If a broker is selling a house, you figure he knows the place pretty intimately - after all, he talks a good game about the new kitchen, the big closets, the heated garage. What you need to worry about, though, are the home's features that he keeps to himself. Steve Van Grack, chairman of the Maryland Real Estate Commission, says, "We have had cases where [brokers have] been deceptive about termites and flood damage." You'd figure that the home inspector, who comes to check out the place before you close the sale, might notice those things. And he will - if he's not in cahoots with the broker. "Realtors give potential homebuyers lists of home inspectors," says S. Woody Dawson, a structural inspector in Connecticut. "Those are people who will rubber-stamp the house" in return for repeat business. As one who works outside those lists, Dawson says that he sometimes butts heads with overly controlling brokers. "One time I had a broker tell me that unless I told her the results of my inspection - which is confidential between myself and my client - she wouldn't let me get up on the roof. I got out my ladder and told her that unless she was big enough to stop me, I was going up there. She wasn't big enough." One common flaw: Unethical posting houses that sold long ago but they keep them on their website. While the mistake can be simple negligence, others think that it's a bait-and-switch-style ploy. "It brings people in, but it gets them upset when they find out that the property's [gone], "If a broker has to advertise properties that are already sold, it tells you that he doesn't have enough inventory to keep his [roster of houses] full." Not saying they are a broker owned when selling a home. CODE OF ETHICS FOR REALTORS FIND ONE YOU CAN TRUST- Don't get excited when someone tells you they will give you a "marketing plan"....We all have them! There are some unethical realtors who will continue to keep a sold home up on their website to draw people into calling them. (Bait and switch! )Ask them how long that house has been sold and if you continue to see a sold house on their website, click here next choose property search and then address to verify that it is even a legitimate address!! Another deceptive "bait and switch" practice- We have seen some dishonest realtors who will feature a nice looking home on their website but for the address will use an incorrect address for Springfield, Missouri. When you try to find the house there is no such address! (They might have put a wrong directional on the address such as N. (north) when the street only runs east and west. When when you check it that way there is no street number with the one they gave. tend to drag down their peers making us all look like "bottom feeders"
when in reality most realtors aren't. BIG ONE TO CHECK OUT! Another sleazy tactic used by unethical realtors is to lie to you about square footage. This is usually done by a realtor when it is a home they own that they are trying to make more money on.

When the real estate salesperson answers
an incoming call at the real estate company from someone wanting to list
their home and sneak around and buy it themselves this also unfairly cuts
the real estate company out of commission that is rightfully theirs. If you encounter a realtor who wants to buy your home for themselves do NOT, I repeat DO NOT deal with them. It is in your financial best interest to go with a different realtor who does not have an interest in buying your home. Remember a realtor, using the inside scoop can buy your home at a lower price so they can profit from it. MISSOURI BROKER DISCLOSURE FORM states: Seller's or Landlord's Limited Agent- Duty to perform the terms of the written agreement made with the seller or landlord, to exercise reasonable skill and care for the seller or landlord, and to promote the interest of the seller or landlord with the utmost good faith, loyalty and fidelity in the sale, lease or management of property.While this one may not be considered unethical it is questionable. As a seller, it is better that your listing agent not be the one who brings you a buyer. The reason for this is that they can use the inside information to share with the buyer as they prepare the offer. Although on their website in trying to win the listing they may say otherwise, many unethical realtors aren't as concerned with making sure you get "top dollar" as they are with making sure the house is sold quickly so the listing agreement doesn't run out and you go to another realtor, before they get paid a nice listing commission. One of the many reasons why houses don't sell quickly is due to to Real Estate agents who want the listing so badly they will ignore the comparative market analysis and let the seller tell them instead how much they expect to get. An overpriced house sits on the market while homes around them change owners.
The realtor listed on the sign is acting in the best interest of the seller and will be paid a percentage of what the home sells for. If you are interested in buying the home call a realtor of your own who can negotiate for you a lower price on the house (as your Buyers Agent , who looks out for your best interest)! There is no charge to the buyer.If you are selling your home yourself and a Realtor tells you they have a buyer to bring you and want you to sign an agreement be careful! This will allow them to collect a commission for you if the house does not sell to the person they bring you (which it probably won't!) and it sells later to someone else!!
Be sure to interview realtors and don't just go with the first one you call! To "get the listing" some Realtors may allow you to set the price of your home instead of showing you the "Comparable Market Analysis" which will keep your home from being underpriced.
