To the Honorable the Court of Probates in and for the State of New York
The Petition of Phinias Alvord most respectfully -----
That John Day (who was a Soldier in the last revolutionary War) was at the
time of his death an Inhabitant of the State of Massachusetts to wit of
Easthampton in said State and left a widow named Eleanor , and seven
children to wit Joseph aged about twenty three years now or late an
Inhabitant of Northhampton in Massachusetts aforesaid, Abigail aged about
twenty one years of the same place, Hannah aged about twenty years of the
same place, Asa aged about nineteen years of Easthampton in said State,
Moses aged about Sixteen years of Northhampton in said State, Eleanor aged
about fourteen years of the same place and Submit, aged about ten years of
the same place—
That the said John Day died at Easthampton in Said State intestate sometime
or about the year 1790 [could be 1798] leaving property in this State to be
administered—
That your Petitioner the said Phineas married Rachel Judd a sister of
Eleanor the widow of the said John Day and that the said widow is an
Inhabitant of Northhampton in Massachusetts aforesaid but has (although
requested by your petitioner) declined to take out Administration on the
Estate of the said John Day deceased.  Your Petitioner also states that he
is a Creditor
of the Estate of the said John Day. Your Petitioner therefore humbly prays
that this Honorable Court may (after causing all proper parties to be

grant Administration on the Estate of the said John Day in this State.
And your Petitioner shall ever pray ---
