Description

Unjustly convicted Massachusetts prisoner working on developing new evidence, writing my life's story, a screenplay with the help of my wife Danielle.

For my website ads, addresses and information you may email Danielle at Boo245@aol.com

To directly write me, I am Robert J. Shelley w36832, SBCC PO Box 8000, Shirley Mass.01464-8000

I am looking for child sexually abused victims of William C. Dubbels formerly of 402 Coronation Drive Franklin Mass, prior to September 3,1975. I am serving natural life for killing him when he tried to sexually abuse me. I was a child that was sexually abused at 10 1/2 years old and I was 19 when Dubbels tried it with me and I did kill him. Court and police covered up Dubbles and his accomplices and their activities to avoid a small town scandal.

I'll die in prison without help. I am asking for your help, Danielle and I can not do this on our own. So please help us fight for my release, only you can, one person at a time.

Thanks, Bobby Shelley, 30 years in prison and counting.

Dear Members: Free Robert J. Shelley,

I want to personally thank all of you who are taking an interest in being a member of this group and helping me get the truth out, even if it is thirty years late in coming. I would like to request that you get as many people as you can to join and also sign my petition for pardon to the Governor of Massachusetts at Petition Online.com

I don't care if you live in Massachusetts or wherever in the world you live, you're a human being and you have a right to join me in petitioning for my freedom. Allow no one to usurp or deny you this right.

The reason my story was never told was due in part to one of "our" rights being usurped in a 1971 case before the Massachusetts Supreme Judicial Court in which they removed " The Right To Make An Un sworn Statement" to a jury in a Capital case, before the jury deliberated a capital case.

The right was a right protected by our Massachusetts Constitution, Article 12 which protects our right to be "fully heard" in our defense and all previous rulings by the courts prior to 1971 protected this provision of the un sworn statement as "a right" protected under Article 12.

An "un sworn statement" was a provision based upon our constitutional right to "speak to the jury about to deliberate a case, the consequences of which could carry the penalty of Death or the Lifetime loss of liberty."

This is not to be confused with the right to testify before the jury, this merely protected a person right of free speech to the jury of his or her peers to standup and explain in his or her own words "what happened " that brought him or her before a jury to be judged on serious matters that, at the time could cost a defendant his or her life or their liberty forever.

A natural life sentence removes a persons liberty to the day of his or her death-- it is in essence, a very long death sentence for young person, a short sentence for a person late in life with little time left on Gods Clock.}

That is a right I tried to request and was denied at my 1978 trial where I only wanted to tell the jury my story as it happened, not in the contest manner between my lawyer and the assistant district attorney.

I wanted the jury to understand that I had the right to sleep without being sexually attacked in my sleep no matter if I was a man or a woman, no matter if I had legally consumed alcohol earlier that night, and no matter of any other circumstance used to convict me of murder in the first degree. I wanted to say to the jury that I wouldn't have killed Mr. Dubbels if he hadn't implemented a plan to intoxicate and/or drug me into a state of defenseless incapacitation.

I was a naive suburban nineteen year old as stupid as the prosecution had made me look, a man on trial for his life, should be allowed to tell the jury directly what had happened.

I've studied some law over the past thirty years of being in prison, and I learned that the Supreme Judicial Court may interpret  law but they have no authority or power to take a "right" away, only the legislature may do that.

So, in 1971, when they usurped that Massachusetts Constitutional right to address a jury of ones peers without harassment of the court or prosecutor, not as evidence, but for themselves if a person on trial for their life was affected by the circumstances that would have influenced the events in question to the point that if there was a crime committed, was it a capital crime, or a lesser crime, or possibly, in their opinion a very tragic event that could not be classified as a criminal  incident and an opportunity as a jury to determine they did not believe a "crime per se" was committed and that the deceased provoked the incident which caused his death or caused the accused to react in a state of mind  which would only be defined criminal if it was unprovoked.

I wanted to "open up" to the jury but the court would not allow me to speak openly to the jury, they bound me to rules of the court that silenced me. They decimated my right to make an un sworn statement, they nullified our right to right to free speech, a cornerstone of every Americans right.

Eventually, all the trial transcripts of two separate trial, psychiatric reports, prison records, and links to witnesses perjury, false reports, errors of perception stated to the jury by the judge, and finally, you will be one of the first group of people who will have a chance to hear what really happened on September 3rd, 1975 which caused the death of William C. Dubbels, a resident of 402 Coronation Drive, Franklin, Mass 1968 thru 1975.

You will have the opportunity to "judge" me from my own words, the truth as known only by me and Mr. Dubbels and facts no jury was allowed to hear as both the court and police along with prosecutors excluded enormous amounts of true evidence and planted false evidence.

These are not just my words-- you will see in the two sets of transcripts, many reports, and after thirty years in prison, because of The World Wide Web and the dedication of my wife Danielle and all of you who have or will have helped her, that I should finally be able to have a life  with my "own" family-Myself, Danielle, and our daughter Brianna.

There are literally over a hundred thousand people who believe my conviction was an injustice and that I never should have been imprisoned-- I believe  I killed Mr. Dubbels and I had no control at that time as to what happened and, that, in and of itself shames me and hurt me. Knowing you have killed another person no matter what the circumstances will leave you with a never ending queasiness in you stomach. It can't be classified as guilt or innocence, lawful or unlawful, just personally sad and hurtful.

I now have an avenue to the world to explain how and to a small degree why these events took place, and why the intervention of authorities, who could have acted upon complaints and common knowledge of the residents around the Coronstion Drive area would have prevented my having ever met Mr. Dubbels and in today's heightened awareness of pedophiles and rapists would have imprisoned Mr. Dubbels long before I became an employee of the White Hen Pantry in Needham, hired personally by Mr. Dubbels as his planning begun long before he met me, I just fit, or so he thought, into his realm of possibilities to secure more victims for himself and his accomplices, some of whom are/ were well know to Franklin authorities who shielded them as the Cardinals of My Church concealed their scandals.

Thank You, I hope you can help
