This indenture made this 18th day of December in the year of our Lord one thousand eight hundred and twentynine between William Nichols of the first part and Patrice O'Neal of the second part and Jepe G. Thomas of the third part, all of the county of Lawrence and state of Alabama. Witneseth that the said William Nichols hath this day received of Patrick O'Neal the aforesaid the sum of sixty eight dollars and twenty five cents of which the said William Nichols hereby acknowledges the receipt of for securing the payment of the said sum of sixty eight dollars and twenty five cents by the said William Nichols to the said Patrick O'Neal and for the further consideration of four dollars to him the said William Nichols in hand paid by the said Jepe G. Thomas trustee the receipt whereof is hereby acknowledged by the said William Nichols granted, bargained and sold and by these present do bargain and sell unto the said Jepe G. Thomas for use of Patrick O'Neal a certain sorrel horse about thirteen years of age. A black mare about thirteen hands high, nine years old, eight head of cattle [Viz] five cows and three heifers, two feather beds and furniture, two pots, six puter plates and six eartherns plates, three sows and pigs, three axes, two plows and five hoies, thirty five barrels of corn, and Set of glasses, the said property now in possession of said William Nichols, to have and hold said property herein before named bargained and sold unto the said Jepe G. Thomas his heirs and assigns for the use aforesaid, and he the said William Nichols binds himself, his heirs and assigns to warrant and defend a good and lawful title in and to the aforesaid mentioned property and the said Jepe G. Thomas, his heirs executors administrators and assigned against any claim or demands of the said William Nichols his heirs or any other person whatsoever. All for trust and special confidence nevertheless and for no other purpose whatsoever that the said Jepe G. Thomas shall and will permit the said William Nichols to keep possession of the aforesaid property until the twenty-fifth day of December 1830 hereinafter and as soon thereafter as he may be directed by the said Patrick O'Neal after giving fifteen days notice of the time and place of sale. The above named property to the highest bidder for cash and Out of the proceeds of said sale pay the said Patrick O'Neal the said sume of sixty-eight dollars and twenty five cents with charges, cost which may attend effecting said sale and after paying said debt and cost pay the balance if there by any to the said William Nichols his heirs or assigns.
