The U.S. District Court judge hearing the terrorism case wants to give Moousaui, a foreign national, the right to question other al-Qaida suspects detained outside America.
Prosecutors, fearing national security would be hurt if details were disclosed about sensitive interrogations or statements made by the other prisoners, are seeking relief from a circuit court of appeals.
Military tribunals are designed to handle such cases. Civilian courts are not.
