Once upon a time, our constitution specifically held the principal that the government would not ever be trustworthy in many areas and that is why specific privileges and immunities were spelled out. It was considered that if the government was not permitted to do certain things then certain undesirable government actions and results, because of government intrusion, and negligence, would not be possible either.

However, it is now common and presumed reasonable that the government does not do these things and therefore it is reasonable to permit discretion when delegating authority. We have lost the very principle's our founding fathers long ago knew to be true when our current government legislates child protection laws.

Immunities and presumptions are destroying the lives of far too many children.

Our legislators can reason that if a person is held accountable for drinking alcohol and driving then accidents will be minimized.

But our legislators appear to fail to reason that if the child protection laws are going to protect administrator's, court appointed attorneys, psychologists and social workers, as well as overzealous prosecutors, first and foremost, then child protection laws may also fail to protect children and minimize the risk the laws intend to do by presumption and procedure instead of realizing that the children need protection, not presumptions.

When the current child protection laws are "corrected," to not only protect children from actual abuse situations, but to also protect children from negligent and incompetent social workers, psychologists,  judges, and prosecutors, as well as attorneys involved, then we will have effective and just child  protection laws. Currently we have child protection laws that protect, with immunities; judges, prosecutors, psychologists, social workers and many attorneys and these individuals are protected on nothing more than a presumption that there are not negligent, incompetent, or corrupt individuals involved with child welfare, or that impartial judges and the court's "fact finding functions" will protect children from these situations. This is insanity. Any society that permits a special group to have special  privileges will invite and create a situation where negligence, incompetence, and corruption may flourish unchecked.

Any law that can effectively protect children must also effectively protect children from system abuse and negligence from prosecutors, judges, attorneys, social workers, psychologists as well as abusive parents, or abusers. If the government cannot, or will not, protect children from its own negligence and incompetence then children are not being protected.
