• Redrafting or Amendment

   Many people forget to update their legal documents. Most often those that must be changed are your:

     • Will
     • Health Care Proxy
     • Living Will
     • Trust
     • Power of Attorney
     • Contracts

   Your Will (Last Will and Testament) can be the most important document to update. Some people plan ahead and have a new Will made just before the marriage. Unfortunately, planning ahead in this case often does not work. For example, in Massachusetts a Will made prior to marriage, unless specific language is incorporated into it, is voided by the subsequent marriage and will have no effect. So much for planning ahead.

   The other estate planning documents such as a Living Will, Trust, and Power of Attorney will also need to be updated if you have them. If you do not have them, now is the time to consider whether you need them.

   Contracts is a big category. There are so many different types of legal documents to update that it is highly situation specific. They can usually be updated either through redrafting them or by drafting a short amendment. Each document will have it's own requirements.
