Remember Ato! |
It's almost one year ago
that Ato disappeared from his cruel, injustified imprisonment at the HSHV
and so escaped out of the hands from all those so called 'officials', who
had only two things in mind.....killing a dog, who did nothing wrong and
only protected his owners' property against an uninvited intruder and secondly
discriminating his owners by all means. In spite of a jury trial, where
Ato was found not guilty, the City of Ann Arbor, initiated by the assistant
city attorney ('Lost Prize West'), continued chasing Ato and his owners
in an unrespectful, unethical way with the support of Ann Arbor News.
Until to-day it's unknown where Ato is and in what condition. Take a moment to think about this whole case. Your beloved pet becoming startled by some stranger, uninvitedly entering your house and showing a normal 'defensive' behaviour. What then can follow is not a nightmare, but something very realistic. In all probability you will loose your best friend and it will cost you lots of money. And what about all the emotions you have to go through? When you are a pet-owner it can happen to you to-day or to-morrow! Be aware of that.... You have to proof that your pet is not dangerous, but when the officials don't even listen and don't take your arguments and facts serious...., You are lost!..... Why? Very simple.......there is money involved and the life of an animal is seen as not relevant in such cases......... |

Ato, now and then, in what can happen to a dog owner, be aware!
Be aware, all those who were after Ato's euthanization and the (blood) money, that Ato is and will be one of your nightmares coming true one day! |

, incl. facts and the irroneous and outrageous way the Newtons, the assistant
city attorney Robert West, Ann Arbor News and others acted, is well described

crimes against animals and humans are hold against the light.

Well, Ann Arbor News has
an 'open' Forum where you can enter your opinion or whatever issue you
like to share or discuss with others. So far so good.......But it becomes
weird when you are noticing that the AA News editor suddenly is deleting
your entry......
That is what happened to Linda Porasso, who entered in the forum under entry #831 comments on Dee Strom's 'letter to the editor'...... It's very clear that AA News is censoring and hate to see publications or Forum entries which are in favor of Ato. Ann Arbor News is a newspaper
reporting against Ato and the Ikumas. First of, all this newspaper applies
a publishing policy which is one-sided in favor of the Newtons, the City,
Humane Society of Huron Valley (HSHV), but ignores Supportive letters to
Ato. The publications on Ato in that newspaper are inaccurate and not complete.
Many supporters sent letters to the editor, which were either ignored or
returned by the news editor Mr. Ed Petykiewicz (e-mail editor @aa-news.com)
with the remarks such as "we published numerous letters expressing support
for Ato" or with the statement 'for Ann Arbor citizens only'!
Yes, we are talking about Ann Arbor News, which can be found on the World Wide Web with the strategy to be viewed all over the world ! For Ann Arbor citizens only......Discrimination ? When you read all the articles on Ato in Ann Arbor News it is clearly proven that this newspaper knows unethic reporters too. Reporters, who are either impressed or forced by a person called Mr. Robert West, the assistant city attorney, who stated in this newspaper that "We lost the Prize"! |
Of course
the news editor has the rights to publish what he thinks is good enough
for his readers,,,,,,
Well this newspaper does that very well and is misleading, like Mr. West, his readers. |
On September 8, 2000 Ann Arbor News published on their site for the World Wide Web a 'letter to the editor' written by a person called Dee Strom. Of course a citizen of Ann Arbor ! |
The article, "Unfortunately, 'bad' dogs really do exist", tries to have believed that Ato is vicious. Without any knowledge of the facts and never seen Ato, Dee Strom thinks that she is able to judge. Dee Strom is a danger not only for Ato, but for all animals and humans in this world. She does not comprehend the laws of nature and is very proud of having 18 years of animal rescuing experience. 'Chow-Chows are genetically agressive'. Such a statement proves that she has not understood dog's behavior at all. Welcome, Dee Strom, in the world of the Newtons, Mr. West, the HSHV, Ann Arbor News and judges! |

