This Indenture made this Oct 11 1852 between CHARLES M WILLIS and MARY his wife of the first part and REUBEN SMITH of the second part, all of BARREN COUNTY KENTUCKY witneseth? That the said Willis for and in consideration of the sum of one hundred and seventy five dollars hath bargained and sold and does hereby convey to said Smith a certain tract or parcil of land in Barren County on the south side of the Lexington road, about half a mile westwardly of the Horse Well containing one an a half acres more of less an boundry as follows. Beginning at a Stone in W S O White line on the south side of the Lexington road. Thence, along the side of the road including the fence around the Lot. S44, W17 72/100 poles to a stone thence S/E? 14 27/100 poles to a stone thence E 16 42/100 pole to a stone in Whites line. Thence with his line to the beginning. To have and hold said land to said Smith forever and the said Willis agrees to forever warrant & defend? Said land to said Smith and is heirs free from all claims whatever. Horse Well was at the intersection of Old Lexington Road and the
Glasgow-Munfordville Road (off Hwy. 70), about 2 1/2 miles from Cave City. The
Mary Woods Weldon Library has some excellent articles on it. It was an inn,
store, blacksmith, whole community at one time before the railroad.

Whereas in the action of MARTHA E PENNINGTON Plaintiff against EDNA S SMITH & co defendants.
Pending in the Barren Circuit Court, an order was entered at the Sept. term 1881, directing T.M. DICKEY Master Commissioner of said court , to expose for sale at public auction, to the highest and best bidder, the property hereinafter described; and whereas said property was sold in accordance with said order, on the 16th day of December 1881, for the sum of seven hundred and fourty dollars and - cents when B.W. SMITH , became the purchaser thereof; and whereas the report of said sale was confirmed by said Court at the March Term 1882, and at the same term 1882 an order was entered directing said Commissioner to execute a deed of conveyance of said property to said B. W. SMITH , but for greater certainty , the record and proceedings in said case are referred to. Now therefore, this indenture , made and entered into this 18th day of march 1882, between GEORGE A. PENNINGTON , MARTHA E. PENNINGTON, EDNA S. SMITH, REUBEN SMITH, BY T.M. DICKEY Master Commissioner of the said Court of the first part and of the second part, Witnesseth that for an in consideration of the premises, the party of the first part , by said Commissioner afore said has sold and by this writing do convey to said party of the second part and his heirs and assigns for ever, the following described property to wit. A tract of land in Barren County in Rich Grove , on the Glasgow and Bardstown turnpike , containing about 20 acres. Bounded one west by the land of J.L. CALDWELL and the line between the two places, begins on a hickory and runs with a marked line S64 poles to a large beech and black gum, and on the South bounded be the lands of the late Jno.B. Wilson. This line runs E36 poles to an elm and two dogwoods. Said land is bounded one North and East by the lands of Henry L. Rogers, that were conveyed to him by W.B.ROGERS. A lein is hereby retained on said land to secure the payment of said purchase money. To have and to hold said property with its appertenances, unto the said grantee his heirs and assigns, the said Commissioner conveys all the right, title and interest , legal and equitable of the said parties of the first part, in and to said property, and warrants the title thereto, so far as the is authorized by the judgement , orders , and proceedings in said cause and no further ; but he does not bind himself personally by anything contained herein, in any event whatever in testimony whereof, said T. Hi Ken,
When I saw "Horse Well" I thought you must mean "Horse Cave". We live on the old Lexington Road. Not far out of town, but on the old Lexington-Munfordville Road nevertheless.
Then, I pulled my Barren County Heritage off the shelf and find that Horse Well is exactly where you thought it was. Near Goodnite.
"Before any large scale settlement, there were several Indian trails in our area in addition to the fairly heavily traveled Nashville and Lexington Trace, also called the old Lexington Road in 1783. Edwards said it was safe to travel after 1792, and that the bulk of early settlers in this section came down this trace to Elk Lick on Little Barren, where they divided. At times, this was also called the New Orleans Trace (an extension of the Natchez Trace, which ended in Nashville--"by far the most famous and important road of the new southwestern wilderness--for several decades, most of it's traffic was northbound.") This Nashville and Lexington Trace ran through Barren county from Park City (then called three Forks), passing just east of Prewitt's Knob, to Cool Spring, then to Horse Well, to Bear Wallow and on to Lexington......"

