OSBORNE THOMAS
last will and testament


State of North Carolina, I Osborne Thomas of the County of Union & State aforesaid being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following that is to say

First That my executor herein after named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and to whom soever rising out out of the monies that may first come into his hands as a part or parcel of my estate.

Item 1st I give and devise unto my beloved wife Julina Thomas one Hundred and two acres of land on the waters of Richardsons Creek andjoining the lands of ALa Broom, Ezekiel Yarborough, Addison Whitley & others for and during the term of her natural life and at her death to go to my lawful heirs share and share alike. I also give and bequeath to my beloved wife Julina one Black Mare to be her property absolutely and also give and bequeath to my beloved wife all my household and Kitchen furniture and all my stock of cattle hogs and sheep to be her property absolutely and I also will that my wife have all the provisions of every Sort both for man and beast that may be on hand at my death.

Item 2nd I give and devise unto my children that tract of land lying on the waters of Richardsons Creek adjoining the lands of Redden Staton and others known as the old Thomas tract containing sixty-one acres to be theirs absolutley share and share alike.

And lastly, I do hereby Constatute and appoint my trusty friend Addison Whitley my lawful executor to all intents and purposes to execute this my last will and testament according to the true and intent and meaning of the same and every part and clause thereof hereby revoking and making and declaring uterly void all other wills and testaments by me heretofore made.
In testimony whereof I have hereunto set my hand and seal this 25th day of April A. D. 1862 Signed sealed @ declared to be his last will and testament in the presents of of us

Then the last will and testament of Osborne Thomas was brought into Open Court & proved in due form of law by J. E. Irby and S. B. Webb And Ordered to be recorded whereupon Addison Whitley ws duly sworn as executor of the same.

Osborne enlisted 28 Apr 1862 and was killed at Fredricksburg 13 Dec 1862
