Dear Sir:
This is the revised and augmented text of a letter sent originally to the Human Rights Bureau of the United States Department of State on the 24th of January, 1996. The attached sheet indicates that the State Department never responded, nor did any person or agency supplied with a copy of the letter provide substantive response, action, or effective advocacy.
Since at least 1982, I have been subjected to a program of persecution and terrorism in apparent retaliation for my free exercise and enjoyment of First Amendment rights and other rights and privileges secured to me by the Constitution and laws of the United States. Throughout, I have found all avenues of recourse corruptly obstructed. Police, prosecutors, attorneys general, and governors have ignored or insulted me. Civil rights agencies, public and private, and human rights advocates have passed the buck, or else whitewashed the outrages I have experienced.
Having for many years obscenely invaded my personal privacy, agents of the United States and the State of New York and their associates have carried out a program of slanderous attacks on my honor and reputation, depicting me as crazy or criminal, or both, sometimes even denying and misrepresenting my very identity. Having no access to their secret files, their falsified documents, their lying witnesses, their doctored photographs, I cannot confront the liars. As a result, I am everywhere anathematized, discounted, patronized, rejected, treated like a suspect or, at best, a nuisance. For the record, I am a natural-born American citizen who has never been charged with or convicted of any crime, in any state or nation. No mental competency hearing was ever held with respect to me.
Lawyers will not take my case. My Senators and three different Congressmen have refused to act and have participated in the coverup. Apparently influenced and intimidated by American forces, three European nations have refused to grant me political asylum and have returned me, against my will, to this country. United Nations agencies have not acknowledged my correspondence.
Agents of the United States, some of them "privatized," have subjected me since 1987 to incessant electromagnetic violation and concomitant mental torture, including the abuses described by Mr. John St. Clair Akwei in his lawsuit against the National Security Agency (US Civil Action 92-0449), as published in the April-May, 1996 issue of Nexus magazine (Volume 3, Number 3). For this crime against humanity, there has likewise been no recourse or remedy available to me these ten years.
I hereby accuse the United States of America of long-standing and extremely serious violations of my rights under the First, Fourth, Fifth, Sixth, Ninth, and Fourteenth Amendments to the Constitution, Title 18, Sections 241 and 242 of the United States Code, other federal and state statutes, and Articles 2, 3, 4, 5, 7, 8, 9, 10, 12, 14, 16, 17, 18, 19, 20, 21, 22, 25, and 26 of the International Covenant on Civil and Political Rights. These are summarized as follows:
Article 2
Sex (discriminatory treatment leading to, and in the course of, a divorce trial in 1991).
Language (An early investigator in or about 1983 told my next-door neighbor "This talking in German is part of it all").
Religion (My personal philosophy, a mixture of Taoism and occultism, has apparently been slanderously misrepresented as satanism. Ironically, many of those responsible are themselves satanists associated with the Temple of Set).
Political or other opinion (I am a liberal Democrat, sometimes discriminated against on that basis, sometimes maliciously misrepresented as a terrorist of the right or the left).
Other status (I am maliciously misrepresented as a mentally incompetent person with a history of aberrant behavior, a victim of paranoid schizophrenia or delusional disorder, a fugitive from justice, an illegal alien, and the like).
Despite many attempts to obtain effective remedies for violations of my rights, federal authorities and those of New York and New Jersey have consistently, sometimes insultingly, denied me such remedies.
Article 3
I maintain and charge that the State of New Jersey did not accord to me the same protections in the course of my divorce dispute (Middlesex County, New Jersey Docket Number M-19503-90) that a woman in comparable circumstances would have enjoyed.
Article 4
The United States of America has obviously derogated from its obligations under the Covenant with respect to my rights and probably those of multitudinous others, without observing the procedure set forth in this Article. Its lack of just cause and avoidance of accountability demonstrate blatant contempt for its own Constitution and laws, for international law, and for the common standards of human rights, human dignity, and human decency. Its violations of Articles 7, 8, 16, and 18, moreover, can find no justification in Article 4's derogation procedures.
