To the worshippful the Court of pleas & Quarter Sessions. In Obedience to an order to us directed we have this day been in our respective persons upon the premises set forth in the petition herewith accompanying this our report and after having it surveyed we find One hundred and twelve acres their being but eighty eight set forth in the petition, and after missing the situation of the land and its quality have set it of in lots as follows {viz} Begining on the South East side of the premises lot no. 1 nineteen acres to Samuel BROOKS & wife Penelope, No. 2 of the same quantity to Jackson SWINDELL, lot No. 3 of eighteen acres to Samuel G. WATSON & wife, lot No. 4 to Silvester SWINDELL contain fourteen acres, lot No. 5 to Benjamin SWINDELL of same quantity, lot No. 6 to David W. SWINDELL of same quantity, lot No. 7 to the heirs of Solomon SWINDELL of same quantity, with all the rights & privileges which the premises has heretofore been entitled to given under our hands & seals the 30th day of April 1845.

This Indenture on the sixteen day of February one Thousand Eighteen hundred and forty eight between Samuel BROOKS and his wife Penelope BROOKS of the County of Hyde and State of foursaid on the one part and Jackson SWINDELL on the other part of the same County and State of foursaid witnesseth that the said Samuel BROOKS and wife Penelope do for and in consideration of the sum of three hundred and sixty dollars to us in hand paid by Jackson SWINDELL before the signing and delivering of these presents the receipt hereof I do hereby acknowledged our selves sattisfied and paid have bargained and sold and conveyed unto the said Jackson SWINDELL his heirs executors and administrators and assigns forever certing pease of land on Mattamuskeet in said County cituated between Dixon SWINDELL and Jesse GIBBS wheare Hardy SWINDELL decd all of our Right and title of fifty one acres more or less I Samuel BROOKS and wife Penelope Part and Silvester G. SWINDELL and all that we heird By death of William Martin SWINDELL Part unto Jackson SWINDELL heirs, executors, administrators and assigns for ever defend unto Jackson SWINDELL and his heirs for ever and against all lawfull clames what so ever witness our hands and seal in the presents of

Then was this deed from Samuel BROOKS and wife Penelope BROOKS to Jackson SWINDELL duly proved in open court by the oath of Benjamin F. TUNNELL a witness thereto.
It having been represented and made appear to the satisfaction of the court that Penelope BROOKS wife of the said Samuel BROOKS is so infirm that she cannot travel to this court to be privily examined as to her executing the aforesaid deed of conveyance of her own free will and consent.
It is accordingly ordered by the court that a commission issue to take the private examination of the said Penelope BROOKS.

This Indenture made this 28th day of December A. D. One thousand eight hundred and fifty four: between Samuel BROOKS and wife Penelope of the one part and Israel W. GIBBS of the other part all of the County of Hyde and State of North Carolina: Witnesseth that for and in consideration of the sum of five hundred dollars to them the said Samuel BROOKS and wife Penelope in hand paid the receipt and payment of which is hereby acknowledged hath bargained and sold and do by these presents bargain sell and convey unto the said Israel W. GIBBS his heirs and assigns for ever all right title interest and estate we have either by purchase or inheritance in a certain tract or parcel of land which Hardy SWINDELL died seized & possessed and upon which he lived at the time of his death containing by estimation fifty one acres more or less which right and title as aforesaid embraces & includes the shares that descended by the death of Jackson SWINDELL to Sally wife of S. G. WATSON, Sylvester SWINDELL, Mordece wife of Henry GIBBS and Penelope wife of said Samuel BROOKS as also the further share that said Mordece heired by her father Solomon SWINDELLs death to have and to hold unto the aforesaid Israel W. GIBBS his heirs and assigns forever free and clear from us the aforesaid Samuel BROOKS and wife Penelope our heirs executors administrators and assigns and from any and all persons laying claim thereto.

May Term 1853 } Then was this deed from S. BROOKS & wife Penelope BROOKS to Israel W. GIBBS exhibited for Probate in open court & the due execution thereof was duly proved by the oath of Benners A. ENSLEY one of the subscribing witnesses thereto & it being made appear that the said Penelope BROOKS is unable to travel to this court to acknowledge the execution of the said deed. It is therefore ordered that a commission issue to Joseph SWINDELL and Joseph C. TUNNELL two of the Justices of the peace for this County to take the private examination of the said Penelope BROOKS touching her consent in the execution of the said deed and report these proceedings in due form of law to the next Term of this court.

This Indenture made the second day of March in the year of our Lord One thousand eight hundred and fifty five between Samuel BROOKS of the one part and Israel W. GIBBS of the other part both of the aforesaid State and County Witnesseth that I the said Samuel BROOKS for and in consideration of the sum of three hundred and fifty dollars to him the said Samuel BROOKS in hand paid by Israel W. GIBBS the receipt and payment is hereby acknowledged hath bargained, sold and doth by these presents bargain, sell and convey unto him the said Israel W. GIBBS, his heirs, executors administrators and assigns forever his the said Samuel BROOKS right, title and interest in a certain tract of land in the aforesaid State and County and in the Wysocking district known as the Hardy SWINDELL tract of land wherein the said Hardy died adjoining the lands of Joseph S. MANN & wife Fabius D. GIBBS & others that is to say the right, title and interest of which I purchased of Benjamin W. SWINDELL in the aforesaid tract of land being as yet undivided containing fifty one acres more or less together with the privileges appertainances thereunto belonging to have and to hold unto him the said Israel W. GIBBS his heirs assigns forever free from myself my heirs, executors, administrators and assigns and from any and all lawful claims thereunto. In testimony whereof I the said Samuel BROOKS doth hereunto set his hand and seal the day and year above written. Signed, Sealed and delivered
