All of my dogs are sold with written health guarantees.
I guarantee the following: ALL DOGS AND PUPPIES

1. A dog purchased from me is guaranteed against Distemper, Hepatitis, Leptospirosis, Parvo and Corona Virus as long as immunization is continued, as scheduled, by a licensed Veterinarian and normal care is given to the dog for (90) Ninety days from date of purchase.

2. If the dog dies within (4) Four years of age from a problem related to a genetic defect, not here-to-fore called to your attention or sold "AS IS" at a reduction, the dog will either be replaced with another dog 100% or at half price according to the conditions involved. (MY CHOICE) If a replacement dog is ever required I will provide one as soon as I have one of equal quality and value available.

3. Under NO CONDITIONS will I replace a dog, where I am not advised of its being ill beforehand, or, "put to sleep" without my permission.

The Following applies to SHOW DOGS OR SHOW PROSPECTS ONLY
If purchasing a dog from me for showing in conformation, I guarantee the following to (18) eighteen months of age: BITE (level or scissors), HIPS (up to two(2) years of age), TESTICLES (in males--both to be descended). I DO NOT guarantee a dog to finish it's Championship Title, I only guarantee that the dog is within the Standard and has no disqualifying faults.
It is your responsibility to train and continue to socialize this dog. If you take it home and do not properly train and continue to socialize it, IT WILL NOT SHOW. Hard work and training comes with making a dog a Champion and they are your responsibility.

BULL ROCK KENNEL'S PUPPY BUYER AGREEMENT/CONTRACT

The breeder(s)/seller(s) and the buyer(s) agree to the following conditions of sale:

  1. That the buyers are purchasing for the price of $_____ a American Pit Bull Terrier/American Staffordshire Terrier puppy in good health.
  1. (One of the following paragraphs will appear in this section, depending on the breeder's evaluation of the puppy being purchased and the buyer's stated purpose for purchasing a dog).

(A) This puppy is being sold with the understanding that it appears to have some potential to be successful in the conformation show ring. However, the seller makes no representations or warranties as to puppy's ability to succeed in the show ring, but will be happy to evaluate the puppy for the buyers as it grows and to assist them in any way if they should decide they want to show it.

(B) This puppy is being sold as a "show quality" puppy. The seller does not guarantee or represent that the puppy will finish its breed championship. However, the seller feels that it has the potential to do so and the buyer agrees to see that the dog is shown until it either finishes its AKC/UKC championship or until the seller has released the buyer from that obligation. The seller will work closely with the buyer to see that this happens.

  1. The buyer is free to name the dog: however, the registered name must begin with the kennel name of Bull Rock, as in "Bull Rock's Blue Baron."
  1. In the event the buyer should wish to sell or give away the dog at any time during its lifetime, it is agreed that the seller will be contacted first and be given the first opportunity of finding the dog a new home.
  1. The buyer agrees to have the dog's hips X-rayed and the X-rays sent to the Orthopedic Foundation for Animals for reading and evaluation at the age of 24 months. The breeder is to be notified or sent a copy of the OFA reading and the OFA number. This requirement may be waived if the dog is spayed or neutered.
  1. The buyer agrees to keep the dog safely confined and under control at all times. It is not to be permitted to run at large unattended in such fashion that it could be a danger to itself or to other pets or livestock in the community.
  1. The seller agrees to refund to the buyer one half of the registration fee of a basic obedience class, said refund not to exceed $25.00, upon proof of successful completion of such a class.
  1. Any additional terms pertaining only to this particular puppy are as follows:

LIMITED WARRANTY

The seller warrants the puppy for two years against the hereditary condition of hip dysplasia and any hereditary eye conditions that affect the sight of the dog. Should the puppy develop any of these conditions before the age of two years, the buyer agrees to replace the puppy when a suitable puppy of the seller's choice becomes available or to make a suitable adjustment in the purchase price. Said adjustment not to exceed one third the price of the puppy nor be less than $100.00. During this two year warranty period, should a dysplastic condition be of such a severe nature that it would result in the death of the puppy, the puppy would be replaced with one the seller determines to be of equal value as soon as such puppy becomes available. In the event of a mild dysplasia, which does not show up until the OFA reading at two years of age, an adjustment equal to the difference between the purchase price and the price being charged by the breeder(s) for pet quality puppies at the time of the purchase will be made if section eight (8) above indicates that the puppy was a bitch purchased for breeding purposes. The seller also warrants that at the date of the sale the puppy is sound, healthy and is a true representative of the breed. The seller's obligation to the buyer shall be limited to taking the puppy back and/or adjusting the sales price as stated above.

