TAMPA, Fla. (AP) - Backstreet Boy Nick Carter was arrested on suspicion of refusing to follow police officers' orders to leave a nightclub after a fight broke out.
The youngest of the five-member pop group at age 21, Carter was charged early Wednesday with a misdemeanor count of resisting/opposing a law enforcement officer without violence. He was handcuffed, placed in a squad car and released on his own recognizance.
His first court appearance is set for March 4, Tampa Police spokesman Joe Durkin said Thursday.
Police were called to the Pop City nightclub early Tuesday evening because of a fight. They returned to the nightclub later in the night to break up another disturbance. While officers made arrests and tried to restore peace, Carter became involved in an argument with a woman, according to the arrest affidavit.
He was told to leave the nightclub more than 10 times until officers told him to leave by ``the count of 3'' or he would be arrested. Carter continued the argument and was arrested, the affidavit said.
``Outside of who this defendant is, it's not that unusual a thing to happen,'' Durkin said.
Carter, who lives outside Tampa, is the second Backstreet Boy to run into trouble in recent months. In July, A.J. McLean spent time at a rehabilitation center for depression and alcohol abuse, forcing the group to postpone its U.S. and Canadian tour. McLean, who turns 24 next week, has said he's been sober ever since.
Sonya Muckle, vice president of publicity for Jive Records, the Backstreet Boys' label, did not immediately return a phone call seeking comment Thursday.

Nick was arrested for resisting a Tampa police officer.
A fight broke out. Nick was in the process of leaving, and had one foot in the car, when a girl stopped him and asked if he knew a mutual friend. He did. He got out and talked to her. An officer asked him to leave. He ignored him and kept talking. Then the officer came by and asked him to get into the vehicle repeatedly. Nick told Vicki he explained to the officer that he was just trying to talk to a friend, but the officer still wanted him to leave. At that point, the officer counted to 3 quickly, and then arrested him, even though Nick explained to the officer that he just in the process of leaving and trying to talk to a friend.
He doesn't believe he did anything wrong, but is concerned about his younger fans' outlook. He believes it was just blown out of proportion.

Hey everyone.. Last evening I wrote to the radio station 933 FLZ, a local Tampa radio station, .. if some of u aren't aware.. 933.. had gotten calls from supposed 'eye witnesses' who were there da nite at Pop City when Nick was arrested.. saying Nick exposed himself...Saying Nick was crying.. Dat Nick was fighting w/ some chick.. etc.. Well the DJ's at 933.. I thought weren't being very indifferent about it.. they literallie laughed on da air (as u can listen to in some of da clips on 933).. and made Nick seem like he did something horriblie wrong and what not.. when he didn't do one thing wrong (in my eyes ne ways).. I mean for me.. Nick has DJ'd for dat station..and I am a long time listener for da station.. So I thought they'd be more cordial towards da matter..but apparently.. they weren't.. So I emailed them telling everyone at da station I thought it could have been handled more professioallie.. and I thought it was quite rude dat people r starting to link da news about Nick towards AJ's time off for rehabilitation..The following is an exerpt from my actual email:

TAMPA -- Millions of teenage girls can breathe a collective sigh of relief.
Heartthrob Nicholas Gene "Nick" Carter, the smash singer of the all-male pop group Backstreet Boys, won't become a convicted criminal.
Carter agreed to enter a pretrial intervention program that will allow him to avoid jail and any criminal record for getting into a spat with a Tampa police officer at a nightclub last month.
"He is a first-time offender, and we treated him just like anyone else," Assistant State Attorney Pam Bondi said Friday.
Police handcuffed Carter, 22, on Jan. 2, saying he refused to stop arguing with a woman and leave Pop City, a video arcade and nightclub on Channelside Drive in downtown Tampa.
As the club was closing about 3 a.m., police ordered Carter 10 times to leave but he wouldn't, authorities said. Police did not say what Carter and the unidentified woman were arguing about.
Carter only calmed down when an officer handcuffed him and put him in the back of a police car, police said.
At the time, Carter, who grew up in Ruskin and often hangs out at Pop City, said he had "done nothing wrong."
"I truly believe my celebrity motivated the officer to arrest me," he said in a statement released soon after his arrest.
Police, however, said they didn't know who Carter was. The same police officers approved the pretrial intervention deal, Bondi said.
Carter was charged with resisting or opposing a law enforcement officer without violence, a misdemeanor. If convicted, the internationally known sex symbol could have faced a year in jail and probation.
But rather than go to trial and risk a criminal record, Carter agreed to enter a pretrial intervention program, which is similar to probation. He will pay a fine, perform community service and serve a period of probation.
Bondi didn't know Friday how long it would take for Carter to complete the program. She also didn't know the size of the fine or the number of hours of community service Carter will complete.
The State Attorney's Office often offers first-time offenders the chance to keep their records clean by completing pretrial programs. If Carter finishes the program, prosecutors will drop the charges.
"He made a stupid decision that night," Bondi said.

