Republican mantra vilifies some judges as "activists" pursuing the Democratic Party's liberal agenda.

But, horrors, one conservative judge really deserves that partisan label:

Federal district judge Henry Hudson of Virginia, who struck down as unconstitutional the health-care overhaul's key mandate for individual coverage.

Judge Hudson did not recuse himself even though he's financially involved in Campaign Solutions Inc., an online communications firm hired by the GOP to fight the "Obamacare" legislation.

He owes his robes to Dubya, who appointed him to the federal bench in 2002.

The legislation doesn't take effect until 2014. The Obama Administration plans to appeal Judge Hudson's ruling, which did not affect other provisions of the law.

Two other judges have rejected other challenges to the law and one other decision is pending.

Judge Hudson'sk decision was based on "an individual's right to choose to participate."

Whoa, Your Honor. You mean we can choose not to participate in Social Security or in paying taxes?

Who'd have thunk it? (19 DECEMBER 2010)
