1. CODE OF CONDUCT
1.1 Each student of Martial Art Academy of India must abide by the Martial Art Academy of India Code of Conduct (“the Code of Conduct”) at all times.
1.2 Failure by the Student to abide by the Code of Conduct may, at the sole discretion of Martial Art Academy of India , result in the immediate termination of his/her membership, in accordance with Clause 3.1.
2. PAYMENT PERIOD AND FEES
2.1 The payment period runs for three calendar months starting from the first (1st) day of the Payment Period.
2.2 The Student must pay the relevant membership fee (“the Fees”), as set out on the Martial Art Academy of India website at www.delhikarate.com (“the Website”) and/or in the Newsletter (as defined in Clause 8) at least fourteen (14) days prior to the start of the Payment Period (“the Due Date”).
2.3 If the Student fails to pay the Fees before or on the Due Date, Martial Art Academy of India may, at sole discretion, prevent him/her from attending classes until such time as the Fees have been duly paid.
2.4 If the Student fails to pay the Fees 5 days after the Due Date, Martial Art Academy of India may, at her the sole discretion, terminate his/her membership in accordance with Clause 3.
2.5 In the event that the Student elects to terminate his/her membership, the Fees are not refundable.
2.6 At the sole discretion of Martial Art Academy of India, the fees may be paid in advance on condition that they will not be refundable in any event.
2.7 The Student is not entitled to renegotiate the Fees on the basis that he/she has failed to attend classes.
3. TERMINATION OF MEMBERSHIP AND CANCELLATION FEES
Martial Art Academy of India may, terminate the Student’s subscription immediately and without prior written notice to the
Student in the event that:-
3.1 The Student fails to abide by the Code of Conduct, in accordance with Clause 1; or
3.2 The Student has not paid the Fees within (5) days of the Due Date, as set out in Clause 2.4.
4. MISSED AND EXTRA CLASSES
4.1 In the event that the Student misses his/her regular class, in respect of which the Student has paid the Fees, due to any reason the Student is not compensated in any terms.
5. CHANGES TO THE MEMBERSHIP PACKAGE
5.1 The Student may be taught by a number of different instructors during his/her period of subscription with Martial Art Academy of India , and the Student’s regular instructors may, at the sole discretion of Martial Art Academy of India , be changed without notice to the Student.
5.2 The Student’s regular class time may be changed at the sole discretion of Martial Art Academy of India.
5.3 The venue at which the Student regularly trains may, in the sole discretion of Martial Art Academy of India, be changed at any time. Notice of such a change will be given to the Student either by a posting on the Website or in the Newsletter.
6. ACADEMY CLOSURE
6.1 The Student will receive notice of the exact dates of the Academy Closure in advance, by the posting of a notice on the Website, and/or a notice in the Newsletter.
6.2 The Student is not entitled to attend a Replacement Class to make up for classes missed during the Academy Closure.
7. NEWSLETTER
7.1 An electronic newsletter will be sent to the Student via e-mail on a monthly basis, and will be posted on the Website. In addition to the electronic newsletter, electronic updates will also be sent to the Student via e-mail. Together the electronic newsletter and electronic updates are referred to herein as “the Newsletter”.
7.2 It is the Student’s responsibility to ensure that he/she has seen a copy of the Newsletter, and the Student will be deemed to have received notice of any Martial Art Academy of India events or changes to his/her membership package once the Newsletter has been sent to the Student.
8. CHANGES TO THESE TERMS AND CONDITIONS
These Terms and Conditions may be amended from time to time at the sole discretion of Martial Art Academy of India. Notice of such amendment will be provided on the Website and/or in the Newsletter. It is the Student’s responsibility to ensure that he/she is familiar with the current Terms and Conditions.
9. INDEMNITY
Martial Art Academy of India and/or the instructors shall not be under any liability in respect of any loss or damage to the Student’s property whilst it is at the venue in which the Student’s class is being held except to the extent if at all as Martial Art Academy of India and/or instructors may be able to enforce a claim for indemnity against a third party or under any policy of insurance effected by Martial Art Academy of India and/or instructors (and in this connection Martial Art Academy of India and/or instructors undertakes to maintain all customary insurances); nor for any personal injury, ailment, or death arising out of or in the course of your engagement except to such extent if at all that the same is due to the negligence of Martial Art Academy of India and/or instructors.
10. ENTIRE AGREEMENT
These Terms and Conditions embody all the terms between the Student and Martial Art Academy of India and/or instructors and no oral representations warranties or premises shall be implied as terms of this Agreement.
Martial Art Academy of India and/or the instructor shall not be under any liability to the Student in respect of anything which, apart from this provision, may constitute a breach of these Terms and Conditions, namely, circumstances beyond the control of Martial Art Academy of India and/or instructor which shall include (but shall not be limited to) acts of God, perils of the sea or air, fire, flood, drought, explosion, sabotage, accident, embargo, riot, civil commotion, including acts of local government and parliamentary authority.
11. GOVERNING LAW
These Terms and Conditions shall be governed and construed in accordance with the laws of India and the courts of Delhi shall have sole and exclusive jurisdiction over any and all disputes arising hereunder.

CODE OF CONDUCT
At Martial Art Academy of India, we pride ourselves on providing a safe place in which to train, where we can be ourselves without fear of homophobia, racism, sexism or any other form of prejudice. In order to preserve this environment, members should abide by the following Code of Conduct:-
· Members must not behave in a manner, which would be prejudicial to the good name or interests of Martial Art Academy of India.
· Members must, at all times, conduct themselves in such a way, which is respectful of the instructors, assistant instructors, and other members.
· Members must always bow in and out of a class to their instructor.
· Members must take care when using equipment, and must not wear any rings when punching, or trainers when using the punch bag.
· Members must not chew gum during class.
· In the event that members are awaiting the start of their class whilst another class is in progress, they must be considerate and avoid making a noise, which might distract those participating in the class.
· Members must be respectful of the training environment and not leave any litter after training.
· Members are responsible for their personal belongings at all times, which should be left in place which will not impinge upon the space in which others are training.
· Members must wear suitable training equipment during classes.
· A member who has earned a belt must wear it at all times whilst training.
· Members must be aware of their personal hygiene at all times. Karate is an energy booster, causing people to perspire a great deal, if you are someone who knows this is an issue for you.
· Members must not under any circumstances attend training when under the influence of alcohol or drugs.
· Members are invited to make any concerns they have about the school or other members known to one of the instructors or assistant instructors, so that any problems can be addressed quickly, efficiently and directly. Instructors will handle any information given to them in a discrete manner.
Martial Art Academy of India has absolute discretion in the interpretation of this Code of Conduct and the decision is final.
I agree that I will abide by all rules and regulations for the duration of my participation in this course established by Martial Art Academy of India.