 

DISCLAIMER

There are no warranties which extend beyond the description on the face here of, the warranties or merchantability and fitness for particular purpose are specifically disclaimed, as are all other representations to the buyer. The seller specifically excludes any liability for any incidental or consequential damages. The seller shall not be responsible for expenses or inconveniences which might be incurred or experienced with respect to the puppy. Nor shall the seller be liable for loss caused by improper care.

SAMPLE
SALES AGREEMENT

This agreement is made and entered into this _____________ , 2001 by and between George Arceo/Bull Rock Kennel (hereafter "Seller"), and _____________ (hereafter "Buyer"), for the purpose of setting forth the terms and conditions of the purchase by Buyer of a purebred American Pit Bull Terrier/American Staffordshire Terrier from the litter whelped on _____________ 2001, out of Sire: _____________ AKC# _____________ UCK#__________ & Dam _____________ AKC# _____________ UKC# ___________, Currently known as " _____________ ", (hereinafter referred to as Dog) For good a valuable consideration, the seller agrees to sell and the buyer agrees to buy (1) one female/male dog from the litter described above. Buyer will pay for the dog in accordance with the terms of this contract. Sale is contingent on Full Veterinary Approval within 5 Days.

Ownership of the dog will be transferred to the Buyer for the sale price of $_____________ , to be paid as follows: $_____________ paid on ______________as a non-refundable deposit, the balance of $_____________ to be paid on or before the dog leaves the Seller's premises. If the balance is not paid by ______________, this Agreement shall be canceled and the Buyer forfeits the deposit given hereunder. Payments must be made in cash or money order. All other arrangements must be made in advance and in writing signed by both Buyer and Seller.

This dog is being sold as a pet. The dog being sold as pet has limited American Kennel Club (AKC) registration and limited United Kennel Club (UKC) registration, and there will be no consideration for breeding, No litters produced by the breeding of this dog will be accepted by The American Kennel Club or The United Kennel Club for registration. Limited registration precludes Buyer from showing dog in conformation shows. Said registration entitles Buyer to register dog with AKC and attend sanctioned obedience trials. It shall be understood that at the time of sale this dog is NOT considered to be of show or breeding quality, but is representative of its breed and is structurally and temperamentally suited as a pet. The Seller guarantees that the dog is free of hereditary defects to the best of his/her knowledge at the time Buyer assumes ownership.

If the dog is unsatisfactory and is to be returned to Seller, it must be done within the time limit of one (1) weeks from the date the dog was delivered to Buyer. The dog is to be returned to Seller at Buyer expense and must be in the same physical condition as when it left Seller in order for a full refund of any purchase or deposit moneys to be returned. One third of the sales price is to be forfeited if the dog is returned for any other reason than failure to pass Veterinarian examination.

Seller guarantees that dog is in good health and has received appropriate medical inoculations and care including parvo inoculations. Seller will provide Buyer with a medical chart detailing treatment dog has received under Seller's care and future care Seller feels is essential to dog's well being. A health certificate from a veterinarian will be provided to Buyer upon request at time of delivery if requested. Seller recommends no rabies shot on said animal until the age of 5 (five) months unless required by local ordinance of Buyer's residence.

Buyer agrees that he/she is not acting as an agent in the purchase of this dog and that Buyer will not sell this dog or its progeny to any agent or pet store.

The Buyer and Seller agree to a two year warranty against crippling/disabling hereditary genetic defects. Determination of constitutes a hereditary defect is to be made by the unanimous agreement of two Veterinarians agreeable to both parties. One of these Vets is to be a tenured faculty member of an accredited University Veterinary Teaching Hospital or Board Certified in the applicable specialty. Cost of the opinions is to be assumed by the buyer. If a problem develops that is proven to be the Seller's responsibility, the Seller will either (a) replace the dog (b) reimburse the Buyer for veterinary treatment of that problem or (c) A refund of 100% of the purchase price, provided the living dog and its registration papers are returned to seller. The choice of options will be the Sellers. The Seller is not liable beyond the original purchase price, and must be promptly notified of any problems in writing by the veterinarian. In case of death an autopsy must be obtained at the Buyer expense within 24 hours of death to establish cause.