Ann Arbor, August 22- September 3, 2000 "Moot....." |
On August 10, 2000 an Application for Leave to Appeal to the Michigan Supreme Court was filed; a Motion for Immediate Consideration and a Motion to Stay the execution. |
On August 22, 2000 the court denied the Application for Leave to Appeal and Motion to Stay. The Motion to Stay was denied as 'moot'..... |
Being denied as 'moot' is a statement that there is nothing to be decided. This ruling, which is erroneous, resulted from Ato being kidnapped from the Humane Society of Huron Valley (HSHV) by unknown persons on July 16, 2000. |
But can this case be 'moot' since Ato's body has not been found ? Really strange..... |
Because Alex Newton trespassed into the Ikuma's home, they have lost Ato ! This is the fact, regardless of the status of Ato. |
Two possible scenarios can be considered. (1) The City of Ann Arbor, conspiring with the Courts and the Newtons, paid to have taken Ato from the HSHV. Once taken, the Courts could rule that the matter is 'moot'. (2) Another theory is that persons, who were concerned on Robert West's erroneous statements (that Ato was killed prior to Seiko Ikuma exhausting her appeals ), which were published (and may be in conspiracy with..) in the Ann Arbor News, took action in order to prevent Ato from being killed. |
As a result, the law has been violated thereto by taking Ato. |
The Ikumas have always scrupulously respected and followed the law. Because of the whole incident, which started with the first criminal trial and culminating with the taking of Ato, the Ikumas filed a complaint with the United States Attorney for the Eastern District of Michigan. A request was made to investigate all the parties, entities and judges involved with this case. |
The Ikumas have exhausted their state remedies as is mandated by law. Accordingly, they are now in the position to persue their case in Federal Court. |
The fight is not over and will continue until justice is done. |

Ann Arbor, August 10, 2000 "West versus Ato" |
Since
begin of August the city (through assistant city attorney Robert W. West
) is starting to react to Ato's supporters and stating that "one has been
wrongly informed by the 'Save Ato's websites'". West is talking about
"lies and distortions, which are now broadcast worldwide".
"It's too bad that good people can be so easily misled by lies and distortions", he states. So supporters, there we are......West lost 'his prize'........and starts now washing his hands in innocence......, meanwhile blaming those who are concerned 'being misled'. |
Mayor Sheldon seems to have a problem. A very serious problem ! |
Time will show, who misled who and until then we will continue to report the facts on Ato. |

Ann Arbor, August 8, 2000 "Supreme Court Procedure" |
Attorney Mullins mailed an Application for Leave to the Michigan Supreme Court, as well as a Motion to Stay Enforecement and Motion for Immidiate Consideration. The hearing is scheduled for August 22, 2000. The procedure finds that no one will appear before the judges at hearing. The seven judges of the Supreme Court will make a decision. |

Ann Arbor, 25-30 July 2000 "The war continues!" |
The
war continues until justice is done for Ato and the Ikumas ! The goals
remain a safely return of Ato home and a compensation for violating the
Ikuma's civil rights. Support is received from all over the world and lots
of disagreements on the articles appearing in certain newspapers (e.g.
Ann Arbor News), which are colored, incorrect, misleading and mainly referring
to abusive statements of the assistant city attorney 'Robert W. West'.
Even copies of letters are received which are directed to the city mayor
on Robert W. West's behavior (e.g. "we lost the prize !").
When do these newspapers take the time to research for the facts ? Options for them are, among other resources, checking this homepage (e.g. standby/summary, or forgotten facts ). |
The Ikumas are still devastated but still prepared to fight further until justice is done for Ato. The next step is the Supreme Court. |
On July, 27, 2000 the Ikumas were interrogated at the sheriff's office for the disappearance of Ato. Please keep in mind that the Ikumas have no clue at all on this kidnapping (neither were they involved), which has been an action of an animal liberation movement. |
A support meeting is scheduled on Tuesday, August 15, 2000, 7:30 p.m. in Ann Arbor. Details will follow in due course. |

