(2) The above described animal is a purebred dog and is registered with the AKC registering agency.
(3) The health of said dog is excellent to the best of the Breeder's knowledge and belief at the time of sale. The required vaccinations and wormings are current; however, Breeder advises the Purchaser to have a competent licensed veterinarian of his own choice examine said dog within 48 hours of receiving the dog. If the veterinarian finds the dog in poor health, the dog may be returned to the Seller.
(4) Seller guarantees that said dog will obtain an OFA certification of at least an OFA Fair by 26 months of age. X-ray films of the hips showing proper positioning, and meeting OFA standards, must be submitted to OFA for evaluation at the owners expense for guarantee to be valid. If OFA deems that said dog shows evidence of Hip dysplasia, an evaluation letter from OFA MUST be supplied, and buyer may be asked to produce a copy of the X-rays to be forwarded to the seller’s vet.
We will then give you the option of returning the dog to us or keeping the dog and we will replace the dog with a similar dog in value and characteristics. If you choose to keep the dog, we will need proof that the dog has been spayed or neutered.
Seller reserves the right to refuse buyer a replacement pup for any reason. Seller will then offer a full refund of the purchase price.
All shipping costs will be the responsibility of the buyer.
By signing this contract, the buyer acknowledges they have been informed young bones and growth plates have not completely matured and do not properly calcify until at least 12 months of age. Buyer acknowledges we will guarantee the hips, providing the buyer agrees they will not allow environmental conditions to adversely affect the development of the hip structure. Buyer will provide a certified nutritionally complete food that will not promote excessive growth or obesity. Buyer will provide regular moderate exercise. The buyer is aware that if they allow the dog to engage in activities that would stress the hips before the age of 12 months, the hip guarantee will then become null and void. Activities include, but not exclusively, exercise on hard unyielding surfaces, continuous running, repetitive jumping, training in competitive dog sports, or any activity that may cause injury.
No further health guarantee is made.
(5) Buyer agrees to maintain said dog in good health, provide routine preventative health care including, but not limited to , inoculation, internal and external parasites, and where indicated, heartworm preventative medication.
(6) Buyer agrees Seller will REPOSSESS said dog UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller.
(7) This contract applies only to _____________________ von Jagenstadt and is non-transferable to a second party.
(8) The Purchaser may return said dog within 48 hours from the date of purchase for a full refund of original purchase price if a licensed veterinarian finds said dog to be unfit for sale. Unfit for sale on account of an injury sustained, or illness contracted after you take possession of said dog does not deem it "unfit for sale". The Purchaser agrees to pay all transportation costs back to Seller. Even though all dogs/puppies are wormed, a veterinary finding of intestinal or external parasites is not grounds for declaring a dog unfit for sale unless the animal is clinically ill because of that condition. The buyer is advised to follow up on the proper immunizations with their vet.
(9) In order to receive an adjustment, under the terms of this sales contract, the Buyer must return signed AKC papers to Seller before any adjustment can be made. Buyer must make said dog available to Seller or designee for appropriate examination and evaluation.
(10) The breeder does not guarantee against any environmental temperament problems, environmental referring to abuse, neglect, teasing, or failing to train the dog properly. The breeder strongly suggests that the buyer takes said dog to obedience classes to learn proper handling techniques.
(11) Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising.
(12) There are no further guarantees or warranties implied.
(13) Any legal disputes must be settled in seller's county.