Thanks for the info. I located Elias's gravesite today and made some
pictures. That's pretty country this time of year.
I could not be certain of the year Elias died, maybe 1848, the same year
Crit was born. My father was raised by Crit Smith and Fanny Bowles. He
affectionately referred to them as Ma and Pa. That and the Cyrus
Edwards stories keyed my interest in this branch of my tree.
John Crittenton Smith, 1848-1939 married Fannie Bowles, 1847-1935.
Their daughter, Ida M., 1873-1957 married Alvin N. King, 1868-1937.
They produced Pauline, Jo, Flora, Golden, and John Crittenton King.
Johnny King, 1894-1962 married Katie Peterson, 1894-1977.
Johnny and Katie had 3 children, Ernest Wilburn, 1915-1975, Andrew
Wilson, died 1973, and Eugenia, who presently lives in Glasgow.
Ernest married Mattie Lee Montgomery 1916-1992. They operated the store
at Griderville 1954-1975 where I more or less grew up. I'm their only
child born in 1948 and married to Ann Gardner. We have one son Joseph
Grant.

Now to you..How old are you? Surely I am acquainted with some of your
family if not you. I remember a blond girl and her brother, last name
Smith, younger than me, while getting my Hiseville education. Darn if I
can remember the first names.
If you need more information on descendants in my line let me know and
I'll try to put it together. mickey




Hart Co was formed in 1819 from portions of Hardin, Barren, possibly a
little bit of Green and Christian Co.

Hardin came from Nelson in 1792
Barren came from Green and Warren in 1798.
Green came from Lincoln and Nelson in 1792
Christian came from Logan in 1796.
Warren came from Logan in 1797.

Franklin County was removed to form GALLATIN County and in 1819 a portion was again taken to form OWEN County. In 1827, for the third and last time, a portion of Franklin County was taken to form the county of ANDERSON. Franklin County, located in the central Bluegrass region of Kentucky.

There are two separate wills marked rejected. The second will is dated 3 Sept. ,1847 as is the first. This is noted Rejected 17 Nov 1857 .,they are basically the same.

Rejected - no notation as to why.

My son JOHN R SMITH and my son0in-law JOHN RICHARDSON Executors.

My wife ELIZABETH shall keep an hold possession of the tract of land I now live on during her natural life of widowhood. She shall keep my Negro woman Jenny and my man Jeffrey and my boy John. Also the work horses , 4 good milk cows, all my farming tools, 2 sows, shoats, stock hogs (enough for a year's support), 15 sheep, a little wagon, one yoke of steers, grain an provinder of ever kind I may have.

My son REUBEN has a boy Dave from me, I now give him Chloe.

I have heretofore give my daughter MARGARET PAYTON a Negro woman and her increase.

My son JOHN R SMITH shall have my boy Thornton or my boy Carroll, which ever he chooses. Thorton is now in his possession.

In addition to the Negro boy George that I have given my son SIDNEY, I now give him 6 sheep, 12 hogs (2 sows and 10 shoats) , and 2 cows - he may have the equivalent if he can't use them.

I give to my son WILLIAM my Negro boy Alexander, I did give him a note one the estate of my brother HUBBARD SMITH decd., which was collected.

I have already given my son JOSEPH a girl Mary who died. I then gave him a boy Gabail andtho JOSEPH has been unfortunate with the boy it seems just to me - the two Negroes shall be regarded as one. I also give him 6 sheep, two sows and 10 shoats and one cow or their equivalent.

To my son GREENVILLE - the boy now in his possession shall remain so, only for his use and benefit of him an his wife and children. The boy Albert shall not be liable for any debt that GREENVILLE now owes. This is because GREENVILLE once sold a boy that came by his wife, and I now think it is just to replace her boy.

My son DANIEL to keep the boy Peter now in his possession.

My daughter ELIZABETH CLARK shall have my girl Martha but it to be clearly understood that if my son WILLIAM or any person for him shall return my girl Rachel, by next Christmas then in that case I direct that ELIZABETH shall have Rachel instead of Martha - but in either case ELIZABETH shall keep her Negro - at he death to her children. ELIZABETH shall also have 6 sheep , 2 sows and 10 shoats and 2 coww or their equivalent.

My daughter LYDIA ANN to keep the girl Maria that she now has an also 6 sheep.

To my daughter MALINDA my girl Sarah that she now has, plus one mare Platos , one bed and furniture , 6 sheep , two sow and 10 shoats plus two cows.

