On Wednesday, December 1, 2005, David P. Hanlon, CEO and President of Empire Resorts made statements that were false and misleading. He stated that they and the St. Regis Mohawk Tribe have the unanimous support of the Mohawks to build a casino at Monticello Raceway. We, the Kanion’ke:haka/Mohawk have never been consulted. We would never give their consent. This casino project is illegal. Monticello is on sovereign constitutional Kanion’ke:haka land. According to our constitution, the Kaianereh’ko:wa, this territory is legally held by the Women of our Nation as the “progenitors of the soil” for the coming generations of our people, which we have never surrendered. It is our duty to inform you that you are violating the Two Row Wampum Agreement which governs our relationship. The U.S. Constitution respects this nation-to-nation relationship between our nations. The Saint Regis Mohawk Tribe is a non-Indian corporation created by federal and state law, violating the U.S. Constitution. It is an illegal municipal level entity. They are imposters who speak for the outside authorities and not for the Mohawks.

FURTHER REASONS FOR OBJECTION:

Whereas:

1. Jurisdiction over the ter ritories now called “New York State,” “Southern On tario” and “Quebec” and beyond belongs to the Rotinonshonni Confed eracy known in English as the Iroquois Confederacy;

2. Article II, Section 2, Clause 2, Paragraph 1 of the U.S. Constitution respects that relations with us shall be con ducted on a nation-to-nation basis; Sections 109 and 132 of the constitution of Canada declares that the interests of Indians shall supersede that of Canada and its provinces and that relations with us shall be conducted on a nation-to-nation basis. The constitution is the law of the land. Business contracts do not supersede the constitution. This project is treasonous.

3. The United States and Canada have never contracted a valid treaty of cessation with the Rotinonshonni Confederacy. The Rotinonshonni continue to have constitutional jurisdiction over all Kaianereh’ko:wa lands. Any contact must go through the President of the United States who then deals with the constitutional Indigenous people.

4. The assumption of juris diction over Rotinonshonni Territory by federal, state, provincial or local govern ments of the United States and Canada is treasonable, fraudulent and unconstitu tional.

5. The denial of a nation’s exis tence constitutes genocide, according to the many international covenants that the United States and Canada have pledged to uphold;

Therefore: 6. We demand that the federal, state and local tribal governments immediately cease and desist your illegal assumption of jurisdiction currently being imposed on our territories.

7. We demand that George W. Bush, and Her Majesty the Queen immediately abide by our constitution-to-constitution relationship.

8. Finally, we demand to be officially informed how federal, state and local tribal governments can violate international law and the rule of law by superseding our jurisdiction over land that we never surrendered through a treaty or any means whatsoever.
