Be it Known that I Martin SWINDELL of the State of North Carolina & County of Hyde of the one part and Joseph TUNNELL of the same State and county of the other part Witnesseth that I the said Martin SWINDELL do bargain and sell unto Joseph TUNNELL a certain Negro Girl Known by the name of Lydia for the valuable consideration of the sum Two hundred & Eighty one Dollars and fifty Cents to me in hand paid at or before the delivery of these presents the Recpt. and payment whereof I do hereby acknowledge myself satisfy.d contented and paid and I Martin SWINDELL do for myself my heirs Executors Admrs. and assigns warrant and forever defend the right of the aforesaid Negro Girl Lidia unto said Joseph TUNNELL his heirs Executors Admrs. and assigns free from the Lawfull claims of any person whatsoever In Testimony whereof I have hereunto set my hand and seal at Wysockin 2nd day Jany. 1822

Hyde County } Febry. Sessions 1834.

To the worshipful the parties of said Court. The petition of John HATCH and Nancy his Wife, and Hardy SWINDELL assigns of Willoughby BASNET & Polly his wife, humbly complaining Sheweth unto the Court that some time in the year Martin SWINDELL late of the County of Hyde departed this life Seized and possessed of the following real estate, to wit, One tract of land containing four acres of land, adjoining the William SWINDELL Oliver GIBBS & others on Wysocking Creek, one other tract of land adjoining the lands of William SWINDELL, Hardy SWINDELL, & others containing about three & one fourth acres, and one other tract of land commonly known as the Marsh lands, adjoining the lands of William YOUNG and Jesse GIBBS containing thirty three acres. Your petitioners further shew unto the Court that the said Martin SWINDELL left him surviving, his children, and heirs at Law, Polly, who has since intermarried with Willoughby BASNET, who have sold and assigned all their right & title & interest in and to the said lands to Enoch HALL, who has assigned the same to your petitioner Hardy SWINDELL, Nancy who has since intermarried with your petitioner John HATCH, and Hetty who is a minor of tender age, & David CARTER is her Guardian. Your petitioners being desirous to have partition made of the above described lands so that your petitioners John HATCH & Nancy his wife may have their One third part of said lands laid off & set apart to them in severalty, and that your petitioner Hardy SWINDELL in right of Willoughby BASNET & Polly his wife may have One third part of said lands laid off & set apart to thim in right of the said BASNETT & wife. Your petitioners therefore prays the Court to appoint five freeholders to be summoned by the Sheriff to divide the said lands & set off & alott to your petitioners their respective shares, and if it Shall appear to the said freeholders that an three equal division of the said lands cannot be made in each of the three said lotts of land Without lessing the Value of the lot so divided, then & in that case, the said commissioners being first sworn to do equal justice, among the claimants, according to the best of their Skill and ability, may charge the more Valuable lot or lots wiht such a sum of money as they shall judge necessary to be paid to the dividend or dividends of less Value in order to make an equitable division & make report of their acts & proceedings under their hands & Seals to next Term of Your Worshipful Court
