Mumia Abu-Jamal: People's Petition

The Institute for Tsunamic Justice works closely with MOVE and the International Concerned Family & Friends of Mumia Abu-Jamal for the release of this revolutionary who is an extraordinary journalist known as "The Voice of the Voiceless."

Seeing the need to put into play a legal strategy that placed politics in command, we devised and implemented what we call "The People’s Petition," which is an application for the writ of habeas corpus demanding that the federal court arrest the state court process in Mumia’s and other cases, such as that of James Dennis and the MOVE Nine.

The "People’s Petition" was filed November 30, 1998 on Mumia Abu-Jamal’s behalf. Though this strategy is now moot with regard to Mumia’s case, it is a valid strategy which can and should be used on behalf of another prisoner. The petition and amicus demand is available below.

Within 24-hours after it was filed, U.S. District Judge J.C. Waldman dismissed the "People's Petition." The basis on which Judge Waldman dismissed was that the applicant had to be related to the prisoner. Since that is not what the law says, ITJ filed for reconsideration, attaching a notice of appeal in expectation that Judge Waldman would be obstinate. A stay of all executions in the state of Pennsylvania was part of the relief sought in the petition, meaning that even if Judge Waldman refused to correct his order, he would have to issue the stay pending the appeal.

Judge Waldman has not ruled upon the motion to reconsider, even though it has been before him since early December. Coincidentally, or not, a number of scheduled executions have not taken place.
