Hello! My name is Anthony Mungin, black African-American, born on July 22, 1966 and an inmate at Union Correctional Institution [D.R.] in Raiford, Florida.

In 1992, I was charged with First Degree Murder. I was accused of shooting a store clerk during a robbery. The only witness at the scene of the crime told the detectives, "he could not swear in court it was me", then gave a totally different description of my identity. This all happened on the day of the crime, September of 1990. All of this information is on deposition.

I was appointed a Public Defender as my attorney and he did nothing I asked him to do. I told the detectives, police officers and my attorney I was innocent from day one. No one believed me and no one investigated the story I told them. The witness that stated "he could not swear in court it was me" and identified someone totally different from my description, denied he ever said that, when he testified at my trial two years later.

I was totally ignorant of the law and court procedure and the language of the court. I relied and trusted my Public Defender to mention everything I told him, but he did nothing to help me. Eventually, I was found guilty and sentenced to the death penalty February 23, 1993.

I was then appointed an appellate lawyer who had no experience in Capital cases and had never done a Capital Appeal before. That appeal is called a Direct Appeal and I could only raise issues that my trial lawyer objected to during trial. Needless to say, my trial lawyer didn't object to much of anything, so my appellate lawyer didn't have much to raise. The Florida Supreme Court denied my first appeal, but one of the judges dissented and wanted to grant me a new trial.

My next appeal would be my 3.850 Motion, but first I would have to be appointed a lawyer. On September 23, 1998 I was appointed a good attorney, Mark Olive by Chief Judge Moran. But before Mr. Olive could receive payment, he had to sign a contract drawn, that had limitations on what he could and could not do as my attorney. Mr. Olive, as well as myself disagreed with the contract, because it restricted him from doing things that needed to be done in my case.

A law suit was filed by Stephen Hanlon of the firm Holland and Knight, on behalf of Mark Olive against the contract - February 26, 1999 Case No. 99-1027 "Complaint For Declaratory Judgment".

Chief Judge Moran, advised by The Florida Legislature Commission on Administration of Justice in Capital Cases, appointed conflict counsel Attorney Wayne Henderson to represent me on my 3.850 motion March 11, 1999.

I wanted Mr. Olive to stay on my case, but he was forced to move off my case. Mr. Henderson has no experience with Capital cases and has never done a Capital appeal before. He came to see me once April 29, 1999 (briefly), to tell me he was my attorney. Since that day, he has not been in contact with me whatsoever. I only have one year to file my 3.850 motion.

I have written Mr. Henderson numerous times, but to no avail. He hasn't consulted with me about the case and refuses to communicate with me. It has been over eight (8) months and I haven't spoken with him at all about my case and what happened to me. This is not right - it's not fair and it's NOT JUSTICE

I've done some terrible things in my life before, that I sincerely regret and am truly sorry for...but I am innocent of the crime I've been sentenced to death for. I have been appointed poor representation and can't afford a decent lawyer. Since my incarceration I've spent countless of hours studying the Law, writing letters pleading for help and justice. I've filed motions on my own, in which some has been granted in part - however, I am not a lawyer and I don't understand or have knowledge of a lot of the Law. I'm just doing the best that I can with the knowledge I have learned thus far. If anyone can help me or assist me, God knows I will most definately appreciate it.