My son HUBBARD to have my boy Milton , my 4 year old ball horse ,one bed and furniture , 2 cows , 6 sheep , two sow and 10 shoats. He is also to have 75 acres of my tract of land in Hart which I purchased of m son REUBEN at $3.00 per acre. This is if HUBBARD be willing to have it , he shall have the price of the 75 acres. If he be not willing, then his 75 acres shall be laid off so as to include the new field beginning at a post oak wher WILCOXLIN'S line crosses the road.

If my son JOHN shall choose to take Carroll , then my daughter CATHERINE shall have Thorton. If JOHN takes Thorton , then she shall have Carroll. CATHERINE shall also have a horse worth $75 of that amount in money , 2 cows , one bed and furniture , 6 sheep , 2 sows and 10 shoats when she reaches 21 or marries.

My daughter ZERILDA shall my girl Perlinia/perlixna ,one horse or $75 (his worth) , one saddle and bridle , one bed and furniture , 6 sheep, 2 sows and 10 shoats and 2 cows when she reaches 21 or marries.

My youngest daughter SOPHIA shall have my boy Osborn and my girl Tabbitha when she arrive of full age , a horse worth $75 or so much money , one saddle, bridle , 2 cows 6 sheep , 2 sows and 10 shoats , one bed and furniture or its equivalent.

My girl Rachel now in the hands of my son WILLIAM as Administrator of my son in law JOHN CLARK , which is contrary to any act of mine, as I never did give the girl to Mr. CLARK or to his wife , but loaned her only and so belonging in his possession, and claimed by him assets in his hands belonging to the estate of JOHN CLARK decd, I am deproved of the pleasure of making provision for my two daughters in the way I did wish , viz; I did with my 2 daughters ELIZABETH and CATHARINE should one of them have Rachel and the other Martha… as it is WILLIAM that claims Rachel as above said, ank requires that I must bring suit to recover her , which I will not do. I will not sue my child but must ( as have here done) make other provisions giving Martha to ELIZABETH and Carroll or Thorton to CATHERINE. But let it be clearly understood that if WILLIAM shall return Rachel, ELIZABETH is to have CATHERINE is to have Martha , and Carroll or Thorton is to go back into the undivided part of my property to be disposed of.

The remainder of my negros not specifically devised , including Carroll or Thornton, shall be sold by my executors on a credit of 12 months for the Negroes and the land on a credit of one and 2 years ….the balance to be equally divided amongst all my children. If WILLIAM does not return my girl Rachel by Christmas he is not to be an equal distribution with the rest, he shall $10 and no more and no portion at all of the remainder of my estate . If he does bring her back he shall have an equal distribution with the rest.

Executors to put out my cash on hand at interest safely secured and the interest to clothe and school my 3 youngest daughters.

At the death of my wife , the whole of the remaining estate to be sold and equally divided amongst all my children except WILLIAM if he does not return Rachel . GREENVILLE's portion shall go to his wife and children to procure a home. In case of any of my infant children be unfortunate enough to lose the Negro or Negroes assigned them , a fair value shall be furnished.

As soon after my death as possible to sell all my stock no disposed of by me.

Visited grave site again June 12, 2001 lots of undergrowth covering gravestones (lying flat on ground, not upright).Noticed this time a approx 2 1/2 inch square plug (left center of stone) loose fitting on ELIZABETH SMITH's stone , dont know the purpose of this. Would like to find old house site (somewhere near wooded with large oak trees of cemetery ) . Metal detector to check possible site! ....Ken ps have pictures of site & Park store to be added to file.........

E. H. Smith was born in Barren County, Ky., December 1, 1827, and is the twelfth of a
family of sixteen born to Elias and Elizabeth (Milzener) Smith. Elias Smith was born in
Lincoln County, Ky.; was engaged in agricultural pursuits all his life, and was a son of
Reuben Smith, who was born in Virginia, but was one of the first settlers in Lincoln
County, Ky. He was a farmer and stock raiser. Mrs. Elizabeth was a native of Anderson
County, Ky. E. H. Smith was reared in Barren County, Ky., and received a good common-
school education. In 1847 he commenced writing in the circuit and county clerk's office
in Grant County, and remained until 1852, then went to Kenton County, Ky., and was deputy
circuit clerk for one year, and in March, 1855, moved to Grant County, Ky. He read law,
and was admitted to the bar in 1855, and practiced up to 1858, then was elected county
clerk, and served one term, giving universal satisfaction. In 1863 he represented Grant
County in the Legislature, and is one of the leading Republicans of Kentucky. His criminal
practice has been very large, he having prosecuted and defended in as many important cases
as any lawyer in Kentucky. He was married July, 1850, to Sallie C. Ohara, who was born in
Owen County, Ky., a daughter of James Ohara. Four children have blessed this union: Lucy,
Kate, Helen M. and James W. Lucy married Dr. O. P. Hogan, Jr., and had three children:
Overton P., Elihu and Willie. Kate married Tim Needham, and had one child--Hubbard S.,
Helen M. is unmarried, and James W. died May 29, 1885. Mr. Smith is a member of Centurion
Lodge, No. 100, I.O.O.F., located in Williamstown. His wife is a member of the Catholic Church.
Mr. Smith has recently retired from the practice of law, and now employs his time by riding
over and conducting his two large farms in Grant County, which comprise 1,600 acres. At the
organization of the Bank of Williamstown he became president and has since retained that
position.

