Last Will and Testament of Tobias Oswalt

In the name of God, Amen. I Tobias Oswalt, being weak in body but of sound mind and perfect memory, blessed by God of the same, do make and publish this my last will and testament in manner and form, that is to say first i will and bequeath unto my wife Rachel Oswalt my dwelling plantation and the appertainances belonging thereto and also the proceeds of the whold one third part of all my personal property. I also bequeath unto my daughter Catherine Purky an equal part with all my children except fifteen dollars which I have already paid her. I also bequeath unto my son Jacob three dollars only as his whole legacy. I also give and bequeath unto the widow and heirs of my son, George Oswalt, eleven dollars which has already been paid which is the whole of their legacy. I also bequeath unto my sons, to wit, Andrew, and likewise my daughters Margaret, Elizabeth, and Rachel, and Isaac, John and Henry and Martha all an equal proportion. I also will and require that the dwelling plantation as aforementioned, after the decease of my wife. Rachel Oswalt, shall be sold for the best price it will fetch and divide in equal proportion as above mentioned. I hereby constitute my two sons Isaac and John my sole executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal this 17th day of August, 1827. Signed, sealed and published and declared by the above named Tobias Oswalt to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator, witness present: Jesse Tomlinson, (illegible) Moyer Jesse Valentine.

Bedford County: Personally appeared before the subscriber Register for the probate of wills and ranting letters of administration in and for said County, Jesse Tomlinson one of the subscribing witnesses to the above and within instrument of writing who being duly sworn deposeth and saith that he was personally present and heard and saw the testator Tobias Oswalt sign by making his mark, publish and declare the above and within instrument of writing as and for his last will and testament that at the time thereof the testator was of sound and disposing mind memory and understanding according to the best of this deponants knowledge and belief and that the named Nicholas Moyer and Jesse Valentine thereto subscribed as witnesses are the proper signatures of the said Nicholas Moyer and Jesse Valentine Sworn and subscribed the 3rd day of September A.D. 1827 before me Job Mann, reigister

Also, personally appeared on the 10th day of September 1827 Jesse Valentine one of the subscribing witnesses to the aforgoing instruments of writing who being duly sworn deposeth and saith that he was personally present and hear and saw the testator Tobias Oswalt, sign by making his mark, seal publish and declare the aforegoing instrument of writing as and for his last will and testament that at the time thereof the testator was of sound and disposing mind memory and understanding according to the best of this deponants knowledge and belief and that he subscribed his name thereto as a witness in presence of the testator and at his request Sworn and Subscribed the 10th Sept. 1827 Cor. Job Mann Register

Be it remembered that on the 10th day of September A.D. 1827 Letters Testamentary were granted to Isaac Oswalt and John Oswalt Executors in the aforegoing will named, having first been duly sworn according to Law - also sworn agreably to the act of assembly untitled an act relating to collateral inheritance.
