Article II in a Petition of the Final Estate of Sarah Thomas


As found in the loose leaf estate records at North Carolina State Archives, the final estate record for Sarah Thomas included a petition of which article II reads as follows:

II. That Sarah Thomas late of the county of Union on or about the ___ day of September 1867 departed this life Intestate leaving as her heirs at law the Defendant Winnie Austin intermarried with the Defendant James Austin also the heirs of David Thomas a son of said Intestate that is to say the Defendants James R. Thomas, Sarah Brewer, intermarried with Solomon R. Brewer. John M. Thomas, William G. Thomas, Jane Williams, Ellen Brooks intermarried with the Defendant Joshua Brooks, Edmond Thomas all of full age and David Thomas , George Thomas infants who have for their regular Guardian Edmond L. Davis of said County. David Griffin also an infant (child of Elizabeth Griffin dec'd - daughter of David Thomas) whose regular Guardian is John M. Thomas. Also the heir of her deceased son Headley Thomas Viz: Defendants Wily Thomas, Calvin Thomas, Elizabeth intermarried with Riley Austin, Adeline Thomas, Sarah Thomas all of full age and John Thomas Catherine Thomas and Winnie Thomas infants without any regular Guardian. Also the heirs of her deceased son John R. Thomas Viz: the Defendants Marshall Thomas, Elizabeth Thomas, Harbert Thomas, Calvin Thomas, Jane E. Thomas, Annice A. Thomas all infants without any regular Guardian. Also her sons the Defendants Ebenezer Thomas and Jacob Thomas and her daughter Lucy howard intermarried with John Howard all of full age also the heirs of her deceased son Ananias Thomas Viz: the Defendant Ashley Thomas, James Thomas, Martha Thomas Elizabeth Thomas and Mary Thomas all infants without any regular Guardians. Also the children and heirs of deceased son Benjamin Thomas Viz: the Defendant Ellen Howard intermarried with Elbert Howard of full age and the Defendants Elizabeth Thomas and George Thomas infants without any regular Guardian.
