Last Will and Testament of Samuel Day
Book "0" page 254, Urbana, Champaign County, Ohio

In the name of the Benevolent Father of all:
I Samuel Day of the County of Champaign and State of Ohio, do make and publish this my last will and testament:

Item 1st--I give and devise unto my Daughters Elizabeth Swatz (late Elizabeth Day) and her heirs one
half of the following Described land, Situate in Champaign County Ohio. Viz The East half of the
North East quarter of section Nineteen, in Township three of Range Eleven, MRs
Containing Eighty acres and twenty six hundreths of an acres, also ten acres off the West side of the
West half of the North West quarter of Section thirteen, of Township three of Range Eleven MRs, with
the understanding that the death of my Daughter Elizabeth Swatz, her portion of the above tract or
parcel of land shall be divided equally among her children, (except John Swatz whom I do hereby disinherit,)

Item 2nd--I give and bequeath unto my Daughter Rebecca Stapleton (late Rebecca Day) and her heirs
the remaining one half of the above Described tracts or parcels of land, of which I have devised one half to my
DaughterElizabeth Swatz.

Item 3rd--I give and bequeath unto my Daughter Elizabeth Swatz the desk which I now have and to my
Daughter Rebecca Stapleton my Clock which I now have, and all the Stock household goods, furniture,
provisions, and other goods and chattels which I may have at the time of my decease to be divided equally
between my said Daughters Elizabeth Swatz and Rebecca Stapleton share and share alike; they however,
selling so much thereof as may be sufficient to pay my just debts.

Item 4th--I do hereby nominate and appount David N Jones Executor of this my last will and testament,
hereby authorizing and empowering him to compromise, adjust, release and discharge, in such manner as
he may deem proper, the debts and claims due me. I do also authorize and empower him, if it shall become
necessary in order to pay my debts, to sell, by private sale, or in such manner, upon such terms of credit,
or otherwise, as he may think proper, all or any part of my real estate, and deeds to purchasers to execute,
acknowledge and deliver, in fee simple.

I do hereby revoke all former wills by me made.
In testimony whereof, I have hereunto set my hand and Seal, this twenty ninth day of June in the year of
Our Lord One thousand eight hundred and forty eight.

Estate Sale:
The State of Ohio Champaign County Vs
We the undersigned do make solemn oath that we will truly, honestly, and impartially, appraise the Estate
and property that may be exhibited to us belonging to the estate of Samuel Day, deceased and perform the
other duties required by law of us in the premises as appraisers vs, according to the best of our knowledge
and ability.