We have been able to locate the limited military records in our collection
upon Elias Smith's service during the War of 1812. Most records upon the
War of 1812 for Kentucky were burned in 1874, thus the limited information.
There are limited records at the National Archives (www.nara.gov) upon
Kentucky soldiers.

Elias Smith enlisted as a private in Captain Dan Garrard's Company, 2nd
Regiment of Kentucky Militia on 1 September 1812. This regiment was raised
to assist in the defense of Detroit, but that city was surrendered before
the troops mustered into service. The regiment moved into Indian territory
toward Detroit, and were attacked by a British force of regular troops and
Indians. Garrard's company was one of the expeditions advanced guards and
helped to drive off the Indian attack. After the attack the expedition was
cancelled and the troops returned to Kentucky on 1 October 1812.

Frances mar 5 May l794 Lincoln co Ky George Elliot 8, Margaret married l0 Sept l805 Nicholas Wilhot who was co excr of Williams will and the 3rd child of William and Margaret was Ann(Nancy) Ball who was living when her fathers est was divided I had a card on Elias and that he had l5 kids, they whoever sent info to me called Catherine Kittie, but everything eles checked out also had a card for Reuben wife Judith with dau Frances . Also have a card on Elias son John R if you want that info In Lincoln co KY deed William and Rueben Smith sell land back and fforth to each other, also the Neavilles sell them land. Did you say right she will look for my Reuben Smith? This is why I collect Smiths so I can help. Read a query the other day, knew right away it was one of mine, query said my husband grandfather born l879 with those words she gets the Smiths back to l660s in VA, and Ill bet I never even hear thank you. If you need more on this let me know I cant back up beyond Thomas because Loudon co isnt one I really dug into Enjoy Willa Sorensen

Glad you liked it have one Smith searcher mad at me because I said her line wasnt right, It called you dont grab the oldest Smith with a will in a county and claim him. Elizabeth Mizner was the daughter of John Mizner, Sr. and Lydia Duncan. She married Elias Smith in Mercer County. She was a sibling of my line. Connie Dukes of PA has a web site with all the Mizner's - don't recall the web address. You might your search engine. However, she can't connect our John Mizner, Sr. any further back at this time. Thanks for the info. I located Elias's gravesite today and made some
pictures. That's pretty country this time of year.
I could not be certain of the year Elias died, maybe 1848, the same year
Crit was born. My father was raised by Crit Smith and Fanny Bowles. He
affectionately referred to them as Ma and Pa. That and the Cyrus
Edwards stories keyed my interest in this branch of my tree.
John Crittenton Smith, 1848-1939 married Fannie Bowles, 1847-1935.
Their daughter, Ida M., 1873-1957 married Alvin N. King, 1868-1937.
They produced Pauline, Jo, Flora, Golden, and John Crittenton King.
Johnny King, 1894-1962 married Katie Peterson, 1894-1977.
Johnny and Katie had 3 children, Ernest Wilburn, 1915-1975, Andrew
Wilson, died 1973, and Eugenia, who presently lives in Glasgow.
Ernest married Mattie Lee Montgomery 1916-1992. They operated the store
at Griderville 1954-1975 where I more or less grew up. I'm their only
child born in 1948 and married to Ann Gardner. We have one son Joseph
Grant.

Now to you..How old are you? Surely I am acquainted with some of your
family if not you. I remember a blond girl and her brother, last name
Smith, younger than me, while getting my Hiseville education. Darn if I
can remember the first names.
If you need more information on descendants in my line let me know and
I'll try to put it together. mickey
