Lusk, Samuel - Last Will and Testament of Samuel Lusk

In the name of the God above I, Samuel Lusk of the town of Clarendon County of Orleans and State of New York Farmer do make and declare this my last will and testament in manner and form following.  First I resign my soul in the hands of Almighty God hopeing and believing in a rempion (redemption) of my sins by the merit and mediation of Jesus Christ and my body.  I commit to the earth to be buried at the direction of my friends and my worldly Estate I give and desire as follows:  All my personal property I give and bequeath to my beloved wife Comfort Lusk.  I also give and bequeath all my real Estate to my beloved wife Comfort Lusk to have and to hold the same and all the profits arising therefrom during her natural life.  After her decease then to be divided equally among my children being ten in number.  I do hereby appoint my beloved wife Comfort Lusk Executrix of this my last will and testament in witness whereof I have hereunto set my hand and seal this twenty-ninth day of November in the year of our Lord one thousand eight hundred and thirty four.

Signed, sealed and published and delivered by said testator as and for his last will and testament in presence of us who at his request in his presence and in presence of each other have subscribed their names as witnesses thereunto.

Comfort Lusk being duly sworn deposes and says that she is the executrix named in the will of Samuel Lusk deceased here in court produced. That the said Samuel Lusk returned home from Camillus in or about the month of January last and as stated by her two witnesses above mentioned.  That just before the said Samuel was confined by the sickness that terminated his life he took the will herein Court produced and gave it to this deponent and directed her to keep the same.  That this deponent kept the said Will sealed up by an outside wrapper untill after the death of the deceased when it was given to James Lusk to bring to the Surrogate for probate and this deponent says from the time that the testator gave the said will to her to keepthe same was not in any way altered or opened untill after the death of the deceased and then opened only and in no way altered or changed.

Sworn and subscribed the 2d day of October 1835 before me John Chamberlain, Surrogate

Richard Lusk being duly sworn deposes and says that he was well acquainted with Samuel Lusk at the time and before his death.  That his residence according to deponents best knowledge and belief was in the town of Clarendon in the County of Orleans.  That the said Samuel Lusk died in the said town of Clarendon in the month of May last – that he left a widow Comfort Lusk and ten children.  Eight of whom are under the age of twenty one years according to deponents information and belief.  That the deceased died a natural death.  That this deponent saw the said Samuel Lusk subscribe the will herein Court produced by making his mark.  That the deceased signed said will in the presence of this deponent and one John Sears.  That the said testator at the time of executing said will declared the same to be his last will and testament.  That this deponent signed said will therein Court produced at the request of the testator.  That the testator signed said will at the town of Camillus in the County of Onondaga being there at the time upon and until after the execution of said Will as aforesaid the testator too the said home to Clarendon, Orleans County as he said and further this deponent says not.  Except at the Execution of said will he resided in Lysander, Onondaga Co.

John Sears being duly sworn deposes and says that he saw Samuel Lusk make his mark at the end of the will here in Court produced.  That the said Samuel deceased executed said will in the presence of this deponent and one Richard Lusk and this deponent then lived in the town of Camillus in the County of Onondaga where the testator then executed said Will.  That the testator at the time of Executing said Will declared the same to be his last will and testament.  That the deponent signed said Will as a witness at the request of the testator and the testator took the same as stated by the aforesaid Richard Lusk to bring to the town of Clarendon the then residence of the deceased.  And this deponent further says that at the time that the testator Executed said Will he was of sound mind and memory.
