There are two Court Proceedings to evict a tenant:

1) Holdover Proceedings

This is where a tenant is in possession of the premises after a lease has expired or is on a month-to-month agreement with the landlord. And the landlord wishes to have the tenant leave the premises and the tenant refuses. This type of action may be brought by the landlord where the tenant is in possession of the premises and the tenant is up to date with their monthly rent.

2) Non-payment Proceedings

This is the situation where a tenant is not paying the rent, the landlord has the right to bring a nonpayment proceeding to evict the tenant for failing to pay the monthly rent.

After a landlord is successful in one of the above proceedings, paperwork then must be submitted to the sheriff for the sheriff to evict the tenant.
