Terry
Sims' case:
Terry Sims, 56, has been convicted of 1st degree
murder
and sentenced to death on July 24, 1979 for the shooting of George
Pfeil, an
off-duty sheriff's deputy during an attempted robbery of a pharmacy
in
Seminole County on Dec. 29. 1977. George Pfeil tried to stop the
robbery
when he has been shot. Sine Terry Sims was a prior felon, he
committed the
crime to escape capture, and he committed the shooting while
committing
another crime. That is the main reason for his sentence to death.
But 3
other men were in the pharmacy with him, and one of them, Curtis
Baldree,
testified against Terry Sims. Terry had successfully appealed to US
District
Court in Florida, stating his counsel was ineffective, but the
Florida
district attorney's office appealed, and the decision to reinstate
the
sentence was handed down on September 1998 by the 3-judge panel of
Judges,
Joel A. Dubina, Ed Carnes and Franck M. Hull.
His appeal clearly
said his defense should have objected to the use of
testimony enhanced by
hypnosis, and that his counsel should have
cross-examined Curtis Baldree.
Is Terry Sims the shooter?
Terry Sims' case:
Terry is 57.
Terry Sims has been
convicted of 1st degree murder
and sentenced to death on July 24, 1979

Terry was also injured: he was shot in the hip.
But 3 other men were in the pharmacy with him,
Curtis Baldree, B.B. Halsell
and
Clarence EugeneRobinson.
and one of them, Curtis Baldree, testified against Terry Sims.
As did Halsell.
Baldree and Halsell were both killed after being
released from 2-year prison terms.
Robinson, who was indicted in absentia for murder
in the pharmacy shooting,
remained at large until June 1983
when he surrendered after being charged with
shooting two FBI agents in Volusia County.
I don't know Terry personally, but those who do,
including my mother and Sid Kleiner,
have many good things to say about him:
he is kind, considerate, unselfish, loyal.
During his 20-year stay on death row
he has managed to maintain a positive attitude
towards life.

I believe now is the time to call on the pope to
appeal to the Governor on behalf of Terry and Anthony.