Ann Arbor, 25 July 2000 "Interpretation of Ato's case" |
Ato's
case is hitting the news around the world......., of course in particular
in the Michigan area, but nevertheless the case is known around the world
in the meantime. Unfortunately certain newspapers in the Michigan area
are not presenting the facts in the right context. When looking to the
various quotes it's very clear that the assistant city attorney of Ann
Arbor, Mr. Robert West, is mostly quoted. This person is playing a powergame
without any ethics. Just some quotes he made during last week until now.
"We're not going to drop this case.We're winning.We just lost the prize", West said "Ato has a history of biting people, including the daughter of a friend whom the Ikumas were visiting", West said. "He also bit a woman who stuck her hand through an open car window, although the woman was at fault in that incident", West said. "The best one was when the owners hired an animal evaluator to evaluate the dog's temperament .... and the dog jumped up and bit her in the arm on the way to the neck," West said. "If she knows the dog is safe, she may not worry about signing the waiver," West said. "I am not willing to accept her denials that she has no knowledge of where the dog is." First of all the Ikumas are currently completely devastated and at a nervous breakdown. They have fought for Ato during 23 months in order to get him home safely. The Ikumas believed and still believe in justice and were hoping on Ato's return. THEY WERE NOT INVOLVED IN THE KIDNAPPING AT ALL !! It has been an action from an Animal Libaration Movement group, referring to a statement of Gary Yourofsky founder of Animals Deserve Absolute Protection To-day and To-morrow. The Ikumas had no part in that at all !!! It's better that West is looking to the facts , which he can find by clicking here at; "Standby/Summary". Ann Arbor, 21 July 2000 "Application for Leave to Appeal Denied" |
The Michigan Court of Appeals denied Seiko Ikuma's Application for Leave to Appeal, and consequently her motion to stay proceedings of the District Court was denied. No opinion was written. |
This is very disappointing , but not dismaying ! |
Attorney Mullins will now file, on behalve of Seiko, an Application for Leave to Appeal to the Michigan Court in Michigan's highest court and so likewise seek a stay of the proceedings of the Distric Court, which among other things, ordered the destruction of Ato. |
Today, pursuant to the trial
court’s order, but under protest and under duress, Seiko Ikuma signed and
filed an Authoriation to Euthanize Dog with the office of the City Attorney
for Ann Arbor. It is hoped by taking this action, Seiko will not have to
appear in court on Monday and show cause why she should not be held in
contempt of court for not complying with the order by Judge Julie Creal-Goodrich,
of June 30, which required her to sign such an order or
contract with a veteranarian to euthanize Ato. |
It is Seiko's position by signing the authorization, with or without the written statement which states that she signed the authorization “pursuant to court order, under duress and protest.” It has no legally binding effect because in signing the authorization, she was not exercising her free will to do so. |
Comment; It's good to know that Ato is away from these dirty hands of the City Attorney and the Court., who are becoming more and more unethic and obviously are obsessed .Just remember the statement of Robert West; "We're not going to drop this case.We're winning.We just lost the prize". |

At TV 50 10 " O'clock News" Gary Yourofsky of the Animal Libaration Movement has been interviewed. He related that someone connected with the movement took Ato, they are holding Ato and he is safe. |
Nevertheless the attorney Mullins and the Ikumas will persue their appeals to get the order for destuction overturned. |

