STATE OF WISCONSIN, Plaintiff MOTION TO DISMISS UNCONSTITUTIONAL STATUTE: MEDICAL USE

The defendant, appearing specially by her attorney and reserving her right to challenge the court's jurisdiction, moves the court for an order dismissing this action.  This motion is brought pursuant to §971.31(2) and (5), Stats., on the grounds that the court lacks jurisdiction over the defendant because the statute the defendant is alleged to have violated, section 961.41(3g) (e), incorporating §961.14(4) (t), denies defendant's rights to Equal Protection under the law, thereby denying the defendant Due Process of law, all in violation of the rights guaranteed by Article IV, sections 1 and 2, the 5th and 14th Amendments to the United States Constitution, and Article I, sections 1 and 8 or the Wisconsin Constitution.

IN FURTHER SUPPORT, the defendant submits the attached brief.
