEES/PRISONERS REGULARLY, AS PORTRAYED ON THE NEWS SINCE THE BEGINNING OF THE YEAR, TO HELP WITH THEIR MENTAL HEALTH (MH) ISSUES;  or to help with the over crowding issue at the Dallas County Jail?

Q.  IS IT TRUE THAT IT COSTS JUST OVER $100 A DAY TO KEEP A DEFENDANT IN THE JAIL, BUT OVER $500 PER DAY TO DECLARE THEM INCOMPETENT AND STORE THEM AT THE HOSPITAL? If so, shouldn't the entire Dallas Judicial System and the taxpayers insist a defendant really be incompetent before the transfer?

Q.  WHAT DOES BIG SPRINGS STATE HOSPITAL (BSSH) HAVE TO GAIN BY ACCEPTING ALL THE SUPPOSEDLY INCOMPETENT DEFENDANTS FROM DALLAS COUNTY JAIL?
Does the budget go up for the hospital in ratio to the numbers they accept?

Q.  HOW MANY INCOMPETENT DEFENDANTS DO YOU KNOW OF WHO HAVE FILED A PUBLIC RECORDS REQUEST TO THE DOCTOR RESPONSIBLE FOR PERFORMING THEIR COMPETENCY EXAM?  Sharif has.

Q.  WHAT IS THE NUMBER OF PATIENTS ADMITTED WHO HAVE FILED PRO SE MOTIONS TO THE COURT WHILE IN YOUR CARE?  Sharif has.

Q.  HOW MANY INCOMPETENT PATIENTS FILE BAR COMPLAINTS AGAINST THEIR LAWYER DURING THEIR TIME AT BSSH?  Sharif has.

Q.  HOW CAN YOU ASSIST SOMEONE TO REGAIN SOMETHING THEY NEVER LOST, NAMELY THEIR COMPETENCY?

Q. HOW MANY INCOMPETENT PATIENTS WORK ON A LEGAL WEBSITE WHILE UNDER THE SUPERVISION OF YOUR STAFF?  Sharif has.

Q.  IF THE DOCUMENTS ACCOMPANYING A PATIENT'S ADMITTANCE SHOW THAT THERE WERE TWO EXAMS BY TWO DIFFERENT DOCTORS CONDUCTED BEFORE HIS/HER ARRIVAL;  ONE IDENTIFYING HIM AS COMPETENT AND THE SECOND AS INCOMPETENT;  SHOULD THIS NOT IMMEDIATELY ALERT THE ATTENTION OF THE SUPERVISOR, CASE WORKER AND STAFF TO CONDUCT A THIRD EXAMINATION PRIOR TO THE PATIENT BEING MEDICATED OR OCCUPYING UNNECESSARY SPACE AT YOUR FACILITY?  There were two exams conducted on Sharif, one clearly states he is fully competent and the other firmly insisting he is incompetent. Apparently, in such a case, the entire Dallas system prefers to handle the defendant as mentally ill and incompetent, no matter what the facts may be.

Q. HOW MANY INCOMPETENT PATIENTS UNDER YOUR CARE DO YOU OR YOUR STAFF KNOW OF WHO PASS THE TIME BY READING LAW BOOKS SUCH AS TEXAS RULES OF COURT AND TEXAS CRIMINAL LAW, ETC.?  Sharif does.

Q.  ARE YOU, MR. MOHAN, CONCERNED THAT, IF DALLAS COUNTY JAIL CONTINUES TO FLOOD THE HOSPITAL WITH "INCOMPETENT" INMATES, THERE WILL BE ADDITIONAL STAFF/PATIENT PROBLEMS, POSSIBLY VIOLENCE?  Shouldn't that concern force you to re-evaluate patients before accepting them?