Article 5
The United States may not seek to justify its deprivation of property without due process of law (a violation of the Fifth and Fourteenth Amendments) on the grounds that such deprivation is not prohibited by the International Covenant on Civil and Political Rights.
Article 7
Assault with radiation, resulting in blood dyscrasias, depressed immunity, sterility, and endocrine imbalances.
Somatic disruption, including cardiac arrhythmias, by means of "biological process control" weapons.
Poisoning with microbes and other toxic substances, resulting in chronic and recurring infections, sexual dysfunction, pain, suffering, and disability.
Obscene deprivation of privacy and constant stalking.
Repeated interference with my medical care, "complimenting" -- that is, securing the cooperation of -- medical personnel, to impose and prolong physical suffering and limitation and to prevent certification of my physical disability.
Similar interference with all attempts to obtain legal representation or other effective advocacy.
Since 1987, these agents have subjected me to a program of torture, using state-of-the-art anti-personnel weaponry that detects private thoughts, images, and other bodily states. This device also imposes upon a hapless victim degrading and disruptive verbal assault and other aversive sensory input, from which no escape is possible.
No remedy has been available to me with respect to these and other forms of cruel, inhuman, degrading treatment. Like many previous attempts to obtain such a remedy, letters since 1995 to the FBI, the President, the National Security Council, the Defense Criminal Investigative Service, the UN Committee Against Torture, the US State Department, the Supreme Court, the US Attorney General, and the Governors of New Jersey and New York, when acknowledged at all, have produced only specious rejections.
Article 8
The brain-invasion equipment used to torture me not only deprives me of privacy, solitude, and intimacy; it also forces upon me a circumstance in which I cannot respect the confidence of others, cannot keep anyone's secrets. This makes me an involuntary, unpaid agent of the United States Government -- a slave-spy. Such forced labor is a human rights violation. If my government wishes to observe others through my senses, it should secure my consent and provide me with appropriate remuneration.
Article 9
I maintain that the kind and degree of surveillance to which I am subjected, the malicious interference with all aspects of my personal life, and the calculated imposition of physical pain and disability mentioned above, create a condition that so limits my personal liberty as to amount to a form of detention. This condition is imposed in a manner entirely extralegal and devoid of all due-process guarantees and protections. I thus claim status as a Prisoner of Conscience, deprived of my liberty on the basis of my political and other beliefs and the free exercise of my Constitutional rights.
Article 10
This limiting circumstance constitutes and involves treatment utterly contemptuous of my humanity and my inherent dignity as a human person.
Article 12
I have left the United States three times, seeking political asylum in European nations, stressing in all instances my status as a victim of torture. These nations nevertheless forcibly returned me three times to the land of my torturers. Responsibility for this unimaginably vicious cat-and-mouse game, which cost me my money, my health, and almost my life, must be borne not only by Denmark, the Netherlands, and Belgium, but, as well, by the disgustingly cruel and contemptuous government of my own nation, with whom they acted in concert. I do not wish to be here. I would leave again if possible, but poverty and illness now preclude any further attempts at escape from America.
Article 14
I have been denied a fair and public hearing:
In the matter of contract grievances and disciplinary grievances filed by myself under the contract between the State of New York and Public Employees Federation, AFL-CIO.
In the matter of my complaints before the Office for Civil Rights of the United States Department of Health and Human Services (Docket Number 02-86-3013, later changed to 02-86-3016, and, still later, to 02-88-3073, and Docket Number 02-86-3057).
In the matter of my Improper Practice Charge (Case Number U-10571) before the Public Employment Relations Board of the State of New York.
In the matter of my divorce (Middlesex County, New Jersey Docket Number M-19503-90). There were irregularities in process, probable ex parte contacts between my former wife and Judge Mark B. Epstein, and a markedly unfair hearing in which I was forced to represent myself.
