Whereas George W. Garlington deceased late of the County of Green of said State died intestate and Wm. Edmondson of the county last aforesaid upon the appraisement to the honorable the inferior court of said County of Green when setting for ordinary purposes was duly appointed administrator of all and singular the goods and chattles rights and credits of the said George W. Garlington deceased and where the said inferior court when setting for ordinary purposes passed an order for the sale of a certain Lot of land containing one hundred and sixty acres more or less known and distinguished in the plan of survey of the Cherokee territory Georgia by the number fifty nine in the thirteenth district of the second section of Cherokee County Georgia as the property of the said deceased and whereas in obedience to said order the said William Edmondson administrator as aforesaid duly advised ____ according to law on the courthouse door of Cherokee County and in the Southern recorder a weekly gazette published in the city of Milledgeville for the space of sixty days previous to the day of sale as whereas on the fifth day of February in the year of our Lord eighteen hundred and thirty nine within the legal hours of sale being the first Tuesday in said month before the courthouse door of said Cherokee County did ___ the said Lot of Land at publick out cry where BARTIN LOVELESS of said County being the highest bidder the same was knocked of to him at the price or sum of twenty five dollars.
Now this indenture made the fifth day of February eighteen hundred and thirty between the said Wm. Edmondson administrator as aforesaid of the one part and the said BARTON LOVELESS of the other part witnesseth that the said Wm. Edmondson administrator as aforesaid for and in consideration of the sum of twenty five dollars to him in hand paid by the said BARTON LOVELESS at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell do for as the Law authorizes him as administrator and the said BARTON LOVELESS his heirs and assigns all that tract or Lor of land aforesaid No 59 district 13th, Section 2 of Cherokee County Georgia together with all and singular the rights ____ and appertenances there of unto the said Lot of Land belonging or in anywise appertaining and also all the estate right title claim and demand of the said George W. Garlington his heirs and assigns To have and to hild the said Lot of land and premises unto the said BARTON LOVELESS his heis and assigns to the only proper use benefit and ____ of the said BARTON LOVELESS his heirs or assigned for ever in fee simple and the said Wm. Edmondson doth warrant and will forever defend all ____ singular to the land and premises aforesaid unto the said BARTON LOVELESS against himself his heirs & assigns and against all and every other person whatsoever _____ is bount to do as administrator aforesaid ___ in law on equity and particularly against the claim of the said deceased or his heirs or assigns in witness where the said Wm. Edmondson as administrator as aforesaid hath here unto set his hand and affixed his seal the sat late herein written.