It had to happen sooner or later. Even in the most harmonious of boy bands, someone will chafe at having to submit to the will and creative demands of the group, and he'll strike out on his own. The first of the Backstreet Boys to do so will be Nick Carter, who says he's preparing a solo release for this fall on BSB's Jive label.
''Right now I've been in the studio, and I've got, like, over 30 songs recorded,'' he tells Launch.com. ''And they are thinking about a single in a couple of months, and the album later on this year --maybe late September.'' He says the sound won't be too different from his pop work with BSB, lest he alienate his fans. ''Of course, I can't stray too far away from what I've done, so I'm stuck with that.'' However, he says, some tunes will have more of a rock feel. ''It's going to be interesting to see how the public accepts it.''
The singer has been spending a lot of time on non-Backstreet projects lately, like racing power boats professionally with his father, playing concert dates with brother Aaron Carter. But he insists that his solo work doesn't mean there's trouble in boyland. ''We're not breaking up. I mean, everybody's all, like, worried: 'Nick's doing this and the Backstreet Boys are over,' and all this stuff,'' he says. Rather, it was just time for a change. ''I've been in the group for 10 years, since I was 12, so I mean, I'm 22 now and I really want to try something new. That's basically what I'm doing. Sometimes you can't make everybody happy -- that's the one thing I've learned in life -- but the guys are supporting me, so that's good.''

Nick Carter says he is being pressured to leave the Backstreet Boys by another member of the all-conquering pop combo. He claims that band mate Brian Littrell, thinks Carter's solo career is "destroying" the band and has told Carter to decide which project he intends to pursue full time.
"I'm only using this break from The Backstreet Boys to make my dream come true," Carter told Popcorn magazine.
"This is blackmail. It seems like Brian is simply jealous of my plans and tries to push me out of the band."
Nick Carter is currently taking time out from The Backstreet Boys to concentrate on recording his album at studios in London and New York.The solo album is scheduled to hit shops in October.

Ish an independent film by director, Eric Spaar... ne ways .. a slight synopsis of da film: Ish about 2 gay high school boys during the Three Mile Island nuclear meltdown scare back in 1979.. I appear in the high school dance scene!!! I had madd fun! Thanks Steve for inviting me onto da set of ur new film!! I appreciate the invite n I had more fun than u ever know.. thanks for helping me make mah film dreams come true! :)

Now or Never, Nick's solo debut album will take over stores October 29th, 2002! Carter's song "Help Me" is under consideration for his first single. Da entire album has a rock-oriented feel dat hits "The Call" n "Larger Than Life" brought thru BSB's previous albums. Da blonde Backstreeter's album also features instrumentation thru guitars..drums n bass! He plans on supporting Now or Never on tour n he's in da process of assembling a band for da road. Da new BSB album following 2000's Black n Blue phenomenon is set for a release earlie 2003. From rumors on various music networks, fellow bandmates..Brian, Howie.. Kevin n Aj rn't keeping close vigil to Carter's dream come true... although for Nick.. his dreams of a solo career r finallie coming true..

So ur prollie wondering wha Nick's been up to lately... on September 11th, 2002..Nick appeared at Tampa's radio station 933 FLZ for a 9.11 tribute. Then on September 16th, 2002.. Nick's 1st single as a Solo Artist appeared on MTV's: Making The Video. Lemme jus say.. it was mah first time seeing it.. I thought his video is awesome..da visual effects were awesome.. da camera shots.. Nick himself..everything!! So ne ways.. I would like to ask everyone to vote for Nick on MTV's TRL!!!. Vote for Nick -n- bring his first single "Help Me" to number 1!!! We luv u Nick -n- ur new single :)
