This Indenture Made this 22nd day of May in the Year of our Lord 1806 – between Benjamin GIBBS Junr. of the State of No. Carolina & County of Hyde of the one part and Joseph JARVIS of said State & County of the other part Witnesseth that the said Benjamin GIBBS Junr. for and in consideration of the Sum of One thousand Dollars to him in hand paid by Joseph JARVIS at and before the Sealing & delivery of these presents the Receipt whereof the said Benjamin GIBBS doth hereby acknowledge, hath bargained, sold, and Conveyed and by these presents doth bargain, sell, Convey & Confirm to the Said Joseph JARVIS his heirs, or assigns forever a certain peice or parcel of [land] Situate in Hyde County, lying on Mattamuskeet on the No. side of Middle Creek – being the Land and Plantation whereon the said Benjamin GIBBS now liveth including the Land the said Benj. GIBBS’s father (Joseph GIBBS) gave him by a Deed bearing date Apr 4th 1787 – and also the Land which said Benjamin GIBBS bought of Josiah JARVIS as by Deed from said JARVIS to said Benj. GIBBS may fully appear – Begining at a Ceader post standing at a Small Gut where said Josiah JARVIS’s former line Crosseth said Gut, runing with said Benjamin GIBBS patent line No. 149 po. to a post then Et. 18 po. to a post then No. 154 po. to the back line of the Land formerly belonging to Joseph GIBBS Senr. Desd. which is also the back line of said patent then with said back line West 49 po. 11 links to the Marked line between said Benj. GIBBS & Daniel GIBBS then with said line So. 278 to the Edge of the Leading Ditch as it was Cut in the Life of Joseph GIBBS Senr. Desd. then with sd. ditch to the first Station Containing 67 ¼ Acres – to have and to hold the above bargained and described Land Together with all and Singular the privileges & improvements and emoluments belonging or in anywise appertaining to the said Joseph JARVIS his heirs or Assigns forever and the said Benj. GIBBS Junr. for himself his heirs or Assigns the above bargained & described prems. with the appertainances unto the said Joseph JARVIS his heirs and Assigns doth Warrant & shall ever defend by these presents against the Claim or Claims of him the said Benjamin GIBBS his heirs or Assigns or any other person or persons whatever – In Witness whereof the sd. Bn. GIBBS Junr. hath hereunto set his hand and Seal the day & year above Writen.
