This Indenture made the Seventeenth Day of April Anno Domini one Thousand Seven Hundred and Seventy one Between Jacob FARROW SENR., Esqr. of Cape Hatteras Banks in the County of Currituck in the Province of North Carolina of the one party and Stephen BROOKS of the Same place of the other party Witnesseth that the Said Jacob FARROW for and in Consideration of the Sum of Ten pounds Proclamation Money to him in hand paid before the Ensealing and Delivery of these presents the Receipt whereof he hereby acknowledgeth and himself therewith fully Satisfyed Contented and paid Hath Granted Bargained and Sold and by these presents doth fully and freely Grant Bargain & Sell Convey and Confirm unto the Said Stephen BROOKS his heirs and Assigns one Certain parcell of Land Sittuate in Hyde County in Armuskeat being a part of a tract of Land to me belonging before the Ensealing & of these presents Beginning at the First or Lowermost bend on Crooked Creek and Running from thence a West North West Course untill it Intersects with the northernmost Side of the Line of him the Said Jacob FARROW thence Running with the Said Line Northerly to the head of Cyprus Swamp Creek thence Down the Said Cyprus Swamp Creek by the Various Courses of the Same to Wissockin Creek then down the Said Creek Called & known by the name of Wissocken by the Various Courses of the Same to the Sound and from thence along the Sound by the various Courses to the mouth of the aforementioned Crooked Creek and from thence to the first Station Containing by Estimation one hundred Acres be the Same more or Less. To Have and to hold the aforesaid one hundred Acres be the Same more or Less togather with all and Singular the marshes Benefits priviledges and Commodities and appurtenances thereunto belonging or in any ways appertaining unto him the Said Stephen BROOKS and his Heirs and Assigns forever and the Said Jacob FARROW for himself his heirs Executors Administrators Doth Covenant and agree to and with the Afsd. Stephen BROOKS his heirs and assigns that the Said Stephen BROOKS his heirs and assigns shall and may forever hereafter peacebly and Quietly have hold Occupy and Enjoy the aforementioned Bargained premises with all and Singular the Appurtenances freely and Clearly to all intents & purposes off and from all and all manner of Gifts Grants Bargains Sails Laws Dowries Judgments Executions or any other Incumberances whatsoever his Majestys Quitrents from this Date only Excepted. And the Said Land with all and Singular the Appurtenances unto him the Said Stephen BROOKS his heirs and assigns the Said Jacob FARROW for himself his heirs Executors and Administrators Shall and will warrant and forever defend against the Lawfull Claim or Demand of any other person or persons whatsoever from or Deriving under one any Excurs. or Admors.