Should Buyer decide to relinquish ownership of this puppy/dog at any time during its life for any reason other than those directed by law, Buyer agrees to return puppy/dog to Seller as fast as possible by safest means possible that will not endanger the life, welfare or well-being of dog. All costs incurred for the return of the puppy/dog as well as any expense resulting from medical treatment and/or training, reconditioning or socialization will be the responsibility of Buyer. All registrations (litter & permanent) must accompany the dog. This dog may not be sold, placed or in any means ownership relinquished to another party unless agreed upon by Seller and expressed in writing by Seller to Buyer. If at any time Buyer is unable or unwilling to provide for this puppy/dog it must be returned to Seller under the terms specified above.

Buyer agrees that the dog will reside at the home of the Buyer, have access to a fenced yard, not be chained or tethered; and will be provided with proper housing; diet; proper grooming; annual shots according to AVMA guidelines; and exercise. Buyer agrees to be responsible for all actions of the dog and to exercise precautions. The buyer will keep seller informed of significant any health, temperament or behavior problems encountered throughout the dogs life. The Buyer will notify the Seller in writing of an address change or telephone number change within eight (8) weeks of such a change.

If delivery is requested by Buyer, it shall be by air-freight, prepaid to a designated location. Buyer is solely responsible for costs of crate, insurance during shipment , and cost of freight charges. If Seller has to purchase crate prior to shipping, Buyer shall reimburse Seller in full for this cost.

Other Conditions and/or Contingencies or Costs:

The Buyer agrees that he/she us not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or it's any of it's progeny to any agent, pet store, or guard dog business. The intent of this contract is to provide Buyer with a quality pet. No warranties or guarantees other than those stated have been given or implied.

This agreement is governed under the laws of the State of Michigan and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller, and any actions resulting from non-compliance of the agreement will be settled in the County of Baraga, in the State of Michigan. Purchaser will be held liable for all legal fees and court costs. Any placement costs, maintenance costs, boarding, medical and associated miscellaneous costs related to this puppy/dog will be the responsibility of Purchaser. This Agreement is made and signed by both parties to insure the well being and protection of this dog. Should the terms of this agreement be violated, whether incidentally or deliberately, Breeder will pursue her options as stated in this Agreement to the fullest.

Liquidation damages in the amount of $3500.00 will be payable to Breeder by Purchaser in addition to the above costs and expenses.

Further, I agree to abide by the letter of the terms and conditions as well as the spirit of this agreement. I am aware of and fully understand the possible consequences of breaching this agreement. Personal Pickup:
Bull Rock Kennel's will assist with reservations, if required, for anyone wishing to pickup their dog in person. No guarantee is made to the availability of motels or bed and breakfast facilities. I will, however, make every attempt to assure that your visit here is as comfortable and convenient as possible, I will even put you up at my house.
Commercial Carrier:
The buyer assumes all costs, responsibilities, and liability related to shipping a purchased dog including, but not limited to: air, land, or water transportation; quarantine expense; other vaccinations not included in the "Sales Contract"; food, care, injury, death and other health related issues; and all other third party handlers. Bull Rock Kennel's will, however, assist the purchaser to arraign transportation and/or deliver the animal to the Las Vegas/McCarran airport , or to a commercial carrier designated by the buyer and within a 100 mile radius of Pahrump, Nevada.
Shipping Costs:
Bull Rock Kennel's uses USAir Airlines at this time for shipping. The rates for shipping, using cargo service costs from $120 and up, plus tax. And, depending on where you live, the dog might have to change planes. McCarran requires night time flights in the summer. If the dog needs to change planes Bull Rock Kennel's requires that you use USAir Priority Pet VIP service, because there is no mandatory layover, it costs $220 or more, plus tax. Another cost in shipping is the kennel/crate, Bull Rock Kennel's will supply a kennel for transportation if desired at a cost of $50.00 (which is our cost, so the price might fluctuate slightly) or you may ship me a kennel to use. The airlines require a veterinary health certificate which is different then the health certificate supplied by my veterinarian, this certificate costs $35.00 (a copy of this certificate is sent to the state of Nevada). Bull Rock Kennel's has listed these prices for your information only and may change at any time. I believe it is important that there is no 'hidden costs' in buying a dog from me.
