CONSTITUTION AND BY-LAWS OF THE
BERKELEY MIDDLE SCHOOL BAND BOOSTER CLUB
MONCKS CORNER, SOUTH CAROLINA


ARTICLE I
Name and Purpose

Section I:This organization shall be called the Berkeley Middle School Band Booster Club.
Section II:The object and purpose of the Club shall be to promote a high level of moral support for the Band, and such financial support as the resourcefulness of its members may provide.
Section III:This Club will have no influence in the operation of the Band and will not attempt to force any decisions on its Band Director.

ARTICLE II
Officers
Section I:The Officers of the Club shall be a President, Vice-President, Secretary, Assistant Secretary, and Treasurer. The officers will normally be referred to as the Executive Board. Nominations will be submitted at the March meeting and the elections will be held at the May Meeting. All elected officials must be members of the Berkeley Middle School Band Booster Club and will be parents/guardians of a member of the band. The officers will serve a 16-month term from May to September. The Band Director may not be an officer of the club, but will be ex-officio member of all committees.
Section II:President: The President shall be the Chief Officer of the club and shall perform such duties as presiding over the meetings and other duties normally belonging to this position. He/she shall have the power of extraordinary occasions to call special meeting of the membership, upon giving due notice to the members and stating in this notice the purpose of this special meeting. He/she will be an ex-officio member of all committees. He/she shall require reports of the Secretary, Treasurer, and/or chairperson of committees. He/she may make decisions on emergency situations that arise after contacting the Band Director and/or a member of the Executive Board.
Section III:Vice-President: The Vice-President shall perform all duties of the President in his/her absence. He/she shall be charged with developing membership strength of the organization, and will serve as chairperson of the Fundraising Committee.
Section IV:Secretary: The Secretary shall have the following duties. He/she shall keep full and accurate records of all meetings of the Club and of all matters of which the President shall have ordered a written record. He/she shall, with the aid of the President, carry on all correspondence of the Club. He/she shall keep a complete and accurate roll of the members, officers, and committees of the Club.
Section V:Assistant-Secretary: The Assistant Secretary shall assist the secretary as needed and shall perform all duties of the Secretary in his/her absence. He/she shall also serve as the Chairperson of the Publicity Committee.
Section VI:Treasurer: The Treasurer shall keep an accurate account of all monies on hand or under his/her control, and render a report at each meeting, or as required by the President as to the financial standing of the Club. He/she shall pay bills after approval from the Band Director and purchase items deemed necessary for the club. The Treasurer records will be audited by a special committee appointed by the President during the month of May.
Section VII:Upon resignation of any officer a new nomination and election must be held. In the absence of a position, any Executive Officer can fill the vacant position upon the approval of the Band Director and remaining Executive Board until such election is held to fill position.

ARTICLE III
Membership
Section I:All parents of the members of the Berkeley Middle School Band and all other persons who express an interest in the promotion of this band and complying with the provisions of the Constitution and By-Laws shall be eligible for membership in the Berkeley Middle School Band Booster Club.
Section II:Each member in good standing shall have the right of a vote on all issues which shall come before the organization for the decision and no member shall be permitted to cast the vote of another member. No member shall be allowed to vote on any issue before having paid the membership fee.
Section III:Membership fee shall be $2.00 per member per year.

ARTICLE IV
Committees

Section I:The Berkeley Middle School Band Booster Club shall have the following committees:
  1. Membership
  2. Publicity
  3. Telephone Tree
  4. Fund Raising
  5. Chaperons
Section II:The committee membership will be formed from volunteers at the September meeting. The committee members at their first meeting will elect the committee chairpersons, with the exception of the Publicity and the Fund Raising committees.


ARTICLE V
Meetings
Section I:The Club shall hold monthly meetings on a special day of each month during the school year from August through May each year.
Section II:Order of Business:
  1. Call to order by the President
  2. Pledge to the American Flag
  3. Prayer
  4. Reading of Minutes of previous meetings from Secretary, Treasurer, Committee Chairpersons Reports, Correspondence, etc.
  5. Unfinished Business
  6. New Business
  7. Adjourn

ARTICLE VI
Amendments
Section I:This Constitution and By-Laws may be amended by two-thirds majority of the members present, providing that notice of the proposed amendment be given to all members prior to the meeting.

ARTICLE VII
General Provisions
Section I:All checks issued by the club will have two signatures. Authorized signers will be Treasurer, President, Vice-President and Band Director.
Section II:Upon approval of the Band Director, all invoices or bills for the operation of the club will be automatically paid by the Treasurer.
Section III:The Band Director has control of money spent to improve the Club or Organization or Band.
