Joseph Smith's will


Will Jefferson county Will book p. 385-389

Know all men by these present that I Joseph smith of the county of Jefferson in the State of Ohio, knowing the uncertainty of life and being desirous of setting my worldly affairs previous to my decease, do make and publish this my last will and testament.
1st it is my will that after my decease my wife rosanna Smith shall hold the land inJefferson County. The land I now live on during her life by the said Rosanna smith y wife paying the annual expenses of the land such as taxes and other necesary expenses duringh er life, except the fulfillment of an article given to B McFarlan and at the expiration of the said McFarland lees, a renewable lees to be given to him and his wife susanna smith my daughtr which lees may continue during the life of her mother, it is ment a renewable lees of the house the said McFarlan now lives in and wife, by not to assign and at my decease a sale f all the movable property to be made and after all my just debts paid,the one third of the amount given to my wife, the balance to be divided equally with my sons and daughters and at the death of my wife Rosanna Smith, or before if al y family can agree on it. a sale of my lands to be made and a divide made as may hereaftr be mentioned.
1st it is my will that a equal divide be made after the decease of my wife rosanna smith by making such reductions as may be herein afterwards memtioned.
ist it is my will to make a reduction of my daughter Jane Mitchell of 500 or less, it being the amount of a note I hold on thomas Mitchell. this note was taken of thomas Mitchell the 7th of April, 1846 but if the said shall lift his note from me, my daughtr Janean Mitchel is willed her equal share.
2nd It is my will that y daughtr elenor Beatty Dillon is to have a reduction of 200 dolars this is for money loaned to Moses Dioon and mad a book account in1845, an after the recuction Elenor Beatty Dilon is to have an equal share.
3rd It is mywill that my son James Reed Smith is to have a reduction made of 1000 dollars, it is for money loaned a note I hold in date 18th March 1845, after a just and fair settlement with my son James Reed Smith it is my will he shall have an equal share.
4th It is my will that Andrew Duncan Smith my son is to have a reduction made of 3oo dollars, it is for a book account of money given to him in the years of our lord 1822 and 22nd March 1834 & 44 & 45 & 46 & 47 and after the reduction the said A. D. Smith my son is to have a equal share with oll his brothrs and sisters.
5th It is my will that Joseph Lafayette Smith my son is to have a recuction of 300 dollars this was money loned and made a book acount of in, or in part in the years 1845 & 46 and part 1850 and there is a note given James R. Smith my son of 450 dollars or more, this was a note I gave to Jaaames R. Smith my son for Joseph L and George B Smith my sons. It is my will that Joseph and George pay that note to their brother James Reed as they got that money n 1850 for California After this reduction it is my wll that Joseph L Smith my son shall have an equal share with his brothers and sisters...
6thIt is my will that George Barten Smith my son is to have a equal share made after a reduction of 125 dollars and an equal share to pay the note with Joseph L Smith to his brother James Reed,my son, and then George B. shall have an equal share with his brothers and sisters, after those sanctions are met.
7th It is my wil that Susanna Baxter McFarlin my daughter shall have the house she lives in during the time of her lees, and a renewable lees, if her mother is agreed, and further it is my will that susan B. McFarlin shall have a equal share with her brothers and sisters and no reduction is to be made.
8th It is my will that Joseph Easten Mitchel my grand son is to have 200 dollars at the divide, this is for the name.
9th It is my will that Ferdinand Spangler Smith my son shall havea equal share with his brothers and sisters.
10th It is my will that Rosanna dilon my grandaughter is to have 200dollars, for the name of her grandmother at the divide.
11th It is my will that Joseph Smith McFarlin my grandson is to have 200 dollars at the divide or when the divide is make and further I do Nonimate James r Smith my son and Thomas Mitchel my son-in-law my executors, of this my last will and testament.

Codicil to will
Whereas I Joseph Smith of warren Township Jefferson county Ohil did on the 22nd of March 1854 make my last will and testament, I now make this my codicil to the aforesaid last will and testament in manner following:
item1st I give an decise to my wife rosanna in addition to what I have gave her in my aforementioned will, all my beds and bedding and houseand kitchen furniture.
Given under my hand and seal this fourth of April 1856.
