STATE OF MISSISSIPPI, JEFFERSON COUNTY
THE LAST WILL AND TESTAMENT OF GILBERT BUIE

I GILBERT BUIE OF JEFFERSON COUNTY, MISSISSIPPI STATE BEING WEAK IN BODY BUT OF SOUND MIND, AND ALSO CERTAIN TO ALL MEN ONCE TO DIE AND DESIROUS ALSO TO DISPOSE OF SUCH WORLDLY PROPERTY AS IT HAS PLEASED GOD TO GIVE ME.

DO FIRST WILL AND DIRECT THAT ALL MY DEBTS AND FUNERAL EXPENSES BE PAID WITH ANY MONEY THAT MAY BE IN MY POSSESSION AT THE TIME OF MY DECEASE.

AND SECOND I DO WILL AND BEQUEATH TO MY LOVING WIFE ALL THE LANDS THAT I MAY POSSESS AT MY DECEASE VIZ. THE WEST HALF OF THE N E 1/4 OF SECTION TWENTY THREE AND THE NE 1/4 OF THE N W QUARTER OF THE SAME SECTION IN TOWNSHIP 8 RANGE 4 EAST. CONTAINING IN ALL ONE HUNDRED AND TWENTY ONE 17/? ACRES TOGETHER WITH ALL THE HOUSE CLEARINGS, IMPROVEMENTS AND APPURTENANCES THERETO BELONGING. AND AT HER DECEASE ALL THE ABOVE LANDS AND IMPROVEMENTS TO DEVOLVE UPON MY BELOVED SON JOSEPH P. BUIE TO BE HIS AND HIS HEIRS FOREVER.

THIRDLY I DO ORDAIN AND DIRECT THAT MY LOVING WIFE SHALL HAVE AND POSSESS DURING HER NATURAL LIFE THE FOLLOWING NEGRO SLAVES WITH ALL THEIR INCREASE AND PRODUCTS VIZ. FLORA, JAMES, FANNY, JENNY AND MARTHA TO BE EQUALLY DIVIDED AMONG THE HEIRS OF HER BODY AT HER DECEASE VIZ. ANN CUNNINGHAM, MARY JANE SHORT, EMILY CATHERINE BUIE AND JOSEPH PAISLEY BUIE AND THEIR DESCENDANTS.

AND FOURTHLY I DO HERBY ORDAIN AND DIRECT THAT MY LOVING WIFE OWN AND POSSESS DURING HER NATURAL LIFE ALL THE LIVE STOCK THAT I DO POSSESS AT MY DECEASE, CONSISTING OF HORSES, HORNED CATTLE, SHEEP AND HOGS; ALSO FARMING UTENSILS, HOUSEHOLD AND KITCHEN FURNITURE, BED AND BED CLOTHES, BLACKSMITH TOOLS AND ALL OTHER APPURTENANCES BELONGING TO MY FARM FOR THE MUTUAL BENEFIT, SUPPORT AND WELL BEING OF HERSELF AND MY DAUGHTER EMILY K. BUIE AND JOSEPH P. BUIE AND AT HER DECEASE ALL THE ABOVE NAMED PROPERTY TO BE EQUALLY DIVIDED BETWEEN ANN CUNNINGHAM, MARY JANE SHORT, EMILY KATHERINE BUIE AND JOSEPH PAISLEY BUIE.

AND FIFTHLY I DO HEREBY ORDAIN AND DIRECT THAT MY EXECUTORS PAY UNTO EACH ONE OF THE CHILDREN OF MY DECEASED DAUGHTER JENNET FIVE DOLLARS AS THEIR FINAL PORTION OF MY ESTATE.

SIXTHLY, I DO HEREBY GIVE AND BEQUEATH UNTO MY SON JOSEPH P. BUIE, EXCLUSIVELY ONE SORREL HORSE. ALSO MY RIFLE AND SHOT GUNS WITH THEIR FIXTURES AND APPURTENANCES TO BE HIS FOREVER.

IN WITNESS HERETO I GILBERT BUIE TESTATOR HAVE HEREUNTO SET MY HAND AND SEAL THIS TWENTY SIXTH DAY OF JANUARY ONE THOUSAND EIGHT HUNDRED AND FORTY EIGHT. SIGNED, SEALED AND DELIVERED IN THE PRESENCE OF THE UNDERSIGNED AND WE HAVE SIGNED IN PRESENCE OF EACH OTHER.

NOTES: The slaves were appraised as follows: FLORA, a negro woman @ $100, MARTHA, a negro girl @ $250, JENNET, a negro child @ $150, JAMES, a negro man @ $700, and FANNY, a negro girl @ $550.

Gilbert Buie was born June 1773 in NC and he died February 24, 1848 in Union Church, Jefferson Co., MS. Gilbert was one of the first settlers in the Union Church area. He is listed as a charter member, along with his wife Katherine, of Union Church Presbyterian Church. Gilbert and Katherine's children were Susanna, Ann, John Alexander, Mary Jane, Sarah Adeline, Gilbert, Jr., Emily Katherine, and Joseph Paisley.
