________________________________/ CONSENT ORDER FOR STAY OF EXECUTION DURING PENDENCY
Of Michigan on Nov. 16, 1999______________ District Court Judge This matter having come on motion of defendant/appellant, and the parties having stipulated hereto, and the Court Being otherwise fully advised in the premises, IT IS ORDERED: 1. Execution of the October 29, 1999 Order of the Court requiring the destruction of defendant’s dog Ato is stayed during pendency of defendant/appellant’s appeal; 2. During pendency of the appeal, subject dog shall remained confined on the premises and under the control of the Humane Society of Huron Valley undersuch terms and conditions as the Humane Society of Huron Valley deems appropriate. Ato shall remained confined to his cage or the restricted night-run area at all times, no persons other than Hiroshi and Seiko Ikuma, employees of the humane Society or the City of Ann Arbor Animal Control Division shall be permitted to enter the restricted area where Ato is confined. Attorney Donald Perkins may, with the consent of the Humane Society and at such times and under such conditions as set by the Humane Society, also enter the area where Ato is confined, during the pendency of the appellate process. If the Humane Society so requests, attorney Perkins will execute a signed waiver of liability on behalf of the Humane Society. 3. Any confinement costs as set by the Humane Society of Huron Valley shall be paid by defendant/appellant; 4. Defendant/appellant’s Bond on Appeal, already posted as a $200.00 cash bond, is accepted. Any additional bond for stay of execution, if required by the Court, shall be a personal bond by defendant/appellant. Date: _11/16/99____
