Before we accept your form, you must agree
to the following, and fully agree
You must be in a
sponsorship contract with {AOD} for a
minimum of 3 months. In this time you
are not allowed to withdraw from the
contract. If {AOD} suffers losses, and
you are responsible for it, {AOD} will
pursue legal action.
You must inform {AOD} a
minimum of 4 weeks before pulling out of
the contract. Rule 1 does apply in this
case. If you pull out of the contract
immediately, and {AOD} suffers losses
which it cannot cover, {AOD} will pursue
legal action.
You must inform {AOD}
approx. 28 days before lowering the
amount that you are sponsoring {AOD}
for. If this results in losses which
{AOD} cannot cover, {AOD} will pursue
legal action.
The services that {AOD}
can provide on your behalf depends on
how much time and money you are willing
to put into the clan. The more money
that you provide us with, the more
services that we can provide for you.
This will only happen if {AOD} is able
to make a net profit of 15% (15 cents
from every dollar) of sales from its
server(s) and all costs of server
hosting have already been covered.
The more sponsors there
are, the less that you can provide {AOD}
with. At any time within the contract
you can increase your payments to the
clan, but you need to look at rule 3 for
decreasing the payments.
If there are any losses
in which {AOD} cannot cover for, the
clan will have to pull out of its
contract with its ISP, and its contracts
with its sponsors unless another sponsor
can be found within the next payment.
This will not result in legal action if
{AOD} has been warned before hand.
Payments must be made at
the 1st of every month. If you wish to
pay at another time, you must notify
{AOD} approx. 21 days before hand so
that payments may be re-arranged if
required. If this results in losses in
which {AOD} cannot cover, legal action
may pursue.
If you wish to change
how much you intend to pay for the
month, please notify BlackMagic on the
day of your previous payment, the amount
you intend to pay the next month. The
amount that you wish to decrease by
cannot be and more than $300, depending
on current sponsorship, intake, and
profits.
{AOD} will _NOT_ host
any software that is faulty and can
result in a fault with their server(s)
that can prevents them from being used,
or forces {AOD} to replace them. {AOD}
in the case of replacing them will take
legal action against the sponsor who
supplied {AOD} with the faulty software
{AOD} will _NOT_ host
any online shopping centre software
unless {AOD} makes a profit from every
sale (15%). This will cover the cost of
maintenance, and hardware for {AOD}'s
server(s).
{AOD} will _NOT_ be
hosting any websites on their server(s)
until they have they have a secure
sponsorship, that will cover the cost of
setting up and running additional
servers.
{AOD} will _NOT_ act as
a storage facility of any kind. We will
_NOT_ under any circumstances host
software or provide software and
hardware that is illegal that may result
in a legal action against {AOD}. If any
software or hardware that is being sold
off an {AOD} server that is found to be
illegal, {AOD} will be taking legal
action against the individual or
corporation who sells the equipment. We
will _NOT_ under any circumstances,
accept any type of software that has
been copied, exploited, exchanged, sold,
represented, hired, borrowed, hosted,
manipulated, or edited without the
express wish of the Creator and/or the
Publisher.
{AOD} server(s) will not
act as a wares hosting site, and will
not accept any software that is illegal
in anyway. We will host MP3's if they
are not illegal copies of an original
sound track, but are rather free ware,
and can be exchanged by the wish of the
Creator/Publisher.
{AOD} server(s) will not
act as an online exchanging service. All
software that is place on one of our
server(s) will be monitored, and scanned
by our own programs before they are
accepted onto the server. If a user
attempts to place a file larger than
10mb on one of our server(s), that user
will be blocked, banned from using the
{AOD} server(s), and their IP's recorded
and handed to the correct authorities.
{AOD} will _NOT_ be a
host to any known hackers or hacking
software. Therefore we will not host any
programs that are in any way affiliated
with or directly with known hackers. We
will not host any anti-hacking software
_UNLESS_ it is proven safe. If there is
found to be any hacking software, or
unsafe anti-hacking software on the
system, the IP will be handed over to
the correct authorities.
We will host only what
like, and will charge for hosting. We
will provide fast upload and download
speeds, and will act as a web server if
required. We will host safe, and secure
software and provide users with a
service for web hosting. Because of our
restrictions, the more traffic we
receive, and the more requests we get
for a certain service that one of
{AOD}'s sponsors requested, the amount
of payment will be increased so that
additional servers can be purchased to
carry the burden of the requests.
Without warning, {AOD}
can cancel any sponsorship contract with
any sponsor, and not be responsible for
the losses. The reasons of which this
may happen are: Unable to pay the
required monthly usage fee, unable to
sustain contracts with other sponsors,
legal action, legal action against
{AOD}, sponsorship no longer required,
service no longer provided, service too
expensive, not enough profit to cover
additional costs and the server no
longer runs.
By clicking on the
button below, you agree and are bound to
the above. Any breach of these rules on
your part, may end up in a legal action.
So please make sure that you have read
through the above, as {AOD} excepts _NO_
responsibility for any representation,
misuse or misconduct on _YOUR_ behalf as
apart of this contract. We will uphold
our end of the contract, and honour it
for as long as it lasts, without abuse.