Ann Arbor, 18 July 2000 "ATO NO LONGER AT THE HSHV !!" |
The Ikumas are desperated and devastated since they were informed by their attorney Mullins that Ato has disappeared at the HSHV ! Until now (7/19)there is no clue what exactly happened or where Ato currently is. Attorney Mullins received on Monday, July the 17th., at about 9:00 A.M., on his answering machine, a report from the HSHV on the 'escape' of Ato. Washtenaw County sheriff's are investigating this terrible event. It's unclear who did this, which heavily devastated the Ikumas, who are completely inconsolable. |
When someone knows where Ato currently is please contact attorney Mullins in Ann Arbor or leave a 'private message' in Ato's Guestbook. It's too important for the Ikumas to learn where Ato is and in what condition. This is an urgent matter ! |
Attorney Mullins has contacted Saul Green, the US Attorney for the Eastern District of Michigan. A written request will follow for having investigated either by him or the FBI the whole affair. Included will be the request to investigate the denial of the Ikuma's Civil Rights, Conspiracy to Deny the Ikuma's civil rights, hate crimes against them, as well as obstruction of justice in the prosecution of the criminal and civil cases against the Ikumas. Further requested will be to investigate the City of Ann Arbor and its agents, the Newtons and the Humane Society of Huron Valley (HSHV) and its agents, and others who have led to the Ikumas being treated so shabbily. |
Believe it or not this is
what the assistant City attorney, Bob West,
of
Ann Arbor stated to FREEP in Detroit;
"We're not going to drop this case.We're winning.We just lost the prize" We are hearing here a person who is so convinced about his qualities, that he considered it ethic to release such a statement !! Time will learn and it well might happen that Bob West will be disqualified by his so called own supporters at the end. Nobody will feel sorry for him then...... |
In the meantime the whole judicial procedure continues and Mr. Mullins has filed a motion to stay the proceedings of the trial court. |

The entire proceedings since June 16 appears to be a series of Judicial exercise in which the prosecution side tries to outdo the defense side, by issuing one item on time or delayed time... |
June 16, 2000 The court, modifying the order of October 29, 1999, as follows: Defender, Seiko Ikuma contacts directly with veterinary services to provide the euthanasia, or Defender signs an appropriate authorization and waiver of liability to effectuate the terms of the Court order. |
June 30, 2000. The city prosecutor sent Defendant a form of authorization and release of liability for Defendant’s signature. (Seiko Ikuma has not received anything from the court!!!!!!) |
The Defendant has not communicated with the court or not signing the form of authorization and release of liability. Communication with the court is attorney Mullins' job. The city prosecuting attorney, Bob West, had not told Defenders' attorney Mullins that he got a signature from the Judge Goodridge on July 6, 2000. |
The City motioned for Show Cause Hearing before Julie Creal Goodridge on Tuesday, July 18, 2000 at 10:00 a.m. |
As of June 30, 2000, the Ikumas and their counsel Ray Mullins have not been presented by the court or the City prosecuting attorney about the two alternative ways of euthanizing Ato or the authorization and release of liability form in writing until 7/14 at 4 p.m. The 7/14 was the first time for the Ikumas to read these documents at attorney Mullins' office ! |
Seiko will never ever sign any document for having Ato euthanized in whatever way or by whom. in this case !! |
On June 30, 2000, Judge Julie Creal Goodridge denied the stay of execution of Ato, but allowed attorney Mullins to appeal her order to the Michigan Court of Appeals. Ray Mullins also received on the 7/14 the information that Judge signed the order on July 6. |
Ray Mullins has appealed to the Michigan Court of Appeals on Judge Goodridge’s decision to euthanize Ato. He has already received a number for the appeal. |
Now that the necessary documents can be attached to the appeal, Ray Mullins can proceed with his filing for the Stay of Execution on Monday, July 17, 2000. |
It's quite obvious that the City of Ann Arbor (via the City attorney Bob West ) is applying a timed strategic tactic and consequent demanding Ato's euthanization !!! |

The city of Ann Arbor is pertinent
in ordering Ato's euthanasia !
Currently the necessary actions are undertaken in order to prevent that happen. As an outcome of the 1st. Supporters meeting a 'flyer/leaflet' will be released within 1 to 2 days and distributed in both the Ann Arbor area and through Ato's homepage. Further a draft for a petition is almost ready which supporters can use in writing their concern and protest to the Mayor of Ann Arbor. Please check on a regular base Ato's homepage ! |
