Michael G. Love’s Will

I Michael G. Love of the County of Stanly and State of North Carolina, being of sound mind and memory but considering the uncertainty of my earthly existence, do make & declare this my last ill and testament in manner and form following,
That is to say

First that my Executor here in after named shall provide for my body a decent burial suited to the wishes of my relations & friends and pay all funeral expenses, together and my just debts howsoever & to whomsoever owing out of the moneys that may first come into hands as a part or parcel of my estate

Item I give & devise to my beloved wife one hundred acres of land to be set out by metes and bounds in the north end of the tract whereon I no live so as to include my mansion house & all out houses & other improvements to have & to hold to her the said Phoebe F. Love for & during the term of her natural in satisfaction for & in lieu of her doer & thirds of & in all my real estate

Item I give & devise to my five sons and to daughters, that is to say Postell Porter, Thomas Alexander, James Symon, Calvin Deberry, Hartwell Spain, Jane Matilda, Mary Elizabeth all the balance of my land to be equally divided between my sons & daughters

Item I give and devise to my five sons Postell Porter, Thomas Alexander, James Symon, Calvin Deberry, Hartwell Spain, one horse and saddle & bridle to be furnished by my wife hen they come of age, that is to say twenty one years of age, also my to daughters Jane Matilda, Mary Elizabeth one horse, saddle & bridle to be furnished as above stated.

Item I give and bequeath to my said beloved wife all household & kitchen furniture all of my horses, cattle, sheep, hogs, domestic fowls & poultry. All my crop of every description that may be on the plantation that I now cultivated and all the grain & provisions no on hand at the time of my death.

Item I give and bequeath to my said wife Pheby F. Love the rite of recovering of all legacies that may be due me by heirship at my fathers and mothers death, to have and use to her benefit and formally as she sees proper during her lifetime of widowhood. If she marries, then the legacy that may be in her hands indisposed of received of my Father and Mother to be sold and Equally divided between my wife Pheby F. Love and my sons & daughters

Item I give and bequeath to my said wife Pheby F. Love one road wagon & all of my farming tools and lastly I do hereby constitute & appoint my trusty friend C C Love my lawful Executor to all intents and purposes to execute this my last will and testament according to the intent & meaning of the same and every part & clause thereof hereby revoking and declaring utterly void all other wills & testaments by me heretofore made. In witness whereof I the said Michael G. Love do here unto set my hand and seal this twenty first day of March A. D. 1862. Signed Sealed published and declared by the said Michael G. Love to be his last will & testament in the presents of us ho at his request & in his presents do subscribe our names as witness there to
