Powergen UK Rules and Regulations ODEON FILMS/ INDIGO BOOKS & MUSIC INC. SPIDER CONTEST RULES As of January 31, 2003 1. NO PURCHASE NECESSARY. The Odeon Films / Indigo Books and Music Inc. SPIDER Contest opens on Tuesday, February 4, 2003 and closes on Monday, March 10, 2003. To enter the Contest, visit www.chapters.indigo.ca/spider and complete the online entry form, including your name, address, daytime telephone number, email address, and your IREWARDS number. To be eligible for the Early Bird Draw (see Rule 2(a) below), your entry must be received by 11:59 p.m. on Monday, February 17, 2003. To be eligible for the Main Draw (see Rule 2(b) below), your entry must be received by 11:59 p.m. on Monday, March 10, 2003. Limit: Only one entry per person. 2. RANDOM DRAWS: (a) Early Bird Draw. The early bird draw will be conducted on Tuesday, February 18, 2003 from all entries received by 11:59 p.m. on Monday, February 17, 2003. (b) Main Draw. The main draw will be conducted on Tuesday, March 11, 2003 from all entries received by 11:59 p.m. on Monday, March 10, 2003. The Draws will be conducted at Indigo Books and Music Inc., 468 King Street West, Toronto, ON, M5V 1L8. Odds of winning depend on the number of eligible entries received. All selected entrants will be notified by telephone or email. To be confirmed a winner of a Prize, selected entrants must correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by telephone or email. If the selected entrant cannot be contacted and the skill test administered within three (3) business days of the Contest Draws, including the draw date, then the Prize may be forfeited and awarded to an alternate entrant. 3. PRIZES: (a) Early Bird Prizes (100): There are 100 prizes available to be won in the early bird draw. Each prize consists of admission for two (2) individuals to a special invitational movie screening of Spider in Toronto on Monday, February 24, 2003. Approximate retail value is $25.00 CAD. (b) Main Prizes (10): There are 10 prizes available to be won in the main draw. Each prize consists of one (1) Spider prize pack, which contains: one (1) Spider book by Patrick McGrath; one (1) Spider T-shirt and three (3) movies by David Cronenberg in DVD or VHS format. Approximate retail value is $100.00 CAD. 4. ELIGIBILITY. The Contest is open to all residents of Canada, excluding Quebec, who are eighteen (18) years of age or older. Employees of Indigo Books & Music Inc., Odeon Films Inc., an Alliance Atlantis Company, (collectively, the "Contest Sponsors") and their respective parents, subsidiaries, affiliates, advertising and promotional agencies, and members of their immediate families and households are not eligible to participate. For these Rules, "immediate family" means spouse, mother, father, sisters, brothers, sons and daughters. 5. CONTEST COMPLIANCE AND RELEASES. Before being confirmed a winner, selected entrants may be required to sign a Declaration of Compliance with the Contest Rules and Release of Liability Form releasing the Contest Sponsors, their respective parents, affiliates, subsidiaries, advertising and promotional agencies, and all of their respective directors, officers, shareholders, employees, agents, representatives, successors and assigns (collectively, the "Releasees") from any and all liability arising in connection with the Contest or a Prize. Guests accompanying winners of the Early Bird Prizes may also be required to sign and return a Publicity and Liability Release prior to their attendance at the screening. By accepting or participating in a Prize, each winner (and his/her guest, where applicable) consents to the use of his or her name, city of residence, voice, photograph or likeness for any publicity carried out by the Contest Sponsors, or their promotional agencies, in all media in connection with the Contest, without further consideration. 6. PRIZE INFORMATION. The Contest Sponsors reserve the right to substitute a Prize, or any component of a Prize, for equal or greater retail value. All Prizes are non-transferable, must be accepted as awarded and cannot be exchanged for cash or other substitutes, except at the Contest Sponsors' sole discretion. 7. MISCELLANEOUS. By entering the Contest, each entrant agrees to be bound by the Contest Rules and all decisions of the Contest Sponsors, which shall be final and binding in all matters relating to the Contest. Entrants who do not abide by these Contest Rules are subject to disqualification. The Contest Sponsors reserve the right to amend or terminate the Contest, without notice, if any factor interferes with its administration as contemplated by these Contest Rules. All entries shall become the property of the Contest Sponsors. The Contest Sponsors and the other Releasees shall not be responsible for indecipherable, incomplete, lost, misdirected or late entries, which will be void. The Contest Sponsors and the other Releasees are not responsible for any problems which may arise, including but not limited to, technical malfunctions of telephone networks or telephone lines, servers or providers, computer hardware or software, viruses, bugs, or failure of any entry to be received by the Contest Sponsors for any reason including but not limited to traffic congestion on the Internet or any website. The Contest Sponsors and the other Releasees are not responsible for damage to a computer system resulting from participation in the Contest. Any attempt to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should an attempt be made to do so, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. No telephone contact or other correspondence will be entered into except with the selected entrants. The Contest is void where prohibited by law and is subject to all federal, provincial and municipal laws and regulations. The Contest and the terms and conditions contained in these Contest Rules shall be exclusively governed by and construed in accordance with the laws of the province of Ontario or Canada, as applicable. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. 8. PRIVACY NOTICE. The Contest Sponsors' purpose for collecting personal information on the online entry form is to administer the contest. Entrants will not receive any future communication from the Contest Sponsors unless consent is obtained by the Contest Sponsors.