In secret, non-adversarial "evaluations" held under the auspices of, or at the instigation of, my former employers, the New York State Office of Mental Retardation and Developmental Disabilities, malicious persons have slanderously accused me of criminal offenses, generally the result of criminal "set-ups" (conspiracies to provide false information to law enforcement authorities). I was not informed of these "evaluations," before or after the fact, not informed of the allegations presented therein, and not allowed to respond on the record. Indeed, my employers declared in a grievance hearing that no such "evaluations" were taking place. Although I do not enjoy access to the records of these proceedings, they have been slanderously disclosed to many others in order to impugn my sanity and attack my honor and reputation.
Article 16
Agents of the United States and the State of New York have violated my right of legal personality by pretending that I am someone other than myself, inciting sundry persons and agencies to regard me as a person named "Graff," an allegedly mentally-incompetent person known as "James Thorton" or "James Thorton Graf," "James Henry," and possibly others. I am James Henry Graf, born March 21, 1942 at Christ Hospital in Jersey City, New Jersey. Except for my years as a resident undergraduate at the Catholic University of America in Washington, DC from 1960 to 1964, I have never resided in any state other than New Jersey. My Social Security Number is ***-**-****. My US Passport Number is 091659005. My New Jersey Driver's License Number is G7144 38368 03424. I have never been known by any other name, nor have I used any other identifying numbers. I have one and only one identity.
Article 17
Since the 1970s, agents and their associates have subjected me to arbitrary and unlawful interference with my privacy, family, home, and correspondence, in multifarious ways and on innumerable occasions:
At my home in New Jersey (Weehawken, Jersey City, Iselin, Elizabeth, and Perth Amboy).
In New York State and City.
On vacation in Massachusetts in 1981 and 1982.
On the roads of New York and New Jersey.
In the Netherlands, Denmark, and Belgium.
In other locations where correspondence was intercepted or tampered with or where family members may have encountered interference.
As noted in paragraph 2 under Article 14, agents of the United States and the State of New York have subjected me to systematic, unlawful attacks upon my honor and reputation, with no right of confrontation or reply. Psychiatric discreditation is one objective of this program of defamation.
I am consistently denied the right to the protection of the law against this interference and these attacks.
Article 18
The nature of the electromagnetic assault inflicted upon me is such that it violates my right to freedom of thought, conscience, and religion. Without privacy of thought, how can one pray, examine one's conscience, or practice one's freedom to think and believe as one wishes?
Article 19
My torturers have subjected me to unlawful interference with my opinions, particularly my belief that marijuana is harmless and should be legalized.
Through interference with my correspondence and attacks on my reputation, agents of the United States and the State of New York have repeatedly violated my right of free expression and the communication of ideas. These agents have thwarted all my attempts at getting my writings published. They may even have sought to register my creations fraudulently under their own copyright. They have also apparently composed and submitted correspondence and other writings in my name, casting a false light on my character and opinions.
These same agents have maliciously interfered with my efforts to obtain information and ideas from others and have repeatedly restrained my legal right of access to personal records, files and other information.
Article 20
My country has waged "low-intensity conflict" against me, treating me as an enemy in war. I maintain, therefore, that the campaign of hate and defamation carried out against me violates my rights under this Article. Wherever I have gone, agents of the United States and the State of New York have incited persons in my community to acts of discrimination, harassment, and hostility. Such things ought not occur in a land of Constitutional liberty.
Article 21
Many of the crimes committed against me have constituted retaliation against my right to freedom of peaceful assembly, particularly regarding my participation in demonstrations against the Vietnam War and in a demonstration against US military aid to El Salvador in Jersey City, New Jersey on or about February 28, 1982.
Article 22
I have also suffered retaliation against, and interference with, my right of free association:
In my personal friendships.
In my efforts to exercise my rights under the Contract between the New York State Office of Mental Retardation and Developmental Disabilities and Public Employees Federation, AFL-CIO.
