The Will of Ann (Evans) Pottenger -- Prince George's Co., Maryland

My 7th great-grandmother, daughter of Richard Evans and Elizabeth Hall, was born about 1696 in Calvert County, Maryland. She married Robert Pottenger, son of John Pottenger and Mary (mnu), December 2, 1718 in Prince George's County, Maryland. They had a total of 8 children:

In the name of God, Amen, I, Anne Pottinger, of Prince George’s County, in the province of Maryland, widow, being in good health and of sound mind and memory, thanks be given to Almighty God for the same. Considering the uncertainty of this mortal life, and being desirous to settle my affairs in time, do make this my last Will and Testament, hereby revoking and making void every Will heretofore by me made.

First, I recommend my soul to Almighty God, my creator, hoping for salvation through the merits of our Blessed Saviour, Jesus Christ, and such worldly goods as it hath pleased God in great mercy to give me, my will is that the same be bestowed in the following manner.

Item. I give and bequeath twenty five pounds in current money to be applied by my Executor to build a wall of brick or stone around the grave yard on the plantation where I now dwell.

Item. I give and bequeath unto my four daughters (viz), Elizabeth Crampkin, Ann Beall, Rachael McGruder, Eleanor MacGill, and my granddaughter, Ann Pottinger, daughter of my son, Robert Pottinger, deceased, all my wearing apparel, to be equally divided among them, share and share alike, and my further will is that my daughter, Elizabeth Crampkin, shall have my chaise and chaise horse(?).

Item. I give and bequeath unto my brother, Samuel Evans, and my sister, Priscilla McClain, each a suit of mourning apparel.

Item. I give and bequeath unto my beloved grandchildren, Robert, Ann, and Rachael, sons and daughters of my son, Robert Pottinger, deceased, sixty four pounds current money, in which is to be included a negro woman named Phyllis, and the said negro is to be my granddaughter, Rachael’s, part, the said Phyllis to be appraised with the rest of my estate, and if appraised to more than the said sixty four pounds, the estate to be paid it out of the sixth part of the remainder of my estate which I shall hereafter bequeath unto the said Robert and Ann. Otherwise, if appraised to less than the said sixty four pounds, the remainder is to be equally divided between the said Robert and Ann. But if any of the said children should die before they come to age, or have issue, their part or parts shall go to the survivor or survivors.

Item. I give and bequeath unto my beloved grandsons, Allen Bowie, John Bowie, Robert Crampkin, Basil Crampkin, and Richard Pottinger Crampkin, sons of my daughter, Elizabeth Crampkin, sixty four pounds current money to be equally divided among them.

Item. I give and bequeath unto my daughter, Ann Beall, wife of James Beall, sixty four pounds current money.

Item. I give and bequeath unto my daughter, Rachael McGruder, wife of Zadock McGruder, sixty four pounds current money.

Item. I give and bequeath unto my daughter, Eleanor MacGill, wife of Thomas MacGill, sixty four pounds current money.

Item. I give and bequeath unto my beloved grandchildren, Robert and Ann, son and daughter of my son, Robert Pottinger, one sixth part of the remainder of my estate (except as before excepted) to be equally divided between them, but if either should die before they come to age or have issue, their part shall go to the survivor.

Item. I give and bequeath unto my beloved grandsons, Allen Bowie, John Bowie, Robert Crampkin, Basil Crampkin, and Richard Pottinger Crampkin, sons of my daughter, Elizabeth Crampkin, one sixth part of the remainder of my estate, to be equally divided among them.

Item. I give and bequeath unto my beloved granddaughters, Elizabeth and Sarah Smith, daughters of my daughter, Mary Congrove, one sixth part of the remainder of my estate to be equally divided between them.

Item. I give and bequeath unto my daughter, Ann Beall, wife of James Beall, one sixth part of the remainder of my estate.

Item. I give and bequeath unto my daughter, Rachael McGruder, wife of Zadock McGruder, one sixth part of the remainder of my estate.

It is further my will that if any claim or claims be brought against my estate for rent or rents of land by Rachael or Robert Pottinger, widow and son of my son, Robert Pottinger, or any other person for them, that the said claim or claims (if recoverable or recovered by law) be paid out of the legacys I have heretofore bequeathed unto my grandchildren, Robert, Ann, and Rachael, son and daughters of my son, Robert Pottinger, and of this, my last Will and Testament, I constitute and appoint my son-in-law, Thomas MacGill, my whole and sole Executor. In witness whereof, I have hereunto set my hand and affixed my seal the eighteenth day of May, Anno Dom. 1767.

Signed, Sealed, Acknowledged, and Declared by the said Ann Pottenger to be her last Will and Testament in presence of:

John Kingsbury

Maryland, Prince George’s County, on the third day of February, Anno Domo, 1768, came John Kingsbury and made oath on the Holy Evangelists of Almighty God, that he did see Ann Pottenger, late of said county, widow, deceased, sign and seal the within instrument of writing and publish the same as her last Will and Testament, that at the time of her so doing, she was (to the best of his apprehension) of sound memory and of a disposing mind, and that in her presence, and at her request, he did subscribe the same as a witness, when Thomas Crampkin, Jr. did the same. Sworn before me day and year aforesaid.
