Re Claim  # C-01-005, C-01-097

 

Dear Ms. H:

I am in receipt of your letter dated February 15, 2001 whereby you are denying my claim # C-01-097.  Having been a police sergeant for 15 years, Public Safety is a sincere concern of mine. I have had an opportunity to observe many instances and causes of traffic accidents.  It is my professional opinion that any tire that can come apart this easily without warning for any reason, and cause this much damage should be considered an extreme danger and safety hazard to the motoring public.  I feel quite certain that any reasonable and prudent person would agree with this.

It is my sincere desire to resolve this matter without litigation, however, make no mistake, your refusal to accept responsibility for the damage caused in this claim will force me to proceed with any and every public and private avenue available to me for relief in this matter. 

Additionally, I am sincerely concerned that the general public should be notified immediately that if they are driving on General Tires that may have been patched due to a minor puncture, they should completely remove and replace that tire out of concern for the safety of themselves and their families.  This tire simply came apart at 70 mph with no warning or indication of any problem whatsoever.  Had there been another vehicle near mine when it occurred, it could have had, and very possibly would have had, fatal results.

This tire was carefully examined by a General Tire dealer in West Houston, prior to my returning it to you who, in his professional opinion, stated that the tire should not have come apart as it did.  It was he who provided me with the information regarding how to contact you, and suggested that I file a claim with General Tires.  I am also respectfully requesting that the tire be returned to me in the same condition that you received it in order to be sent to another expert for an additional professional examination to be used as evidence in a lawsuit should it become necessary.  Please return it via UPS ground, COD.

 This letter is to serve as formal notification, that in the event you have failed to notify me within 10 days of receipt of this letter of your intent to settle this claim, legal action will be taken against Continental General Tires.  After suit is filed, any attempt to settle this claim must include any and all attorney’s fees and court costs resulting from the filing of this action.