Article 25
On Election Day, 1990, at about three in the afternoon, I walked from my home in Iselin, New Jersey to the polling place for my district, the Robert Mascenik School. By the time I arrived, the polling place was closed. There were no signs indicating an election. The doors were locked. Investigation will reveal that many others in my community successfully voted at that location on that date. My shut-out was an egregious denial -- sickening and typically "cute" -- of my right to participate in the election. My then-congressman, Bernard J. Dwyer, and Senator Bill Bradley, informed of the outrage in letters to their offices, would not provide any advocacy.
Article 26
The United States, the State of New York, and the State of New Jersey have consistently denied me the equal protection of their laws with respect to the following:
A pattern of government-instigated terrorism and endangerment, including:
Possible attempted murder on October 4, 1984 at the New York Hospital for Joint Diseases, resulting in the death of my hospital roommate, the late Sanford Liebgold.
Numerous "set-ups" and acts of provocation and endangerment on the highway from 1982 to 1991.
Numerous other acts of criminal conspiracy to provide false information to law-enforcement authorities.
The destruction of my legally-parked automobile in a suspicious "accident" on October 14, 1989.
The stabbing and death of my dog on September 9, 1987.
The torture and death, for terroristic purposes, of several dogs in and around Iselin, New Jersey, in the summer and autumn of 1987.
In the malicious destruction of my health, causing radical reduction of income through lateness and uncompensated disability as well as out-of-pocket expenditures.
In malicious interference with my medical care, to prevent me from documenting my physical disability and collecting benefits therefor.
In the termination of my employment by the State of New York in an ex parte arbitration hearing at which I was too sick to be present and at which my interests were entirely unrepresented.
In the destruction of my car, for which I was corruptly prevented from obtaining an insurance benefit.
In an outrageous, fixed divorce trial at which I was forced to represent myself.
In a larcenous conspiracy to deprive me, in 1987, of a Reader's Digest Sweepstakes prize of which I was apparently the rightful recipient.
In innumerable burglaries and petty thefts since at least 1982.
In malicious and destructive tampering with files (on disk and paper), computer software, computer hardware, and other electronic equipment.
In theft of documents.
In malicious theft of intellectual property.
In malicious incitement of others to overcharge for services and to take advantage of my generosity.
Agents of the United States and the State of New York have subjected me to discrimination and incitement to discrimination:
On the basis of my having studied the German language.
On the basis of my religious and philosophical beliefs.
On the basis of my political and other opinions.
On the basis of my national origin (incitement of Holland, Denmark, and Belgium so to discriminate).
On the basis of my physical disabilities.
On the basis of my personal lifestyle and sexual behaviors (actual, presumed, or maliciously fabricated).
The law protects everyone, without exception or distinction. The Constitution and the human rights treaties are the supreme law of the land. There is no excuse for the coverup that has now spanned the administrations of three presidents. On October 24, 1990, in the heat of a political campaign, then-White House spokesman Marlin Fitzwater discussed Republicans who opposed the President's policies. He said that, while they were free to "say whatever they want," they would be penalized in some mysterious way that he would not specify, except to hint that the President's critics would "suffer in their private purgatories." "If they can sleep with their conscience, let them try." When pressed for an explanation, he smirked, "If I told you, it wouldn't be a surprise." Though he later claimed that no actual retribution would be taken, he never did define a "private purgatory" or indicate by what means President Bush's critics would be thrust into it. He never explained how someone acting according to the dictates of conscience would then find his sleep disturbed by the very conscience he had obeyed.
I have spent more than three thousand five hundred days in Marlin Fitzwater's "private purgatory." Few others, I fear, would last a week. Government by torture, terrorism, and blackmail hardly accords with the Constitution. The surreptitious takeover of the United States Government by satanic intelligence agents in league with unreconstructed Nazis from the Republican National Committee is a horror that no-one should tolerate. Please take notice. Please respond. Please insist that the Executive Branch of government fulfill its responsibility under Constitution and Treaty.

Thorough and honest investigation of my charges by any of the authorities who have thus far refused to do so would expose the full scope and gravity of this sickening crime against humanity, and probably many others as well.
